CHAPTERIII
OwnershipofMineralsandMineralLands
SECTION3.AllminerallandsofthepublicdomainandmineralsbelongingtotheState,andtheirdisposition,exploitation,
development,orutilization,shallbelimitedtocitizensofthePhilippines,ortocorporations,orassociations,atleastsixtypercentumofthe
capitalofwhichisownedbysuchcitizens,subjecttoanyexistingright,grant,lease,orconcessionatthetimeoftheinaugurationofthe
GovernmentestablishedundertheConstitution.
SECTION4. The ownership and the right to the use of land for agricultural, industrial, commercial, residential, or for any
purpose other than mining does not include the ownership of, nor the right to extract or utilize, the minerals which may be found on or
underthesurface.
SECTION 5. The ownership of, and the right to extract and utilize, the mineral included within all areas for which public
agriculturallandpatentsaregrantedareexcludedandexceptedfromallsuchpatents.
SECTION6.Theownershipof,andtherighttoextractandutilize,themineralsincludedwithinallareasforwhichTorrenstitles
aregrantedareexcludedandexceptedfromallsuchtitles.
SECTION7.Withtheexceptionsofthesoilwhichsupportsorganiclife,andofordinaryearth,gravel,sand,andstonewhich
areusedforbuildingorconstructionpurposes,thedispositionofwhichisgovernedbyActNumberedThreethousandseventyseven,as
amended by Act Numbered Three thousand eight hundred and fiftytwo of the Philippine Legislature, all inorganic substances found in
natureinsolid,liquid,gaseous,oranyintermediatestatearemineralswithinthepurviewofthisAct.
SECTION 8. Mineral lands are those in which minerals exist in sufficient quantity or quality to justify the necessary
expenditurestobeincurredinextractingandutilizingsuchminerals.
SECTION9.Theexploitationofpublicandprivatelandsforminingpurposesshallbegovernedbyexistinglaws,rulesand
regulationswhichmaybepromulgatedthereunder.
SECTION 10. Subject to any existing rights, all valuable mineral deposits in public or in private land not closed to mining
location, and the land in which they are found, excepting coal, petroleum, and other mineral oils and gas, which are now governed by
special laws, shall be free and open to exploration, occupation, location, and lease, by citizens of the Philippines of legal age, or by
associations,orbycorporationsorganizedandconstitutedunderthelawsofthePhilippines:Provided,Thatatleastsixtypercentumofthe
capitalofsuchassociationsorcorporationsshallatalltimesbeownedandheldbycitizensofthePhilippines.
SECTION11.UpontherecommendationoftheSecretaryofAgricultureandCommerce,thePresidentmaysetapartmineral
landreservations,andheshallbyproclamationdeclaretheestablishmentofsuchreservations,andtheboundariesthereof,andthereafter
such reservations shall be closed or open to mining location or lease as the President may deem wise and may so provide in the
proclamation.ThePresidentmay,withtheconcurrenceoftheNationalAssembly,byproclamationalterormodifytheboundariesofany
mineralreservefromtimeorrevokeanysuchproclamation,anduponsuchrevocation,suchreserveshallbeandbecomepartofthepublic
domain as though no such proclamation had ever been made:Provided, however, that the President is hereby authorized to declare by
proclamation any mineral reserve, closed to mining location: Provided, further, That all mineral reservations set aside by the Chief
ExecutivepriortotheapprovalofthisActshallremaininfullforceandeffectandshallbeadministeredanddisposedofinaccordancewith
theprovisionsofthisAct.
SECTION12.Fromandafterthedateofproclamationofamineralreserve,ifthesamehasnotbeenproclaimedclosedto
mininglocation,thelandstherebymaybedisposedofonlyforminingpurposesashereinafterprovided.
SECTION13.Wheneverlandsarereservedforpurposesotherthanformining,theholdersofmininglocationsorleaseswithin
anysuchnewreserve,atthetimethereservationismade,shallcontinuetoenjoyallrightsaccordedthemunderexistinglawwithrespect
tosuchlocationsorleasesasifsuchreservationhadneverbeenmade.
SECTION14.Landswithinreservationsforpurposesotherthanmining,which,aftersuchreservationismade,arefoundtobe
more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such
reservationsbythePresidentwiththeconcurrenceoftheNationalAssembly,andthereuponsuchlandsshallreverttothepublicdomain
andbesubjecttodispositionundertheprovisionsofthisAct.
SECTION15.Landleasedforminingpurposesshallbeclassifiedasfollows:
FirstgroupMetalsormetalliferousores.
SecondgroupPreciousstones.
ThirdgroupFuels.
FourthgroupSalinesandmineralwaters.

FifthgroupBuildingstoneinplace,clays,fertilizers,andothernonmetals.
SECTION 16. Lands of the first group shall be those which contain any of the metallic elements or minerals, or their
combinations,suchasgold,silver,platinum,tin,chromium,iron,manganese,copper,nickel,lead,zinc,cinnabar,tungsten,andthelike.
SECTION17.Landsofthesecondgroupshallbethosewhichcontainmineralsmainlyusedforornamentalpurposessuchas
diamond,ruby,emerald,sapphire,topaz,amethyst,zircon,aquamarine,opal,jade,agate,tourmaline,beryl,garnet,turquoiseandthelike.
SECTION18.Landsofthethirdgroupshallbethosewhichcontaincombustiblesubstancesinsolid,liquid,gaseousform,such
aspeat,coal,mineraloils,naturalgas,oilshales,asphalt,andthelike,butnottherecentproductsoforganiclife.
SECTION19.Landsofthefourthgroupshallbethosewhichcontainsurfaceorsubterraneansolublesubstancesorwaters
whichbytheirmineralcontentsareclassifiedasmineralwaters,suchassalt,nitrates,sulphurated,carbonated,sodic,calcic,andother
waters.
SECTION20.Landsofthefifthgroupshallbethosewhichcontainnonmetallicsubstances,suchas:
(a)Thoseusedforbuildingorconstructionpurposes,suchasmarble,granite,clay,andthelike.
(b)Asbestos,feldspar,lime,mica,guano,phosphate,potash,saltpeter,niter,andthelike.
(c)Othersubstancesusedinthemanufactureofpaints,ceramicsandfertilizersandforotherindustrialpurposes.
SECTION21.AerolitesorotherbodiescomingfromsiderealspacearemineralswithinthemeaningofthisAct,thedisposition
ofwhichshallbedeterminedbyregulations.
SECTION22.Minerallandsmaybeclassifiedundermorethanonegroup,dependinguponthenatureandusesoftheminerals
containedtherein.
SECTION23.ThemineralswhicharenotspecificallymentionedinthisAct,andnewoneswhichmaybediscoveredinthe
future,shallbeclassifiedundertheirpropergroups,whenevernecessary,andshallbeincludedthereinbylaworregulations.
CHAPTERIV
ExploitationandProspectingforMineralDeposits
SECTION 24. Prospectors may prospect for themselves, or for other persons, associations, corporations, or other entities,
qualified to locate mining claims and to acquire leases of mineral lands under the provisions of this Act. A proper power of attorney in
writingshallineachcasebegivenbytheemployertohisprospector,whichpowerofattorneyshallbedulyacknowledgedandshallbe
recordedintheofficeoftheminingrecorderconcernedcoincidentwiththerecordingofadeclarationoflocation.Regardlessofthenumber
ofclaimslocatedbytheprospectorforthesameprincipleinthesameprovinceorminingdistrict,heshallberequiredtorecordbutone
powerofattorneyinanysuchprovinceordistrict.
SECTION25.OfficersandemployeesoftheexecutiveoranyotherbranchoftheGovernmentwhosedutiesarerelatedtothe
administrationordispositionofmineralresourcesshallnotbeallowedtoprospect,locate,lease,orhold,directlyorindirectly,minerallands
inthePhilippines.

