Cameron Cos is proposing an OSSF to serve 6 360 square foot short term rental cabins. This property is
10.00 acres of Lot 4 in the J V Ash Jr Subdivision. The property will be served by a private well. The system
designer, Daniel Balboa, R.S., has designed a treatment system which consists of a septic tank and a pump
tank. After treatment, the effluent will be dispersed to a low-pressure dosed drainfield with a maximum daily

This RFQ is being sent out per the Resolution that was approved in Commissioners Court June 7, 2016 defining
the process that will be used to place or remove vendors on/from the current list of Professional Engineering
firms. The Commissioners Court finds that defining a process for establishing a list of pre-qualified professional
services providers will achieve an equitable approach to procurement of professional services. A motion was
made by Commissioner Whisenant, seconded by Commissioner Jones to approve specifications for
RFQ 2016-P13 Professional Engineering Services on an as needed basis. All voting Aye. MOTION

TJJD Grant A provides overtime funds for JPOs to host outreach and education programs to juvenile detainees.
The programs scheduled for this fiscal year have been identified and the remaining overtime budget can be
used to pay for contract detention. No County matching funds required, Budget Amendment: Increase Contract
Detention: 001-686-99-027.5361; Decrease Overtime: 001-686-99-027.5031. A motion was made by
Commissioner Whisenant, seconded by Commissioner Jones to authorize the Juvenile Probation, Texas
Juvenile Justice Department (TJJD) Grant A to utilize over-time savings for contract detention and

The District Court has requested an awning to be installed at the Government Center for the Judges Entrance.
The Facilities Manager has secured three quotes, with Sequin Canvas & Awning being the lowest bidder.
Potential Funding Source: County Wide Contingencies. A motion was made by Commissioner Jones,
seconded by Commissioner Whisenant to authorize the Building Maintenance Department to contract
with Seguin Canvas & Awning, LLC to install an awning at the Government Center and amend the

Under RFQ 2016-P01, Performance Services (PSI) was selected for the Energy Services Performance
Contracting work in Hays County. Approval of the recommendation and selection of PSI was approved by
Commissioners Court on May 17, 2016. A motion was made by Commissioner Jones, seconded by
Commissioner Whisenant to authorize the County Judge to execute a Memorandum of Understanding
and Authorization between Hays County and Performances Services (PSI) for a Technical Energy Audit
and Project Development. All voting Aye. MOTION PASSED

Staff recommends acceptance of construction of roads and drainage improvements within the County ROW.
The Transportation Department has inspected and approved the improvements. There was not a construction
bond issued for this section. A motion was made by Commissioner Jones, seconded by Commissioner
Ingalsbe to accept road construction and drainage improvements and acceptance of the Maintenance
Bond #1036862 in the amount of $858,565.00 for a 2-year period for Sunfield Subdivision, Phase 2, Sec.

This is a preliminary AFA with TxDOT to Design and Acquire ROW for the intersection of RM 12 and FM 3237
using CAMPO funding that was awarded to the City of Wimberley, The Court passed a resolution to undertake
the design of improvements on June 21, 2016. A motion was made by Commissioner Conley, seconded by
Commissioner Whisenant to authorize County Judge to sign an Advanced Funding Agreement with
TxDOT for the design and engineering of improvements to the intersection of RM12 and FM 3237. All
voting Aye. MOTION PASSED

Caitlyn Harrell, County Planner gave staff recommendation and Clint Garza, Director of Development &
Community Services spoke. Public Comments were made by: George Hansen against, Stacy Bass for,
David Nair for, Brian OToole Attorney for Pacesetter Homes, Tom Lynch Pacesetter Homes, Ken Wymore
for, David Christian for, Rudolph Rosen for, Bill McCoy against, Edward Watt Attorney for some
residents, Mark A. Miller against. The Preserve at La Ventana, Phase 3 is a 67 lot subdivision located off of
Covered Bridge Drive in Precinct 4. The subdivision will be served by the La Ventana Water Company LP.
Wastewater service will be provided by individual advanced on-site sewage facilities. A motion was made by
Commissioner Conley, seconded by Commissioner Whisenant to approve SUB-377 final plat of The
Preserve at La Ventana, Phase 3 (67 Lots) ; accept Check No. 7180M-00028046 for the construction of
remaining street and drainage improvements in the amount of $665,769.31 contingent on County
signature and the Judge on receiving this letter from the water supply company. All voting Aye.

