Dog Park Waiver & Release
PLEASE READ THIS FORM CAREFULLY, INITIAL NEXT TO EACH PARAGRAPH, AND BE AWARE
THAT IN CONSIDERATION FOR PERMISSION TO USE THE CITY’S DOG PARKS, YOU WILL BE
EXPRESSLY ASSUMING THE RISK OF, AND LEGAL LIABILITY FOR, AND WILL BE WAIVING AND
RELEASING ALL CLAIMS FOR INJURIES, DAMAGES, OR LOSS WHICH YOU AND/OR YOUR DOG
MAY SUSTAIN AS A RESULT OF PARTICIPATING IN, ANY AND ALL ACTIVITIES CONNECTED WITH
OR ASSOCIATED WITH THE USE OF THESE FACILITIES AND THE SURROUNDING AREAS.

_____ I hereby acknowledge that I have voluntarily applied to participate and use with my dog(s) the dog parks
(“Parks”) owned and/or operated by Toledo Unleashed. I understand that the act of unleashing my dog(s)
and being physically present within the Parks necessarily involves a risk of injury to me, any persons that
accompany me, other people using the Parks, my dog(s), and other dogs.

_____ I understand that these risks are entirely my responsibility and I expressly assume that responsibility
knowingly and voluntarily. When this Waiver and Release refers to “my dog”, it includes me whether or not I
am the legal owner of the dog, since I am the person responsible for the dog while using the Parks. Furthermore
“dog” shall refer to all dogs included on the Toledo Unleashed Dog Park Application. I understand that the
permit/license system is not established to guarantee that dogs in the Parks are safe or healthy. I also understand
that dog activities are intended to provide a fun and rewarding experience for a dog and its owner/handler.
However, despite careful and proper preparation, instruction, medical advice, conditioning and equipment, there
is still a risk of serious injury, including death, to the dog, its owner/handler, other persons, or other animals.

_____ I further understand that dogs, irrespective of their training and usual past behavior or characteristics,
may act or react unpredictably at times based upon instinct or circumstances, and that not all hazards and
Dangers associated with dog activities can be foreseen. I agree to assume the risk of any injury to me, any
individuals (including children) that accompany me to the Parks, and my dog(s). I understand that this risk
may result from fierce, aggressive, vicious and dangerous dogs which may be present in the Parks. I further
understand and assume the risk that all dogs in the Parks may not have been vaccinated for bordatella,
distemper, parvovirus, or rabies, all of which could result in injury to me, any individuals (including
children) accompanying me, and my dog(s). I also understand that there are certain inherent risks, including
the propensity of a dog to behave in a dangerous way. Additional risks include, but are not limited to: the
inexperience or irresponsibility of a dog owner/handler; the inability to predict a dog’s reaction to sound,
movement, objects, persons, or other animals; dog fights, dog bites, and injuries to humans and other dogs;
dog theft or unlawful capture; dog escape over or under fences; plants in the area that may be poisonous to
dogs or people; mosquitoes, ticks, chiggers, fleas, or other insects that may be present; and wild animals, such
as skunks, raccoons, opossums, or stray dogs that could be present in the Parks, all of which might injure or
infect my dog(s); slip and falls, premises defects, equipment failure, failure in instruction/supervision, and other
circumstances inherent to dog and/or outdoor activities. I knowingly and voluntarily accept responsibility for
all of these risks in exchange for the privilege of using the Parks.

_____ It is my understanding that no agents or employees of Toledo Unleashed will supervise the Parks at
any time and I therefore expressly assume responsibility for all risks associated with the Parks, as well as any
fixtures and equipment that may be located there in an unsupervised manner.

_____ I understand that I will not have access to the Park until I have successfully completed the mandatory
informational meeting (to be offered at least once a month). See toledounleashed.org for dates, times, and
locations.

_____ In signing this Waiver and Release, I fully release and discharge Toledo Unleashed, its partners,
employees and volunteers, and others working on behalf of the Parks from any and all claims, demands,
damages, rights of action, whether present or future, known or unknown, anticipated or unanticipated, resulting
from or arising out of my use or intended use of the Parks. I fully and forever release and discharge Toledo
Unleashed, its partners, employees and volunteers, and others working on behalf of the Parks from any and all
negligent acts or omissions with regard to the Parks and intend to be legally bound by this Release. I assume
sole responsibility for, and agree to indemnify and hold harmless Toledo Unleashed, its partners, employees and
volunteers, and others working on behalf of the Parks for any damages for bodily injury, death, or damage, or
loss to property, including legal and expert witness fees.

I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND UNDERSTAND ITS CONTENTS. I
HAVE ALSO RECEIVED A COPY OF THE DOG PARK RULES AND REGULATIONS, AND AGREE
BY AFFIXING MY SIGNATURE BELOW TO COMPLY WITH THOSE RULES AND REGULATIONS.
I ATTEST THE INFORMATION CONTAINED IN MY APPLICATION (BOTH PRIMARY AND
ADDITIONAL) IS TRUE AND ACCURATE, TO THE BEST OF MY ABILITY. I WILL ALSO INFORM
OTHERS THAT I MAY BRING TO THE PARKS (INCLUDING CHILDREN) OF THESE RULES AND
WILL ENSURE THEIR COMPLIANCE WHILE USING THE PARKS. MY SIGNATURE CONFIRMS