SECTION26.Prospectingmaybecarriedonwithinpubliclandsandprivatelandsinaccordancewiththeprovisionsofthis
Act:Provided,however,Thatinthecaseofprivatelandsnoprospectingshallbeallowedexceptbytheownerthereofduringtheperiodof
oneyearfromandaftertheeffectivedateofthisAct.
SECTION27.Beforeenteringprivatelandstheprospectorshallfirstapplyinwritingforwrittenpermissionoftheprivateowner,
claimant, or holder thereof, and in case of refusal by such private owner, claimant, or holder to grant such permission, or in case of
disagreement as to the amount of compensation to be paid for such privilege of prospecting therein, the amount of such compensation
shallbefixedbyagreementamongtheprospector,theDirectoroftheBureauofMinesandthesurfaceowner,andincaseoftheirfailure
tounanimouslyagreeastotheamountofcompensation,allquestionsatissueshallbedeterminedbytheCourtofFirstInstanceofthe
provinceinwhichsaidlandsaresituatedinanactioninstitutedforthepurposebytheprospector,orhisprincipal:Provided,however,That
theprospector,orhisprincipalupondepositingwiththecourtthesumconsideredjointlybyhimandtheDirectoroftheBureauofMinesor
bythecourttobejustcompensationforthedamagesresultingfromsuchprospecting,shallbepermittedtoenteruponandlocatethesaid
landwithoutsuchwrittenpermissionpendingfinaladjudicationoftheamountofsuchcompensationandinsuchcasetheprospector,or
his principal, shall have a prior right as against the world, from the date of his application. The court in its final judgment, besides
determiningthecorrespondingcompensationofthedamageswhichmaybecausedbytheprospecting,shallmakeapronouncementasto
thevalueofthelandandthereasonablerentalfortheoccupationandutilizationthereofforminingpurposesincasetheprospectordecides
tolocateandexploitthemineralsfoundtherein.
SECTION28.Noprospectingshallbeallowed:
(a)Inamineralreservewhichhasbeenproclaimedclosedtomininglocations.
(b)Inlandscoveredbypatentedminingclaims.
(c)InlandsinwhichmineralshavebeendiscoveredpriortotheeffectivedateofthisActandareclaimedbythediscoverer
orhissuccessorsininterest.
(d)InlandswhichhavebeenlocatedforminingleasesbyotherprospectorsundertheprovisionsofthisAct.
(e)Nearorunderbuildings,cemeteries,bridges,highways,waterways,railroads,reservoirs,dams,oranyotherpublicor
privateworks.
TheregulationstobepromulgatedunderthisActshallprescribeindetailthevariousrestrictionsunderthissection.
CHAPTERV
DiscoveryofMineralDepositsandLocationofMiningClaims
SECTION29.Therighttolocateaminingclaimshallinallcasesbebaseduponthediscoveryofmineraltherein.
SECTION30.Thefindingofmineralormineralsinplaceorpositionwhereoriginallyformedintherock,whetherassayinghigh
orlow,shallconstituteavaliddiscoveryforthelocationofalodemineralclaim.Thefindingofmineralormineralsinloose,fragmentaryor
brokenrocks,boulders,floats,bedsordepositswhetheringreaterorlesserquantities,orthefindingofthesameinformsotherthanthose

abovedescribedforlodemineralclaims,shallconstituteavaliddiscoveryforthelocationofaplacerminingclaim.
SECTION31.Alodemineralclaimisaparcelofminerallandcontainingavein,lode,ledge,lens,ormassoforeinplacewhich
hasbeenlocatedinaccordancewithlaw.Aplacerclaimisthatwhichdoesnotcomeunderthedefinitionoflodemineralclaim.
SECTION32.Incaseofconflictinglocations,priorityofdiscovery,followedbycontinuousoccupationandprospectingofthe
land, shall determine the right to lease the claims, subject to any question as to the validity of the location and record of the claim and
subjecttotheholder'shavingcompliedwithalltherequirementsofthelaw:Provided,however, That actual discovery of minerals made
priortotheeffectivedateofthisAct,beforeoraftertheenforcementoftheConstitution,shallconstituteavaliddiscovery,andthepersons
makingsuchdiscoveryshallhavethepreferentialrighttolocateandleasetheminingclaimscoveringthemineralsdiscovered,subjectto
theprovisionsofthisAct.
SECTION33.Immediatelyuponthediscoveryofmineralorassoonaspossiblethereafter,butnotmorethanthirtydaysafter
thedateofthesaiddiscovery,thediscovererorlocatormaylocateaminingclaiminaccordancewiththeprovisionsofthisAct,covering
thelandwherethemineralhasbeendiscovered.Ifnosuchlocationismadewithinsuchperiod,therighttolocateaminingclaimcovering
suchlandshallbedeemedtohavebeenwaived.
SECTION34.Withinsixtydaysafterthecompletionoftheactsoflocationofaminingclaim,ashereinafterprovided,thelocator
thereofshallrecordthesamewiththeminingrecorderoftheprovinceordistrictwithinwhichtheclaimissituated.Aclaimwhichshallnot
havebeenrecordedwithintheprescribedperiodshallbedeemedtohavebeenabandoned.
SECTION35.ThemaximumareawhichmaybeacquiredunderaminingclaimlocatedundertheprovisionsofthisActshallbe:
Firstgroup:
(a)Metalsormetalliferousoresinlodedeposits,ninehectaresforanindividual,anunincorporatedassociation,asociedad
anonima,alimitedpartnershiporacorporation.
(b)Metalsormetalliferousoresinplacerdepositsnottoexceedeighthectaresforanindividualnorsixtyfourhectaresfor
acorporation,sociedadanonima,orlimitedpartnership:Provided,Thatinthecaseofanunincorporatedassociationthearea
shallnotexceedeight(8)hectaresforeachmember,norsixtyfour(64)hectaresfortheentireassociation.
Secondgroup:
Preciousstoneswhetherinlodeorplacerdeposits,nottoexceedfourhectaresforanyqualifiedlocatororapplicant.
Fourthgroup:
Salinesandmineralwaters,nottoexceedfourhectaresforanyqualifiedlocatororapplicant.
Fifthgroup:
(a)Buildingstone,clay,fertilizer,andothernonmetalsinplacerdepositsnottoexceedeighthectaresforanindividualnor
sixtyfourhectaresforacorporation,sociedadanonima,orlimitedpartnershipProvided,Thatinthecaseofanunincorporated
associationtheareashallnotexceedeight(8)hectaresforeachmembernorsixtyfour(64)hectaresfortheentireassociation.
(b)Nonmetalsinlodedepositnottoexceedninehectaresforanindividual,unincorporatedassociation,asociedad
anonima,alimitedpartnershiporacorporation.
SECTION36.Thedispositionofthethirdgroupofminerallands,orlandscontainingmineralfuels,whetherpublicorprivate,
shallbegovernedbyActNumberedTwothousandsevenhundrednineteen,asamended,entitled"AnActtoprovidefortheleasingand
developmentofcoallandsinthePhilippineIslands"andtheregulationspromulgatedthereunder,andbyActNumberedTwothousandnine
hundredthirtytwo,asamended,entitled,"AnActtoprovidefortheexploration,locationandleaseoflandscontainingpetroleumandother
mineraloilsandgasinthePhilippineIslands"andtheregulationspromulgatedthereunder:Provided,Thatthegrantingofpermit,license,
lease, or concession of such coal, or petroleum land, shall be limited to citizens of the Philippines of legal age, or to associations or to
corporations organized and constituted under the laws of the Philippines:Provided, further, That the provisions of Acts Numbered Two
thousand seven hundred and nineteen, as amended, and Two thousand nine hundred and thirtytwo, as amended, to the contrary
notwithstanding,atleastsixtypercentumofthecapitalofsuchassociationorcorporationshallatalltimesbeownedandheldbycitizensof
thePhilippines.Alllicenses,concessions,orleasesfortheexploitation,development,orutilizationofsuchcoallands,orlandscontaining
petroleum and other mineral oils and gas, shall be for a period not exceeding twentyfive years, renewable for another period not
exceedingtwentyfiveyears.
SECTION37.Inthecaseofthefirst,second,fourth,andfifthgroupsofminerallands,nolocator,applicantorlesseeshallbe
entitledtoholdorleaseinhis,itsortheirownnamesorinthenameofanyperson,association,corporation,asociedadanonima,orlimited
partnership more than three lode mineral claims on the same vein or lode, or more than three placer mining claims, in the case of an
individual, or more than three placer mining claims in the case of a corporation, an association, a sociedad anonima, or a limited
partnershiponthesameplacerground.
SECTION38.Mining claims of the first, second, fourth, and fifth groups may be located either as lode or as placer claims,
dependinguponwhetherthemineraldepositsthereinarefoundinlodeorinplacerform:Provided,however,Thatifaparcelofland,by
reason of the nature of the mineral deposits found therein, is subject to either lode or placer location, the prior location of either class,
validlymade,shallprevail:Provided,further,Thatincaseaplacerlocationismadefirst,thelocatorthereofmustthereaftermakealode
locationinordertosecuretheminingrightstolodedepositsfoundwithintheboundariestoallmineralsofthegroupforwhichthemining
locationoftheplacerclaim:Provided,further,Thatincaseaplacerlocationismadefirst,thelocator,thereofmustthereaftermakealode
locationinordertosecuretheminingrightstolodedepositsfoundwithintheboundariesoftheplacerclaim:Provided,further,Thatinsuch
casesthelocator,orhissuccessorsininterest,shallbeentitledtoallmineralsofthegroupforwhichthemininglocationorlocationshave
beenmadeortheleasegranted,whichmayliewithinhisclaims,butheshallnotbeentitledtomineoutsidetheboundarylinesofhisclaim
continuedverticallydownward:Andprovided,finally,Thattheholderorlesseeshallhavepreferentialrighttolocateandleaseanymineral
depositsofanyothergroupfoundtherein.

