RE: Petitioner's Request to Submit Ethics Commission Report and Other Findings to
New Morgan County State's Attorney for Further Investigation
Dear Trustee Pinkerton:
Please be advised that Robert Bonjean recently resigned from his position as Morgan County
State's Attorney, and a new State's Attorney has been appointed to take his place.
This major development directly impacts all previous Village requests for prosecution,
including the Ethics Commission Report, which explained, "The Commission is aware that
the Morgan County State's Attorney, Robert Bonjean, has indicated that his office would have
a conflict of interest in the investigation and prosecution of allegations." (Report, p.5)
As a result of his conflicts, on two separate occasions Mr. Bonjean filed a "Request for
Special Prosecution Assistance" with the State's Attorneys Appellate Prosecutor. The first,
on June 25, 2015, asked for a Special Prosecutor to investigate and prosecute multiple
offenses named in the Ethics Commission Report. The second, filed November 20, lists
multiple felony offenses including forgeries against Linda Douglass. Also due to Bonjean's
conflicts, Village Officials forwarded a 60-page memo with evidence to the Appellate
Prosecutor on September 3.
When Mr. Bonjean left office, the conflicts that prevented him from prosecuting this case
disappeared. As such, his successor Gray Noll may now initiate prosecution free from
conflict.
Therefore, as Petitioner of the Ethics Complaint, I respectfully request the Ethics Commission
and Board of Trustees to redirect all previous communications and documents to the new
State's Attorney for review and prosecution.
