For The Purpose Of Submitting Ethics Report and Other Findings
To New State's Attorney For Investigation and Prosecution
To Whom It May Concern:
I am the chairperson of the Ethics Commission that was the subject of discussion at this month's
Board of Trustees Meeting on January 7 at 7:00 p.m. (Mayor's Report, Item #6) At that time it
was determined that the Commission was not disbanded and is still legally operational. In
addition, Ethics Petitioner Tyson Manker filed a request for the Commission to take action.
As such, I am therefore exercising the legal authority vested in me by Section 20-2, Article
20, of Village Ordinance 876 to reconvene a meeting of the Ethics Commission. I am doing
so to give the Commission an opportunity to submit its report and all subsequent evidence
reviewed by Village Police and this Board directly to the new state's attorney for his filing
decision. I believe we must do so for the following reasons:
First, a new state's attorney was recently appointed who unlike his predecessor does not have
conflicts of interest that would prevent him from investigation and/or prosecuting this case.
Second, due to his conflicts the previous state's attorney submitted a "Request for Special
Prosecution Assistance" to the Appellate Prosecutor's Office twice on June 25, 2015, and on
November 20. To date, the Appellate Prosecutor has not issued an acceptance or a denial of
either request, nor has a decision been rendered or communicated to this Commission.
Third, FOIA documents recently made public by WLDS News show email communications
between the Appellate Prosecutor Ed Parkinson and Richard Evans while Evans was a subject of
the Ethics Complaint that was eventually forwarded to Parkinson, which at a minimum creates an
appearance of impropriety. (WLDS, December 11, 2015, New details document South Jax

Therefore, in the interests of justice I am taking the following actions:
1. Convene a meeting of the Ethics Commission, and subject to the affirmative vote of 2
Commissioners, submit to the new state's attorney a packet that contains at a minimum
the (i) Ethics Commission Report/June 25 Request; (ii) 60-page memo dated September
3; (iii) November 20 request; and (iv) undated Chief Hallock probable cause memo.

2. With approval of the Board, direct Police Chief Joshua Hallock to deliver that evidence
to the new state's attorney, and with cooperation from ISP Agent Deanna Harton assist
the prosecutor's office in the investigation and prosecution of this case as is customary in
all probable cause scenarios.
This notice being filed this 19th day of January 2016 with the intention of convening a meeting of
the Ethics Commission at the earliest possible date allowed by the Open Meetings Act and all
other relevant laws.
