PREFATORY STATEMENT
The issue on same-sex marriage has been relentlessly attack by a plethora of groups bent on
weighing the country down from societal progress and equality.The same people who continues to
preach about love and acceptance yet they are so frightened to accept a group that threatens to
change the meaning of the institution they hold dear. An institution that believes that happiness
could only be achieved and should abide by a strict limitation when it comes to gender preference
or to be more specific, heterosexuality. The people that protects this social institution believes that
child-bearing is its cornerstone but fails to put into account something that proves to be more
important which is a legal proclamation of love.
Denial of these individuals from partaking in the said institution would be a direct violation
of the Equal Protection Clause, provided in the Constitution, which means that the state should
apply the law equally to all classes that society have and cannot give preference to one or two. In
the same vein, it was held in Obergefell v. Hodges, that fundamental right to marry applies to samesex couples because it includes the personal choice of the individual on whom to marry, it supports
a two-person union to committed individuals, the fundamental right to marry forms as a bulwark for
children and families, and marriage is a keystone of our social order that preventing them to partake
in such institution would only cause instability and the furtherance of discrimination and bigotry.
Article 147 and 148 of the Family Code are provisions that provides for the property
relations of couples whether they are with the benefit of marriage or not. Sadly, these provisions do
not apply to same-sex couples. It does not give them right to each others properties despite them
having worked for it through most of their lives. The issue on same-sex marriage deprivation doe s
not end there, in a news story in the United States of America, Roger Gorleys partner was lying
sick in a hospital bed but he was denied access by his partners family because they did not want
him there. The hospital also did not grant him access for the sole purpose that he was not a blood
relative or a spouse. You could see how painful that is for a person who has spent most of his life
with his partner but in the instance his partner fell ill, he is prevented by law to see him.
The amount of discrimination caused by an institution as historic as Jesus Christ has the
potential to bring the country into a state of deterioration. This is not just a mere issue on marriage
but rather this would bring forward years of societal acceptance to a particular social class. Samesex couples have been called to be destroying this social institution however, is it really limited to
them? Heterosexual couples are also susceptible to cheating and all the disgusting truths that comes
with marriage. But Marriage is still beautiful and its something that should be enjoyed by all.