SECTION39.Lodeclaims,whetherlocatedbyoneormorepersonsqualifiedtolocateminingclaimsunderthisActshallbe
locatedinthefollowingmannerandunderthefollowingconditions:
Anypersonsoqualifieddesiringtolocatealodemineralclaimshall,subjecttotheprovisionsofthisAct,enteruponthesameand
locate a plat of ground, measuring not more than three hundred meters in length by three hundred meters in breadth, in as nearly as

possible a rectangular form that is to say, all angles shall be right angles, except in cases where the boundary line of a previously
surveyedclaimisadoptedascommontobothclaims,butthelinesneednotnecessarilybemeridional.Indefiningthesizeofamineral
claim,itshallbemeasuredhorizontallyirrespectiveofinequalitiesofthesurfaceoftheground.
SECTION40.Alodeclaimshallbemarkedbytwoposts,placedasnearlyaspossibleonthelineordirectionofthelodeor
vein, and the posts shall be numbered one and two, and the distance between posts numbered one and two shall not exceed three
hundredmeters,thelinebetweenpostsnumberedoneandtwotobeknownasthelocationlineanduponpostsnumberedoneandtwo
shallbewrittenthenamegiventothelodemineralclaim,thenameofthelocator,andthedateofthelocation.Uponpostnumberedone
thereshallbewritten,inadditiontotheforegoing"Initialpost,"theapproximatecompassbearingofpostnumbertwo,andstatementofthe
numberofmeterslyingtotherightandtotheleftofthelinefrompostnumberonetopostnumbertwo,thus:"Initialpost.Directionofpost
numbertwo___________metersofthisclaimlieontherightand___________metersontheleftofthelinefromnumberonepostto
numbertwopost."
SECTION41.Whenaclaimhasbeenlocatedthelocatorshallimmediatelymarkthelinebetweenpostsnumberoneandtwo
sothatitcanbedistinctlyseen.Thelocatorshallalsoplaceapostatthepointwherehehasfoundmineralsinplace,oronthesurface
verticallyabovesuchpointifthediscoverybeunderground,onwhichshallbewritten"Discoverypost":Provided,Thatwhentheclaimis
surveyedthesurveyorshallbeguidedbytherecordsoftheclaim,thesketchplaninthedeclarationoflocationmadebythelocatorwhen
theclaimwaslocatedandrecorded,postsnumberoneandtwo,andthenoticeonnumberone,theinitialpost.Incaseswhere,fromthe
natureorshapeoftheground,itisimpossibletomarkthelocationlineoftheclaimasprovidedinthisAct,thentheclaimmaybemarked
byplacingpostsasnearlyaspossibletotheproperpositionofnumberoneandnumbertwoposts,andnotingthereonthedistanceand
directionofsuchpostsfromsuchpositions,whichdistanceanddirectionshallbesetoutinthedeclarationoflocationoftheclaim.
SECTION42. In addition to the requirements of sections forty and fortyone of this Act with regard to the placing of posts
numberoneandtwoonthelineoflocation,andtothemarkingofthelinebetweenthem,eachlocatorofthelodemineralclaimshallblaze
treesalongtheboundarylinethereofbyclearingorbymarkingthesamewithanyotherreadilydistinguishablesignsormarks,andshall
establisheachofthefourcornersoftheclaimbymarkingastandingtreeorrockinplace,orbysettingintheground,whenpracticable,a
postorstone.Eachcornershallbedistinctlymarkedwiththenameoftheclaim,thenameofthelocator,andthedateoflocation,andwith
suchwordsastoindicatethatitisthenortheast,southwest,orothercorner,asthecasemaybe,ofthelodemineralclaimconcerned,and
thepostsorstonesusedtomarksuchcornersshallbeasfollows:
When a post is used, it must be at least fifteen centimeters in diameter or twelve centimeters on each side by one hundred forty
centimeters in length, and where practicable, set forty centimeters in the ground and surrounded by a mound of earth or stone, one
hundredtwentyfivecentimetersindiameterbysixtyfivecentimetersinheightwhenastone,notarockinplaceisused,itmustnotbe
less than thirtyfive centimeters on each side by eighty centimeters in length, and must be set so as to project half its length above the
ground when a stone or rock in place is used, a cross must be cut in the stone, the arms of which cross must be at least twelve
centimeters long, intersecting approximately at right angles and in their centers, the cutting to be at least two centimeters deep. The
intersectionofthearmsshallconstitutethecorner.
SECTION43.Itshallnotbelawfultomovenumberonepostofalodemineralclaimbutnumbertwopostmaybemovedbythe
minerallandsurveyorwhenthedistancebetweenpostsnumberedoneandtwoexceedsthreehundredmetersinordertoplacenumber
twopostthreehundredmetersfromnumberonepostonthelineoflocation.Whenthedistancebetweenpostsnumberedoneandtwois
lessthanthreehundredmeters,theminerallandsurveyorshallhavenoauthoritytoextendtheclaimbeyondpostnumberedtwo.
SECTION44.Thelocationlineshallgovernthedirectionofonesideoftheclaim,uponwhichthesurveyshallbeextended
accordingtotheprovisionsofthisAct.
SECTION 45. Placer mining claims may be of an irregular pattern following the meanderings of a creek, river, or
streamProvided,Thatonplacergroundsnotconfinedtothebedsofsuchcreeks,rivers,orstreams,oronthoseextendingbeyondthe
banksthereof,placerclaimsshallbelocatedinasnearlyaspossiblerectangularform.
SECTION46.Thelocatorofaplacerclaimshallpostuponthesameanoticecontainingthenameoftheclaim,designatingitas
aplacerclaim,thenameofeachlocator,thedateoflocation,thenumberofthecornersoftheclaim,andthenumberofhectaresclaimed.
Heshallalsodefinetheboundariesoftheclaimbymarkingastandingtree,orrockinplace,orbysettingapost,stone,ormonumentat
eachcornerorangleoftheclaim.Thetrees,rocksinplace,stakes,stones,ormonumentsusedtomarkthecornersoranglesofaplacer
mining claim must be inscribed with a series of consecutive numbers, thus Corner No. 1, Corner No. 2, Corner No. 3, and so forth, in
clockwisedirection,andatleastthefourendcornersoftheplacerminingclaimshallbemarkedwiththenameoftheclaim,thenameof
thelocator,andthedateoflocation.Theposts,stones,ormonumentsusedtomarkthecornersofaplacerminingclaimmustbeofthe
dimensionsrequiredbysectionfortytwoofthisActfortheposts,stones,ormonumentstobeusedinmarkingthecornersoranglesofa
lodemineralclaim.

notice posted on the placer claim and shall recite all the facts necessary to the identification of the lode or placer claim, as well as a
descriptionoftheclaimasstakedandmonumented,showingthelengthandapproximatecompassbearing,asnearasmaybe,ofeach
side or course thereof, and stating in what manner the respective corners are marked, whether by standing tree, rock in place, post, or
stone,andgivingindetailthedistinguishingmarksthatarewrittenorcutoneach,andalsostatingasaccuratelyaspossible,preferablyby
bearinganddistance,thepositionoftheclaimwithreferencetosomeprominentnaturalobjectsorpermanentmonuments.
SECTION 48. No lode or placer mining claim shall be recorded unless the declaration of location be accompanied by an
affidavitmadebytheapplicantorsomepersononhisbehalfcognizantofthefactsthatthelegalnoticesrequiredbythisActforalodeora
placerclaimhavebeenpostedupontheclaim,thatinthecaseofalodeclaimmineralhasbeenfoundinplacetherein,orinthecaseofa

SECTION49.Nolodeorplacerminingclaimshallberecordedunlessthedeclarationoflocationbeaccompaniedbyproofthat
the locator, or each of them, in case there be more than one, is a citizen of the Philippines, of legal age, or is an association, or a
corporation organized and constituted under the laws of the Philippines, at least sixty per centum of the capital of which association or

SECTION 54. The register of deeds of the province concerned shall act as mining recorder for that province: Provided,
however,Thatifcircumstancessorequire,thePresidentmayappointdistrictminingofficers,orminingrecordersorbyadministrativeorder