Roxie McInnis with Development Services and Joyce Cowan Elections Administrator. Due to the nature of the
election standards for emergency services districts as well as the complex boundary of the proposed ESD #9,
the scope of work and associated time constraints to prepare for the November election exceed what can be
accomplished with the current resources available to the Department and GIS Program. In order to maintain the
highest possible level of service to the public as well as other County office, the Development and Community
Services Department is proposing a PSA with Waypoint Mapping for professional GIS support services. The
contractor will coordinate with the Department to perform the services necessary to prepare for the election.
Savings within the Development Services operating budget will fund this request. Budget Amendment:
Decrease - .5271; Increase 0 .5448. A motion was made by Commissioner Whisenant, seconded by
Commissioner Conley to authorize the County Judge to sign a Professional Services Agreement for GIS
support services for assistance with preparations for the ESD #9 election. All voting Aye. MOTION

Director of Development and Community Services, Clint Garza, spoke. In September of 2014, the La Cima
Public Improvement District was created and the La Cima Subdivision development process began. Portions of
the development, known as major public improvements are paid from Special Assessment Revenue Bonds,
issued by Hays County. As a condition of bond issuance, Hays County has oversight of the expenditure of bond
funds and the development in general. Going forward, Hays County will also be responsible for collection of
special assessments from all owners of property within the boundaries of the La Cima PID. Staff would utilize
PIDWorks services to set up administration procedures as the district grows in population and the development
matures, review of payment and bond reimbursement requests, and maintenance of the annual assessment
rolls. A motion was made by Commissioner Conley, seconded by Commissioner Whisenant to approve
a professional services agreement with PIDWorks, LLC., for Public Improvement District Administration
Services for the La Cima Public Improvement District and amend the budget accordingly. All voting
Aye. MOTION PASSED

The County Clerks office acquired a new software vendor and needs to have a new MOU with each eRecording
provider. Simplifie is a provider of eRecording services for qualified entities. A motion was made by
Commissioner Ingalsbe, seconded by Commissioner Whisenant to authorize the County Judge to
execute a Memorandum of Understanding with Simplifile LC for eRecording in the County Clerk's Office.

General Counsel Mark Kennedy spoke. Brookfield has agreed to purchase its mitigation credits from Hays
County, even though, due to Brookfields independent permitting, it had the option to acquire credits outside of
Hays County. In order to compete with outside sources of mitigation credits, Hays County has offered to allow
Brookfield to pay for the credits over a period of time, as described in the contract, which may be found in
backup. A motion was made by Commissioner Conley, seconded by Commissioner Ingalsbe to
authorize the County Judge to execute a Hays County Regional Habitat Conservation Plan Participation
Agreement between Hays County and Brookfield Residential related to the purchase of Regional Habitat
Conservation Plan credits for endangered species habitat mitigation within Hays County. All voting
Aye. MOTION PASSED

2 (2.103 ac) along FM 1626 South, in Precinct 2. All voting Aye. MOTION PASSED

Session were Commissioner Ingalsbe, Commissioner Jones, Commissioner Conley, Commissioner Whisenant

of Way to Hays County from the Episcopal Church Corporation in West, Texas a Texas Non-Profit
Corporation, as presented in Executive Session, granting approximately 0.2109 acres of land along
Hays Country Acres Road for a turn lane onto Hwy. 290 West in Precinct 4 of Hays County. All voting

Jones, seconded by Commissioner Ingalsbe to adopt a Resolution, as presented in Executive Session,
determining the necessity and authorizing the use of the Countys power of Eminent Domain to acquire
approximately 0.533 acres in fee simple and 0.193 acres for a temporary construction Easement from
property located at 1750 S. FM 1626 in Precinct 2, which is owned by Robert J. and Sherry Lowden and
which is required for the construction of the proposed FM 1626 roadway improvements. Commissioner
Whisenant recused himself from this agenda item. Commissioner Ingalsbe, Commissioner Jones,
Commissioner Conley and Judge Cobb voting Aye. MOTION PASSED
DISCUSSION OF ISSUES RELATED TO THE HAYS COUNTY JAIL, AND THE PLANNING OF
PROJECTS PERTAINING TO THE PUBLIC SAFETY FACILITIES NEEDS WITHIN THE COUNTY
Judge Cobb gave the Hays County Jail Report. Hays Countys current maximum jail capacity is 362 inmates.
Jail Standards recommends holding approximately 10% of capacity open. That lowers our capacity to 311. The
jails daily average was 268 and peak was 285 on July 13th for the week of July 10 to July 16, 2016. The
maximum female capacity is 76 inmates. Last weeks average was 70 and peak was 74 on 7/11/2016. The
maximum male capacity is 256 inmates. Last weeks average was 198 and peak was 215 on 7/13/2016. Inmate
at Guadalupe County: 109; Inmate at Bastrop County: 18; Inmate at Caldwell County: 31; Inmate at Walker
County: 1.