Dog Park Rules
For the health and safety of our dogs and everyone who enters the dog park gated area, we have developed the
following rules:
General Rules & Regulations
-- Please do not let people or dogs in without key and membership dog tag. This protects our park.
-- Owners are legally responsible for their dogs and any injuries caused by their dogs
-- Dogs must be leashed prior to and upon leaving the dog park.
-- Dogs with a history of, or who have exhibited aggressive behavior are prohibited.
-- Dogs must be healthy, fully vaccinated (Rabies, DHLP, Bordatella & Parvovirus), dewormed, licensed and
wearing identification tags.
-- Puppies under five (5) months old are prohibited.
-- Toledo Unleashed requires that you have your dog spayed or neutered before participating in the dog park.
Fighting and dominant behaviors are much more likely to occur with intact animals.
-- It is also recommended that your dog(s) be kept on a flea preventative such as Advantage or Frontline.
-- No people food or dog food is allowed in the park.
-- Owners must clean up after their dogs: no fecal waste may be left in park.
-- Anyone under eighteen (18) years old must be accompanied by an adult. Younger children must be closely
supervised.
-- Each person eighteen (18) years and older may bring no more than three (3) dogs in the park at any time.
-- Dogs must be supervised at all times. Please do not leave the Park for any reason.
-- Owners must maintain vocal control over their dog(s) at all times.
-- The dog park is open from sunrise to sunset, unless otherwise stated at the Park.
-- While all dogs are welcome in the Big Dog Area of the park (at their own risk), only small dogs (under 30lbs)
are permitted inside the Small Dog Area. This is for the comfort and protection of all of our members.
-- Only dog owners or caregivers and dogs listed on an approved Toledo Unleashed Dog Park Application for
user privileges may enter the Dog Park.
-- Please do not bring toys, balls or other items to the park unless you are wishing to donate them to the park.
Members are not premitted to leave the park with any toys (even if they brought them in).
Entering the Park
The entrance gate leads into a safety pen where dogs are unleashed before entering the dog park. From the
safety pen, there are two smaller gates: one leading to the small dogs area, and one leading to the “all dogs”
area. The safety gate design prevents dogs from escaping and facilitates leashing and unleashing the animals. It
also prevents small dogs and their owners from having to enter the “all dogs” area.
For your safety, please abide by these guidelines when entering and leaving the park:
-- Do not open the outside gate if the inside gate is open. One family of dogs at a time in the inside enclosure
(between the double gates) at a time.
-- Remove dog’s leash inside the double gated area. Make sure the gate is closed after entering the park.
-- Do NOT leave a leash on dogs in park. This can actually cause an altercation as a dog may feel restricted
in its ability to protect itself. Also, dogs feel more protective of their owners when leashed. DO carry your
leash into the park in case you need to remove your dog in an emergency situation.
-- Do not to bring any toys that a dog may be particularly attached to. These items may provoke possessive or
aggressive behavior or may be destroyed through rough play.
-- When new dogs enter the facility it can get very congested at the gate area, so move your dogs away,
giving the new dogs a chance to get acclimated.

Small Children in the Dog Park
-- It is not safe for small children to be in the dog park.
-- Not all dogs are socialized with small children.
-- Some dogs see small children (with their quick movements and small size) as prey. A child running may be
seen as prey.
-- Some herding dogs will attempt to herd your child. The dog may naturally herd with small nips to the back of
legs.
-- Your dog may become territorial over your child. Other dogs may also become territorial over your child.
This can cause a fight that could injure or scare your child.
-- When dogs are playing, they naturally mouth, mount and may body slam. A dog may mistake your child for
another playmate.
-- The dog park can be quite overwhelming to small children.
-- A dog fight can occur, which could put your child in a dangerous situation.
-- Again, the Dog Park is “Enter at your own risk.” Toledo Unleashed recommends that you not bring children
under the age of 10 to the Dog Park as it could pose serious risk to yourself, your child, as well as other dogs.
Passes
-- One pass/key is issued per household application.
-- Passes cost $60.00 for first dog and $25.00 for each additional dog.
-- Replacement for a lost key is $10.00.
-- Replacement for a lost dog tag is $5.00
-- Passes can be revoked without refund for any Code of Conduct violation.
-- Passes must be renewed annually.
-- Passes are valid until January 31 of each year. After January 31, your pass must be renewed.
-- Pass fees remain the same all year, regardless of when the pass is purchased.
-- Documentation not indicating the required immunizations or expired dates are not accepted.
-- The dog(s) birthdate(s) are required to verify minimum age requirements.
-- Owners receiving new or renewed memberships prior to their dog’s licenses or shots expiring are responsible
to update the above items prior to their expiration.
-- Each membership includes a 30-day trial period. If within this time, you or any of your dogs do not wish to
remain a member of the dog park, you will be granted a full refund (pending return of key and dog tags).
Police Enforcement
Toledo Unleashed Dog Parks are self-supervised. Visitors to the parks are encouraged to follow the rules and
to encourage others to follow the rules. If there is a problem that is beyond the capacity of visitors to manage,
Police should be called. Toledo Police non-emergency number is 419-245-3340. For emergencies, call 9-1-1.
Dog Licensing
In short, all dogs must be licensed and vaccinated. Those rules are already on the books and they apply to the
Dog Park just as they apply to the rest of the area. We’ve had a lot of questions about whether dogs must be
licensed to visit the park. The answer is yes, because they must be licensed regardless of where they are.

It is our sincere hope that you find your experience at the Park to be an enjoyable one. If you have any
suggestions, concerns or questions regarding the Park, please do not hesitate to email Toledo Unleashed

We take these rules seriously. If you see poor behavior, or are concerned about the safety of the Park, please
email us as soon as possible. Members knowingly assisting others with breaking the above rules will have
membership revoked, without refund.