SECTION59. Fiftypercentumof the fees collected by authority of the preceding section shall accrue to the province, and
fiftypercentumofthesame,shallaccruetothemunicipalityinwhichtheminingclaimislocated.Inthecaseofcharteredcitiesthefull
amountshallaccruetothecityconcerned.
SECTION60.Novalidminingclaimoranypartthereof,maybelocatedbyothersuntiltheoriginallocatororhissuccessorsin
interestabandonstheclaimorforfeitshisrightsonthesameundertheprovisionsofthisAct.
SECTION61.ConflictsanddisputesarisingoutofmininglocationsmaybesubmittedtotheDirectoroftheBureauofMinesfor
decision:Provided,ThatsuchdecisionmaybeappealedtotheSecretaryofAgricultureandCommercewithinninetydaysfromthedateof
its entry. In case any one of the interested parties should disagree from the decision of the Director of the Bureau of Mines or of the
SecretaryofAgricultureandCommerce,themattermaybetakentothecourtofcompetentjurisdictionwithinninetydaysafternoticeof

suchdecision,afterwhichtimewithouttheinstitutionofsuchactionthesaiddecisionshallbefinalandbindinguponthepartiesconcerned.
SECTION62.Anyqualifiedpersonmakingavalidlocationofaminingclaim,hissuccessors,andassigns,acquirestherebythe
rightofexplorationandoccupationfromthedateoftheregistryoftheclaimsintheofficeoftheminingrecorderbutheshallnotbeentitled
tomineorextractmineralsfromtheclaimforcommercialpurposesuntilaleaseisgrantedthereonasprovidedforinthisAct:Provided,
however,Thatifanapplicationforleaseofsaidminingclaimismade,suchapplicationshallipsofactoservetoextendtheperiodofsuch
rightuntilfinalactionistakenthereon.
SECTION63.Atanytimepriortothegrantingoftheleaseonhisminingclaimaholderthereofmayabandonthesameby
givingnoticeinwritingtotheminingrecorderofhisintentiontoabandonthesame,andfromthedateoftherecordofsuchnoticeallhis
interestsinsuchclaimshallcease.
CHAPTERVI
SurveyandLeaseofMineralLands
SECTION 64. The Director of the Bureau of Mines may designate competent mineral or deputy mineral land surveyors to
surveyminingclaimsforanynecessarypurposeundertheprovisionsofthisAct.Heisalsoherebyempoweredtofixthebondsofduly
qualified deputy mineral land surveyors and to issue the necessary regulations governing the execution and verification of surveys of
minerallandsinthePhilippines.AllapplicationsforofficialsurveysofminingclaimsshallbefiledwiththeDirectoroftheBureauofMines
andtheexpensesofsuchsurveysshallbepaidbytheapplicants.Theyshallbeatlibertytoemployanysuchdeputymineralsurveyorto
makethesurveyatthemostreasonablerate.
SECTION65.Atthetimeoftheofficialsurveythecornersofminingclaimsshallbemarkedwithconcretemonuments,iron
pipes,orwithsuchotherobjectsofapermanentnatureasmaybeprescribedbyregulations.
SECTION66.Inallsurveystheastronomicalmeridianshallbemadewithinthelimitsofaccuracyprescribedbyregulations.
Afterthetechnicaladjustmentshavebeenmadetheresultingbearingsanddistancesbetweenconsecutivecornersascomputedfromthe
adjusteddata,shallbeadoptedandrecognized.
SECTION67.AnypersonauthorizedtolocateaminingclaimunderthisAct,havingclaimedandlocatedapieceoflandfor
miningpurposeswhohascompliedwiththetermsofthisAct,mayfilewiththeDirectoroftheBureauofMinesanapplicationunderoath
foraminingleasethereon,showingsuchcompliance.Aplanandatechnicaldescriptionoftheminingclaimcoveredbytheapplication
shallbefiledtherewithorassoonthereafterasthesamemaybeobtainedfromtheBureauofMinesundertheprovisionsofthisAct.Inthe
caseofanapplicationtoleaseaminingclaimlocatedonprivatelands,thesameshallbeaccompaniedbyawrittenauthorityoftheowner
oftheland:Provided,however,Thatincaseofrefusaloftheownerofthelandtograntsuchwrittenauthority,thesameshallbegrantedby
thecourtassoonastheapplicantdepositstheamountfixedasthevalueofthelandandascompensationforanyresultingdamageorfiles
a bond to be approved by the Court sufficient to insure the payment of the rental of the land as determined in accordance with section
twentysevenofthisAct.Shouldtherehavebeennoproceedinginstitutedbytheapplicant,asprovidedforundersectiontwentysevenof
this Act, the Court shall determine the value of the land and the compensation for any resulting damage or its reasonable rental for the
purposesabovementionedandgrantthewrittenauthorityrequiredherein.
SECTION68.Applicationforaleaseonminingclaimshallbefiledwithintwoyearsfromthedateoftherecordingoftheclaimin
the office of the mining recorder or within two years from the date of the approval of this Act. Failure to file such application within the
periodabovementionedshallbedeemedanabandonmentoftheminingclaim,andthelandembracedwithinsuchclaimshallthereupon
beopentorelocationinthesamemannerasifnolocationofthesamehadeverbeenmade:Provided,Thattheoriginallocator,hisheirs,
orhisassigns,whohasorhavethusfailedtofilealeaseapplicationontheclaimshallnotbeentitledtorelocate,directlyorindirectly,the
landembracedwithinsuchclaim,oranypartthereof.
SECTION 69. A single application may be filed, and a single lease may be granted covering one or more mining
claims:Provided,Thatallsuchclaimstobeincludedunderoneleaseareadjoiningorcontiguoustoeachother,andareheldbythesame
holder:Provided,further,Thatthetotalareaornumberofthesaidclaimstobecoveredbyasingleleaseshallnotexceedthemaximum
area,orthemaximumnumberofclaimsauthorizedtobeheldorleasedinanyprovinceordistrict,oronthesamevein,oronthesame
placergroundbyanyoneperson,association,orcorporation.
SECTION70.AllapplicationsforminingleaseshallbeaddressedtotheDirectorofMines,sworntoandshallstate,among
others:
(a)Thenameandpostofficeaddressoftheapplicant,statingwhetherheisanindividual,hisfirstnameandsurnameboth
paternalandmaternal,hisbirthplace,ageandcitizenship,andcapitalintendedfortheexploitationoftheland,andifitisa
corporationorassociation,statingitscompletetitleandaccompanying(1)acertifiedcopyofthedeedofpartnership,itsby
lawsandrules(2)acertifiedlistofthestockholdersandpartners,withthedetailsabovespecifiedinsofarastheindividual
applicantsareconcerned,thenumberofshareshepossessesandtheamounthepaidforthem(3)acertifiedlistofitsboard
ofdirectorsandexecutiveofficers,withtheaddressoftheirofficesandresidencesand(4)incasethereareforeign
stockholdersorpartners,thetotalamountofthesharesofeachoneoftheminthecapitalstock.
(b)Thattheapplicationismadefortheexclusivebenefitoftheapplicantandnot,directlyorindirectly,forthatofanyother
personwhethernaturalorjuridicalwhoisdisqualifiedtoacquireaminingleaseunderthelaw.
SECTION71.Thestatementsmadeintheapplicationormadelaterinsupportthereof,shallbeconsideredasconditionsand
essentialpartsoftheleasethatmaybegrantedbyvirtueofsuchapplication,andanyfalsehoodinthosestatementsoromissionoffacts
whichmayalter,changeoraffectsubstantiallythefactssetforthinsaidstatementsshallcausethecancellationoftheleasegranted.
SECTION72.Uponreceiptoftheapplication,andprovidedthattherequirementsofthisActhavebeensubstantiallycomplied
with,theDirectoroftheBureauofMinesshallpublishanoticethatsuchapplicationhasbeenmade,onceaweekforaperiodofthree
consecutive weeks, in theOfficial Gazette and in two newspapers, one published in Manila either in English or Spanish, and the other
published in the municipality or province in which the mining claim is located, if there is such newspaper, otherwise, in the newspaper
publishedinthenearestmunicipalityorprovince.Thefirstpublicationofsuchnoticeshallbemadewithinthirtydaysafterthefilingofthe
applicationforlease,ifsuchapplicationisaccompaniedbyanofficialplanandtechnicaldescriptionoftheclaimorclaimscoveredbythe
application,andthirtydaysafterthefilingoftheofficialplanandtechnicaldescriptionoftheclaimorclaimscoveredbytheapplication,if
suchapplicationwasfiledinadvanceofthefilingofsuchplanandtechnicaldescription.TheDirectoroftheBureauofMinesshallalso
causetobepostedonthebulletinboardoftheBureauofMinesthesamenoticeforthesameperiod.Theapplicantshallpostforthesame

periodacopyoftheplatoftheclaimorclaimsappliedfor,togetherwithanoticeofsuchapplicationforlease,inaconspicuousplaceon
thelandembracedinsuchplat,onthebulletinboard,ifany,ofthemunicipalbuildingofthemunicipality,andalsointheofficeofthemining
recorderordistrictminingofficeroftheprovinceordistrictinwhichtheclaimorclaimsarelocatedandshallfilewiththeDirectorofthe
BureauofMinestheaffidavitofatleasttwopersonsstatingthatsuchnoticehasbeendulypostedintheplacesabovespecified.Atthe
expirationoftheperiodofpublicationtheapplicantshallfilewiththeDirectoroftheBureauofMinesanaffidavitshowingthattheplatand
noticehavebeenpostedinaconspicuousplaceontheclaimorclaimsconcernedandintheplacesabovespecifiedduringsuchperiodof
publication,andthereupon,ifnoadverseclaimshallhavebeenpresentedtotheDirectoroftheBureauofMines,itshallbeconclusively
presumedthatnoadverseclaimexistsandthereafternoobjectionfromthirdpartiestothegrantingoftheleaseshallbeheardandthe
leaseshallwithinfortyfivedaysbegrantedtotheapplicant,ortohissuccessororassigns,bytheSecretaryofAgricultureandCommerce,
providedthatallamountsthenduetotheGovernmentofthePhilippines,oranyofitsbranchesorsubdivisions,undertheprovisionsofthis
Act,shallhavebeenpaid.
DACTSa

SECTION73.Atanytimeduringtheperiodofpublication,anyadverseclaimmaybefiledunderoathwiththeDirectorofthe
Bureau of Mines, and shall state in full detail the nature, boundaries, and extent of the adverse claim, and shall be accompanied by all
plans,documents,andagreementsuponwhichsuchadverseclaimisbased.Uponthefilingofanyadverseclaimallproceedingsexcept
thepublicationofnoticeofapplicationforleaseandthemakingandfilingoftheaffidavitsinconnectiontherewith,ashereinprescribed,
shallbestayeduntilthecontroversyshallhavebeensettledordecidedbyacourtofcompetentjurisdiction,ortheadverseclaimwaived.It
shall be the duty of the adverse claimant, within fortyfive days after filing his claim, to commence proceedings in a court of competent
jurisdictiontodeterminethecontroversyandtoprosecutethesamewithreasonablediligencetofinaljudgment,andafailuretodososhall
beconsideredasawaiverofhisadverseclaim.Aftersuchjudgmentshallbeenrendered,thepartywhoserighttoaleaseonthemining
claimincontroversy,oranyportionthereof,shallhavebeenestablishedthereby,may,withoutgivingfurthernotice,fileacertifiedcopyof
the judgment with the Director of the Bureau of Mines, and the description required in such cases, together with the proper fees,
whereuponaleasemayforthwithbegrantedthereononsuchminingclaimoronsuchportionthereofastheapplicantmaybeentitledto
underthedecisionofthecourt.Ifthedecisionofthecourtisthatseveralpartiesareentitledtoleasesuponseparateanddifferentportions
of the mining claim, the subject matter of the application, and such parties have theretofore applied therefor, leases may forthwith be
issuedtothesaidseveralpartiesaccordingtotheirrespectiverightsasdeterminedbythedecision.Ifinanyactionbroughtpursuanttothis
sectionarighttoaleaseuponanyoftheclaimincontroversyshallnotbeestablishedbyanyoftheparties,thecourtsshallsofindand
judgmentshallbeenteredaccordingly.Insuchcasetheclerkofthecourtrenderingjudgmentshallfileacertifiedcopyofthejudgmentwith
theDirectoroftheBureauofMines,whereupontheproceedingsundertheleaseapplicationshallbedismissedandtheapplicationdenied.
SECTION74.LeasesundertheprovisionsofthisActshallbeforaperiodnotexceedingtwentyfiveyearsfromthedateofthe
executionoftheleasecontract,andshallberenewableundersuchtermsandconditionsasmaybeprovidedbylawforanotherperiodnot
exceedingtwentyfiveyears.Thetotalperiodofanyleaseandtheextensionthereofshallnotexceedfiftyyears.Suchleasesshallprovide
that the lessee may at any time during the life of the lease apply for the cancellation of the same, and surrender the property leased
whenever,becauseofforcemajeure,orforothercauses,itisimpossibletocontinueprofitableminingoperationsthereon.Nosuchlease
or renewal thereof shall be assigned or sublet without the prior consent of the Secretary of Agriculture and Commerce which shall be
granted if the assignment or sublease is to such persons, associations, or corporations as have the qualifications required of locators,
holders,orlesseesundertheprovisionsofthisAct.
SECTION 75. Leases may be granted covering mining claims located on private lands:Provided, That any exploration,
occupation,useorleaseofanyprivatelandpursuanttothisActshallbesubjecttothepaymentofcompensationtotheownerthereofas
providedinthisAct.
SECTION76.SubjecttotheprovisionsofArticleXIIoftheConstitution,themaximumareathatmaybeleasedtoaperson,
association,orcorporationundertheprovisionsofthisActinanyoneprovinceshallbeasfollows:
(a)Forlandsofthefirstgroupcontainingmetalsormetalliferousores:notmorethanfourhundredfiftyhectarescontaining
mineralsinveinorlodedepositsforanyindividual,association,partnership,sociedadanonimaorcorporation,normorethan
fourhundredhectarescontainingmineralsinplacerdepositsforanyindividual,normorethanthreethousandtwohundred
hectarescontainingmineralsinplacerdepositsforanycorporation,association,sociedadanonimaorlimited
partnership:Provided,however,Thatinnocaseshallthetotalnumberoflodemineralclaimsthatalesseemaylease,exceed
twohundredfiftyintheentirePhilippines.
(b)Forlandsofthesecondgroupcontainingpreciousstones:notmorethanfortyhectaresforanindividual,normorethan
threehundredtwentyhectaresforacorporation,oranassociation,sociedadanonima,orlimitedpartnership.
(c)Forlandsofthefourthgroupcontainingsalinesandmineralwaters:notmorethantwentyfourhectaresforan
individual,normorethanonehundredninetytwohectaresforacorporation,anassociation,sociedadanonima,orlimited
partnership.
(d)Forlandsofthefifthgroupcontainingbuildingstonesinplace,clays,fertilizers,andothernonmetals:notmorethan
fourhundredfiftyhectarescontainingmineralsinveinorlodedepositsforanyindividual,association,sociedadanonima,
limitedpartnershiporcorporation:Provided,however,Thatinnocaseshallthetotalnumberofsuchlodemineralclaims
exceedtwohundredfiftyintheentirePhilippinesnormorethanfourhundredhectarescontainingmineralsinplacerdeposits
foranyindividualnormorethanthreethousandtwohundredhectarescontainingmineralsinplacerdepositsforany
association,sociedadanonima,limitedpartnershiporcorporation.
SECTION77.EveryleasegrantedunderthisActshallcontainaclausebywhichthelesseeshallbindhimselftocomplywith
the provisions of this Act and with such rules and regulations for the policing and sanitation of mines, easements, drainage, disposal of
waste or tailings, water rights, rightofway, right of Government survey and inspection, and other necessary means to their economic
utilization,aswellassuchrulesforthepurposeofinsuringtheexerciseofreasonablediligence,skill,andcareintheminingoperationon
thelandcoveredbythelease,asmaybepromulgatedbytheDirectoroftheBureauofMinesandapprovedbytheSecretaryofAgriculture
andCommerce,underandpursuanttotheprovisionsofthisAct.
SECTION78.EveryleasegrantedunderthisActshallbeconstruedasgrantingtothelessee,hissuccessorsorassigns,the
righttoextractallmineraldepositsofthegroupforwhichtheleaseorleaseshadbeengrantedwithintheboundarylinesoftheclaimor
claims covered by the lease, continued vertically downward to remove and utilize the same for his own benefit, and to use the lands
covered by the lease for the purpose or purposes specified therein:Provided, That in the case of leases covering placer locations the
lesseeshallnotbeentitledtoextractmineralsfromanylodeorveindepositfoundwithintheboundaryofhis,its,ortheirplacerclaimsbut

the lessee shall have the preferential right to locate and lease such lode deposits. The same privilege shall be granted to lessee for
mineralsormineralproductsbelongingtodifferentgrouporgroupsfoundthereinupontheconditionthatthelesseeshallfirstcomplywith
therequirementsofthelaw.Anysuchlocation,occupation,use,orleasepermittedunderthisActshallreservetotheGovernmenttheright
to grant or use such easements in, over, under, through, or upon lands so entered, located, occupied, leased or used, as may be
necessarytotheworkingofthesame,orofotherminerallands:Provided,ThattheSecretaryofAgricultureandCommerce,ingranting
anyleaseunderthisActmayreservetotheGovernmenttherighttolease,sell,orotherwisedisposeofthesurfaceofthelandsembraced
withinsuchlease,underexistinglaworlaws,insofarassaidsurfaceisnotnecessaryforusebythelesseeinextractingandremovingthe
mineraldepositsfromthelandcoveredbysuchlease,orinbeneficiationoftheoresextractedtherefrom,orfromanyotherminingclaim.
TheSecretaryofAgricultureandCommerce,duringthelifeofthelease,isauthorizedtoissuepermitsforeasementshereinprovidedtobe
reserved,andtopermittheuseofthelandscoveredbythelease,orofsuchotherpubliclands,asmaybenecessaryfortheconstruction
andmaintenanceofmills,miningcamps,orotherworksincidenttotheminingandmillingoperationsonthelandscoveredbyanylease
grantedunderthisAct,oronanyotherminerallands.
SECTION 79. For the privilege of exploring, developing, mining, extracting, and disposing of the minerals from the lands
covered by his lease, the lessee shall pay to the Government of the Philippines, through the Collector of Internal Revenue, the rentals,
royalties,andtaxesprovidedbylaw.Therentalsshallbedueandpayableinadvanceonthedateofthegrantingofthelease,andonthe
samedateeveryyearthereafterduringthelifeoftheleaseoranyrenewalthereoftheroyaltiesshallbedueandpayablewithinsixtydays
aftertheshipmentofthemineralormineralproductsfromtheminesandthetaxatthetimeandinthemannerallotherrealestatetaxes
arepayableunderthelaw.Beforethemineralormineralproductsareremovedfromthemines,theCollectorofInternalRevenueorhis
representativesshallfirstbedulynotifiedthereof.Therentals,royalties,andtaxes,shallbeasfollows:
(a)Rentals.Onallminerallandsofthefirst,second,fourth,andfifthgroupsprovidedforunderthisActonepesoper
hectareorfractionthereof.Fiftypercentumofalltherentalscollectedshallaccruetotheprovince,andfiftypercentum,tothe
municipalityinwhichtheminingclaimorclaimsisorarelocated:Provided,Thatincaseofcharteredcitiesthefullamountshall
accruetothecityconcerned.
(b)Royalties.Onallmineralsextractedfrom,ormineralproductsof,minerallandsofthefirst,second,fourthandfifth
groupsasprovidedforinthisActaroyaltyofoneandonehalfpercentumoftheactualmarketvalueofgrossoutput
thereofProvided,Thatinthecaseofgoldmines,theirannualgrossoutputshallbesubjecttoaroyaltyofoneandonehalfper
centumwhenthevalueofthesaidoutputdoesnotexceedfivehundredthousandpesostwopercentumwhenthevalue
exceedsfivehundredthousandpesosbutdoesnotexceedonemillionpesostwoandonehalfpercentumwhenthevalue
exceedsonemillionpesosbutdoesnotexceedonemillionfivehundredthousandpesosthreepercentumwhenthevalue
exceedsonemillionfivehundredthousandpesosbutdoesnotexceedtwomillionpesosthreeandthreeeighthsper
centumwhenthevalueexceedstwomillionpesosbutdoesnotexceedtwomillionfivehundredthousandpesosthreeand
threefourthspercentumwhenthevalueexceedstwomillionfivehundredthousandpesosbutdoesnotexceedthreemillion
pesosfourandoneeighthpercentumwhenthevalueexceedsthreemillionpesosbutdoesnotexceedthreemillionfive

morethansevenpesosperton

(2)Twentyfivepercentuminthecaseoflodeminesproducinggoldfromoreswhichaverageslessthansevenpesos
perton.Theaveragevaluepertonoforeshallbedeterminedbythetotalnumberoftonsmilledduringthatyearforany
particularlodemine.
(3)Thirtyfivepercentuminthecaseofgoldplacermines.
Theterm"grossoutput"ofminesorminerallandsshallbeinterpretedastheactualmarketvalueofmineralormineral
products,orofbullionfromeachmineorminerallandsoperatingasaseparateentitywithoutanydeductionformining,milling,
refining,transporting,handling,marketing,oranyotherexpenses.Theoutputofanygroupofcontiguousminingclaimsshall
notbesubdivided.AlltheroyaltieshereinprovidedtobechargedshallaccruetothegeneralfundofthePhilippineTreasury,
andshallbeinlieuoftheadvaloremtaxonthemarketvalueoftheoutputofminesprovidedtobeleviedandcollected,under
sectionfifteenhundredthirtyfouroftheRevisedAdministrativeCode,asamendedbyActNumberedFourthousandfiftyeight.
Incaseminingiscarriedonuponprivatelands,theroyaltydueonthevalueoftheoutputofsuchminesunderanyandall
leases granted for the purposes shall be reduced by five per centum of the amount due to the Government under the
provisionsofthisAct,whichreductionshallbepaidbythelesseetothelandowner.Thisprivilegeshallnotbegrantedtoany
personacquiringanoptiononthesurfacerightafteranymininglocationhasbeenmadeonthemineralfoundtherein.
(c)Taxes.Allbuildingsandotherimprovementsbuiltinthelandleased,exceptmachines,mechanical,electricaland
chemicalcontrivances,instruments,tools,implements,appliancesandapparatus,usedinconnectionwiththeminingand
millingoperationsonthelandleased,shallbesubjecttoanannualrealestatetaxwhichshallbepaidattherateandinthe
mannerallotherrealestatetaxesarepaidunderthelaw.Fiftypercentumoftherealestatetaxcollectedashereinprovided
shallaccruetotheprovince,andfiftypercentumofthesameshallaccruetothemunicipalityinwhichtheminerallandleased
islocated:Provided,Thatinthecaseofcharteredcitiesthefullamountshallaccruetothecityconcerned.
IncontractsofleasegrantedunderthisAct,itshallbeprovidedthattherentals,royalties,andtaxes,shallbepayableinaccordance
withtheprovisionsofexistinglaw.
SECTION80.FailuretopaytheannualrentalsorroyaltiesrequiredbythisActforaperiodofninetydaysafterdemandshall
causetheleaseconcernedtolapseandtheclaimorclaims,withrespecttowhichsuchfailuretopaywasmade,shallthereuponbeopen
torelocationandleasebyotherpersonsqualifiedtolocateandleaseminingclaimsundertheprovisionsofthisActinthesamemanneras

if no location of the same had ever been made, unless the lessee, his heirs, executors, administrators, assigns or legal representatives
shallhavepaidallsuchannualrentalsandroyaltiesdueandhaveresumedworkontheclaimorclaimsaftersuchfailureandbeforesuch
relocation:Provided,Thatnopersonwhomaybedelinquentinthepaymentofanyrentalorroyaltyhereinaboverequiredtobepaidonany
miningclaimorclaimsheldunderleasemayrelocatethesameoranyportionthereof:Provided,further,Thatnothinghereincontainedshall
precludetheGovernmentfromcollectinganyrental,royalties,ortaxesdue.
SECTION81.Anyperson,association,orcorporationholdingaleaseundertheprovisionsofthisActshallperformduringeach
year,whiletheleaseisinforce,notlessthantwohundredpesosworthoflabor,orofimprovements,oneachminingclaimofthefirstand
fifthgroup,andonehundredpesosworthoflabor,orofimprovementsoneachclaimofthesecondandfourthgroup:Provided,Thatinthe
case of a lease covering a group of two or more mining claims leased or held in common, the total amount of labor or improvements
requiredforthesaidgroupmaybeconcentratedonanyoneofthesaidgroup,eitheronthesurfaceorundertheground.Theperiodwithin
whichtheworkrequiredtobedoneannuallyonallminingclaimsshallcommenceonthefirstdayofJanuarysucceedingthedateofthe
granting of the lease on the said claim or claims, and shall be completed on or before the thirtyfirst day of December of the same
year:Provided,further,Thatfailuretoperformtheannuallabororimprovementsrequiredhereinshallconstituteabandonmentonthepart
oftheholderandthelandshallbesubjecttorelocationbyotherpersons.
SECTION82.Actualexpendituresandcostofminingimprovementsbytheholderofaleaseorhisgrantors,havingadirect
relationtothedevelopmentoftheclaimorgroupofclaims,shallbeincludedintheestimateofassessmentwork.Theexpendituresmaybe
made from the surface, or in running a tunnel, drifts, crosscuts, or trenches for the development of the claim or group of claims.
Improvementsofanyothercharacter,suchasbuildings,machinery,orroadways,mustbeexcludedfromtheestimate,unlessitisclearly
shown that they are associated with actual excavations, such as cuts, tunnels, shafts, and so forth, and are essential to the practical
developmentof,andactuallyfacilitate,theextractionofmineralsfromtheclaim,ortheleasehold.Laborperformedorimprovementsmade,
ifany,duringtheperiodfromthedateoftherecordingoftheclaimtotheissuanceoftheleasethereon,ifthelocatororholderthereofor
their successor in interest should acquire the lease, may be credited for assessment work on the said claim or claims only for the first
periodoryearwithinwhichtheworkisrequiredtobedoneundertheprovisionsofthisAct.
SECTION83.Atanytimeaftertheperformanceoftheannuallabororthemakingofimprovementsuponaminingclaim,butnot
laterthansixtydaysaftertheexpirationoftheperiodfixedbythisAct,thelesseeorsomepersoninhisbehalfcognizantofthefacts,shall
makeandfileforrecordwiththeminingrecorderoftheprovinceordistrictinwhichtheclaimissituatedanaffidavitinsubstanceasfollows:

Such affidavit, when recorded in due time, shall be prima facieevidence of the performance of such labor or the making of such
improvements,andshallbereceivedinevidencebytheDirectoroftheBureauofMinesandbyallcourtsinthePhilippines,asshallalso
therecordthereoforacertifiedcopyofthesame.
TheCollectorofInternalRevenue,withinsixtydaysfromthedateofthereceiptofthepaymentoftherentalsorroyaltiesdueonany

SECTION84.WheneverthelesseefailstocomplywithanyprovisionsofthisActortherulesandregulationspromulgated
thereunder,orwithanyoftheprovisionsoftheleasecontract,theleasemaybeforfeitedandcancelledbytheSecretaryofAgricultureand
Commerce or by appropriate proceeding in a court of competent jurisdiction, if necessary, and the lessee shall be liable for all unpaid
rentalsandroyaltiesduetheGovernmentontheleaseuptothetimeofitscancellation.
SECTION85.Intheeventthatanyminingleaseiscancelledbytheprocedureprescribedinthenextprecedingsectionhereof,
theDirectorofBureauofMinesshall,withinthirtydaysafterthedateofsuchforfeitureorcancellation,causeanoticethereoftobeposted

onthebulletinboardoftheBureauofMinesandintheofficeoftheminingrecorderoftheprovinceordistrictinwhichsuchclaimorclaims
covered by such mining lease are situated, and the lands covered thereby shall be thereupon open to relocation and lease under the

SECTION86.Whentheunoccupiedlandofthepublicdomain,notknowntocontainvaluablemineraldeposits,isnecessaryor
convenientforminingormillingpurposes,aparcelofsuchland,nottoexceedninehectaresinextent,maybelocatedforsuchpurposeby
any person qualified to locate mining claims under the provisions of this Act, and a lease for such land may at any time thereafter be
acquiredbythelocatorforthesameperiodoftimeandsubjecttothesametermsandconditionsregardingthepaymentofrentalsandtax
asprovidedinthisAct:Provided,Thatnosuchlocationshallberecordedunlessthedeclarationthereofbeaccompaniedbyanaffidavit
made by the locator, or some person on his behalf cognizant of the facts, to the following effect: That the land covered by the claim is
necessaryorconvenientforspecificminingormillingpurposes,indicatedanddescribedtherein,andthatnovaluablemineraldepositsare
knowntoexistwithinsuchclaim:Andprovided,further,Thatifatanytimeafterthesaidleasehasbeengrantedmineraldepositsshouldbe
discoveredwithinsaidclaimandmineralormineralsbeextractedandremovedtherefrom,onallsuchoutputthelesseeoftheclaimshall

SECTION87.Allminerallandsnotcoveredbyleaseshallbesubjecttorealestatetaxpayableatthesamerateandcollectible
at the same time and manner and subject to the same liabilities and forfeiture, as provided for in Chapter seventeen of the Revised
AdministrativeCode,asamended.
SECTION88.Thereshallbeassessedandcollectedanadvaloremtaxofoneandonehalfpercentumoftheactualmarket
value of the annual gross output of the minerals or mineral products extracted or produced from all mineral lands, not covered by
lease:Provided,Thatinthecaseofgoldmines,theirannualgrossoutputshallbesubjecttoataxofoneandonehalfpercentumwhenthe
valueofthesaidoutputdoesnotexceedfivehundredthousandpesostwopercentumwhen the value exceeds five hundred thousand
pesosbutdoesnotexceedonemillionpesostwoandonehalfpercentumwhenthevalueexceedsonemillionpesosbutdoesnotexceed
onemillionfivehundredthousandpesosthreepercentumwhenthevalueexceedsonemillionfivehundredthousandpesosbutdoesnot
exceedtwomillionpesosthreeandthreeeighthspercentumwhenthevalueexceedstwomillionpesosbutdoesnotexceedtwomillion

maybeshippedfromthemine,theCollectororInternalRevenueorhisrepresentativeshallfirstbedulynotifiedtothateffect:Provided,
further,Thatuponfailuretopaytheadvaloremtaxhereinleviedwithinthetimeprescribed,thesamepenaltiesorliabilitiesasprovidedby
existing laws for the collection of such taxes shall be imposed:Provided, finally, That thead valorem tax herein provided to be paid and
collectedshallaccruetothegeneralfundofthePhilippineTreasuryandshallbeinlieuofanyroyaltyorotheradvaloremtaxesimposed

CHAPTERVII
TimberandWaterRights,RightsofWay,MinePersonnelandOfficersChargedwiththeExecutionoftheProvisionsofthisAct
SECTION89.AbonafideholderofaminingclaimorgroupofcontiguousclaimsunderthisAct,shallhavethegratuitousright
tocuttreesortimberwithinsuchminingclaimorclaimsforuseinthedevelopmentoroperationofonlythesaidclaimorclaims:Provided,
ThatthecuttingofsaidtimbershallbeinaccordancewiththerulesandregulationsprescribedbytheBureauofForestry:And provided,
further,Thatthelandorlandscoveredbysuchminingclaimorgroupofclaimsarenotcoveredbyanyexistingtimberconcessiongranted
bytheBureauofForestry.
SECTION 90. Bona fide holders of a mining claim or group of contiguous claims under this Act shall also be allowed a
gratuitous water right or rights for the development and operation of such claim or claims upon filing an application therefor with the
Director of the Bureau of Public Works in accordance with the existing law of waters and the rules and regulations promulgated
thereunder:Provided,Thatwaterrightsalreadygrantedorvestedthroughlonguse,recognizedandacknowledgedbythelocalcustoms,
laws and decisions of courts, shall not thereby be impaired:Provided, further, That the Government reserves the right to regulate water
rightsandthereasonableandequitabledistributionofwatersupplysoastopreventthemonopolyoftheusethereof.
SECTION91.Whenanymine,orminingclaimissosituatedthatforthemoreconvenientenjoymentofthebeneficialrightson
thesame,aroad,arailroad,tramway,electrictransmission,telephoneortelegraphline,oraerialtransportationtheretoortherefrom,ora
ditch,canal,pipeline,flume,cut,shaft,ortunneltodrainorconveywater,ore,wasteortailingstherefrom,orashaftortunnelformining
purposes, may be necessary for the better working thereof, which road, railroad, tramway, electric transmission, telephone or telegraph

line,aerialtransportation,ditch,canal,pipeline,flume,cut,shaftortunnelmayrequiretheuseoroccupancyofaminingclaimorclaimsor
other lands owned, occupied, possessed or leased by another or other than the person or persons or body corporate requiring an
easement for any of the purposes hereinbefore enumerated, which purpose are hereby declared to be for the public use or benefit for
which the right of eminent domain may legally be exercised, the owner, locator, or lessee of the mine or mining claim first above
mentioned,shallbeentitledtoarightofway,entryandpossessionfortheuses,purposesandprivilegesofsuchroads,railroads,tramway,
electrictransmission,telephoneortelegraphline,aerialtransportation,ditch,canal,pipeline,flume,cut,shaftortunnel,in,upon,through,
underandacrossminingclaimsorotherlands,uponcompliancewiththeprovisionsofthisActhereinafterprovided.
SECTION92.Whentheowneroroccupantofanymineorminingclaimdesirestoworkthesame,anditisnecessary,inorder
to enable him to do so successfully and conveniently, that he have a right of way for any of the purposes mentioned in the foregoing
sections,ifsuchrightofwaycannotbeacquiredbyagreementwiththeowner,occupant,orclaimantofminingclaimsorotherlands,over,
under,through,across,oruponwhichheseekstoacquiresuchrightofwaytheapplicantmaycommenceandmaintainanactioninthe
mannerprovidedinsectionstwohundredandfortyonetotwohundredandfiftythree,inclusive,ofActNumberedOnehundredandninety,
and in the Acts amendatory and supplementary to the said sections, now or hereafter in effect, including Act Numbered Twentytwo
hundredandfortynineprovidingfortheexerciseofthepowerofeminentdomainbytheGovernmentanditssubdivisions.Atleastoneof
thecommissionerstobenamedinaccordancewithsectiontwohundredandfortythreeoftheCodeofCivilProcedureshall,inanycase
brought hereunder, be a mining engineer, duly qualified as such under the laws of the Government of the Philippines, and such mining
engineerorengineersneednotbelandholdersorownersoftheprovincewherethelandissituated.
SECTION93.Nopersonundertheageofsixteenyearsshallbeemployedin,oraboutanymineinworkconnectedwithmining
operation,andnomalepersonorpersonsundertheageofeighteenyears,noranygirlorwoman,shallbeemployedundergroundinany
mine.
SECTION94.Nopersonshallhavethegeneraldirectionoftheworkin,oractassuperintendentof,amine,millorquarry,
employing more than fifty persons, working underground at any one time without being duly licensed as a mining engineer or as an
experiencedminingormillforemancertifiedassuchbytheBoardofExaminersforMiningEngineers,unlessexpresslypermittedtodoso
bytheDirectoroftheBureauofMines.
SECTION 95. The Secretary of Agriculture and Commerce shall be the executive officer charged with carrying out the
provisionsofthisAct,throughtheDirectoroftheBureauofMines,whoshallactunderhisimmediatecontrol.
SECTION 96. The appraisal or reappraisal, valuation or revaluation of any mine, mining claim or claims with or without
improvementsthereon,patented,leasedorotherwise,forthepurposeofraisingcapitalfortheformation,ororganizationofassociation,
partnershiporcorporationorforpromotionwork,orforissuingsharesofstock,orfordeterminingthepresentnetvalueofthemines,shall
bemadebytheDirectoroftheBureauofMinesorhisdulyauthorizedrepresentative,andnosuchmine,miningclaimorclaims,withor
without improvement thereon, patented, leased or otherwise, shall be accepted as asset or basis of any asset in any formation or
organizationofassociation,partnership,orcorporationforregistrationorincorporationwithoutthevaluethereofhavingbeenfirstappraised
ordeterminedbytheDirectoroftheBureauofMinesashereinprovided.
CHAPTERVIII
PenalProvisions
SECTION97.Allstatements,representations,orreportsrequiredunderthisAct,unlessotherwisespecificallyprovidedherein
shallbeuponoathandinsuchformanduponsuchblanksastheDirectoroftheBureauofMines,approvedbytheSecretaryofAgriculture
andCommerce,mayprovideandanyperson,makingknowinglyanyfalsestatement,representationorreportunderoathshallbesubject
topunishmentforperjury,uponconvictionthereforbyacompetentcourt.
SECTION98.Anypersonwho,withintentofgain,presents,orcausestobepresented,anyfalseapplication,declaration,or
evidencetotheGovernmentorpublishes,orcausestobepublished,anyprospectusorotherinformationcontaininganyfalsestatement
relatingtomines,miningoperation,miningclaimsorlease,shallbeguiltyofperjury,ifsuchfalsestatementismadeunderoath,andshall
bepunished,uponconviction,inaccordancewiththeprovisionsoftheRevisedPenalCode.Ifsuchfalsestatementisnotmadeunderoath
heshallbepunished,uponconviction,byafinenotexceedingsixhundredpesos.
SECTION 99. Any person who willfully and maliciously defaces, alters, removes, or disturbs any stake, post, monument,
boundaryline,oranyothermarklawfullyplacedundertheauthorityofthisAct,ordestroys,injuresordefacesanyrules,ornotices,which
have been posted, concerning locations, mining application for leases, mines, and any other related subject shall be punished upon
conviction,byafinenotexceedingfivehundredpesos,besidespayingcompensationfortheexpensesincurredinreplacingthedefaced,
altered,removed,ordisturbedstakes,post,monument,boundaryline,notices,oranyothermark.
SECTION100.Anypersonwho,withintentorgain,willfullyandunlawfullyextractsmineralsbelongingtotheGovernmentorfrom
a mining claim or mining claims leased, held or owned by other persons without the permission of the lawful lessee, holder or owner
thereof,orstealsoresortheproductsthereoffromminesormills,shallbeguiltyoftheft,orqualifiedtheft,asthecasemaybe,andshallbe
punished,uponconviction,inaccordancewiththeprovisionsoftheRevisedPenalCode,besidespayingcompensationforthedamage
causedthereby.
SECTION101.Anypersonwho,withintentofgain,knowinglysells,transfersorconveysanyfalseminingclaimorclaimsorany
falseright,titleorinterestinsuchminingclaimswhichwerenotactuallylocatedonthegroundanddonotexistassuchclaimsshallbe
guiltyofestafaandshallbepunisheduponconvictioninaccordancewiththeprovisionsoftheRevisedPenalCode.
SECTION 102. Any person who, with intent of gain, knowingly places or deposits, or becomes accessory to the placing or
depositingof,anymineralinanylandforthepurposeof"salting"andofmisleadingotherpersonsastothevalueofthemineraldepositsin
suchland,orwhowithintentofgain,knowinglycommingles,orcausestobecommingled,samplesofmineralswithanyothersubstance
whatsoever, which increases the value or in any way changes the nature of the said minerals or substance, or substitutes samples of
mineral for the purpose of deceiving, cheating, or defrauding any person, shall be punished, upon conviction, by imprisonment not
exceedingaperiodoffiveyears,besidespayingcompensationforthedamagewhichmayhavebeencausedthereby.
SECTION103.Anypersonwhowillfullyandmaliciouslycausesorpermitssludgeortailingstoaccumulatein,orflowfromhis
miningclaimssoastocausedanger,injuryorobstructiontoanypublicroad,riversorstreamsorotherpublicproperty,shallbepunished,
uponconviction,byafinenotexceedingtwohundredpesos,besidespayingcompensationforanydamagewhichmayhavebeencaused
thereby.
TEDAHI

SECTION 104. Any person who willfully and maliciously or with intent of grain, takes water from a mining mill, race, dam,
reservoir, or from any other form of deposits, or prevents the water from entering said mining mill, race, dam, reservoir, or in any way
interfereswiththefullenjoymentofwaterrightspreviouslygrantedandlawfullyheldbyanotherperson,shallbepunished,uponconviction,
byafinenotexceedingonehundredpesos.
SECTION105.Anypersonwhowillfullyandmaliciouslydestroysorinjuresanystructureinoronminingclaims,oronsitesfor
reduction works, shall be punished, upon conviction, by imprisonment not to exceed five years, besides paying compensation for the
damagewhichmayhavebeencausedthereby.
SECTION106.Anypersonwhowillfullyandmaliciouslysetsfiretoanymineral,mine,ortheworkings,fittings,orappliancesofa
mine, shall be guilty of arson and shall be punished, upon conviction, in accordance with the provisions of the Revised Penal Code,
besidespayingcompensationforthedamagecausedthereby.
SECTION107.Anypersonwhowillfullyandmaliciouslydamagesamine,unlawfullycauseswatertorunintoamine,orintoany
subterraneanpassagecommunicatingwithamine,orobstructsanyshaftorpassagetoamine,orrendersuseless,damages,ordestroys
anymachine,appliance,apparatus,rope,chain,tackle,oranyotherthingshallbepunishedbyimprisonmentnotexceedingaperiodoffive
days,besidespayingcompensationforthedamagecausedthereby.
SECTION108.AnypersonwhowillfullyandmaliciouslyobstructstheDirectoroftheBureauofMines,oranyofhissubordinates
orrepresentatives,intheperformanceoftheirdutiesinconnectionwithanymineorminesshallbepunished,uponconviction,byafinenot
exceedingonehundredpesos.

GeneralProvisions
SECTION109.Nograntoflandstoprovinces,districtsormunicipalities,toaidintheconstructionofroads,orforotherpublic
purposes,shallincludeanyminerallands.
CHAPTERX
TransitoryandFinalProvisions
SECTION 110. During the Commonwealth of the Philippines, citizens of the United States or corporations organized and
constitutedunderthelawsoftheUnitedStatesorofanystateorterritorythereof,andauthorizedtotransactbusinessinthePhilippines,
shallenjoythesamerightsunderthisActascitizensorcorporationsofthePhilippines.
SECTION111.If,foranyreason,anysectionorprovisionofthisActischallengedinacompetentcourtandisheldordeclaredto
be unconstitutional or invalid, none of the other sections or provisions thereof shall be affected thereby and such other sections and
provisions shall continue to govern as if the section or provision so annulled had never been incorporated in this Act, and in lieu of the
sectionorprovisionsoannulled,theprovisionsoflawonthesubjectthereofinforcepriortotheapprovalofthisActshallgovernuntilthe
NationalAssemblyshallotherwiseprovideinthepremises.
CHAPTERXI
Repeals
SECTION112.ActNumberedFortytwohundredandfortythreeandalllaws,actsorpartsthereof,andallregulations,rulesand
instructionsinconsistentwiththeprovisionsofthisActareherebyrepealed.
SECTION113.ThisActshalltakeeffectuponitsapproval.