Hays County Fire Marshal, Clint Browning spoke of the predicted forecast for the coming week. It will be dry
and hot with no expected rain. Todays Drought Index is 559. Clint Browning requested the Burn Ban be
implemented. A motion was made by Commissioner Conley, seconded by Commissioner Whisenant to
implement the 90-day Burn Ban. All voting Aye. MOTION PASSED

Health Services (DSHS) Immunization Program .The funding provides support of the salary and benefits of the staff

electricalaswellastheconstructionofnewwalls,millwork,plumbingandelectricalfornewoffices.Reworking
andbalancingofexistingHVACwillberequiredforthenewfunction.Thisprojectwillconsistofmultiple
officestohousethecommissionersoffice,JusticeofthePeace,Constable,AgExtension,Clerks,TaxAssessor
andSheriffsoffice.
ScopeofworkalsoincludesElectricalAndPlumbing(seeattachedPlans)
WARRANTY:
TheContractorwarrantstotheOwnerthatthematerialsandequipmentprovidedundertheContractwillbe
ofgoodqualityandnewunlessotherwiserequiredorpermittedbytheContract,thattheconstructionwillbe
freefromfaultsanddefectsandthattheconstructionwillconformtotherequirementsoftheContract.The

WHEREAS, The attached Bid Package which includes the Cover Sheet, Instructions, Specifications,
General Conditions, and Bid Sheet(s) for the item(s) being published for competitive bid, were solicited
pursuant to Texas Local Government Code 262.021; and
WHEREAS, the Hays County Commissioners Court as the governing body of Hays County did on

and the County agrees to make payment for such items or services purchased on appropriate Purchase Orders in
accordance with the items of said Bid Package which is made a part of this contract and incorporated herein for
all purposes.
THAT IN ACCORDANCE with the attached the Countys acceptance of equipment, supplies and services shall
be contingent on (1) they conform, (2) they were delivered (if applicable), and (3) services have been
satisfactorily performed in the sole determination of the County.
Prior Agreements Superseded
This Contract, with the entire Bid Package incorporated herein for all purposes, including any required
supporting literature, brochures, and/or data sheets or sample, constitutes the sole agreements of the parties to
the agreement and supersedes all oral or written previous and contemporary agreements between the parties and
relating to matters herein.

Because Caldwell County has indicated it can no longer receive inmates from Hays County, the Sheriff's Office is
now seeking to add an additional facility to its lineup of possible hosts for inmate overflow at the Hays County
Corrections Facility. This contract is in the form of other contracts already considered and executed by Hays
County (See attached).

II.
For the purpose and consideration herein stated and contemplated, Contractor shall provide
the following necessary and appropriate services for Hays County to the maximum extent
authorized by this agreement, without regard to disability, race, religion, color, age, sex and
national origin; to-wit:

A. Accept and provide for the secure custody, care and safekeeping of prisoners in
accordance with state and local laws standards, policies, procedures, or court orders
applicable to the operations of the Contractor Facility.
B. In the event that the Contractor Facility shall be at maximum capacity as a result of
Burnet County or other inmates, Contractor reserves the right to require the removal
or transfer of Hays County's prisoners within forty-eight (48) hours after notice to
Hays County, in order to provide facilities for Burnet County prisoners, and
Contractor agrees to notify Hays County as soon as possible when Hays County
prisoners must be removed from the Contractor facility because of capacity limits.
C. Notify Hays County as soon as possible of all emergency medical cases requiring
removal of a prisoner and health care services to include transportation and guard
services provided outside the Contractor facility. All extraordinary medical care and
prescription drugs shall be paid for by Hays County.
D. In no event shall Contractor be required to accept Hays County prisoners under the
terms and conditions of this agreement if such transfer of prisoners will cause
Contractor Facility to be in violation of the Texas Jail Standards Commission.
Contractor, in its sole discretion, shall determine whether a Hays County prisoner
shall be accepted for incarceration by Contractor. Nothing contained herein shall be
construed to compel Contractor to accept any prisoner if it would place Contractor in
violation of any law, regulation or court order.
E. Nothing contained herein shall be construed to compel Burnet County Sheriff, acting in
his capacity as keeper of the jail, to accept any prisoner for any reason.
III.
Hays County designates Captain Mike Davenport as Liaison Officer for Hays County with and
between Hays County and Contractor. Contractor designates Captain Matthew Kimbler as
Liaison Officer for Contractor with and between Hays County and Contractor. The respective
county sheriff of each county, or his/her designated substitute, shall insure the performance of all
duties and obligation of said County herein stated; and, shall devote sufficient time and attention
to the execution of said duties on behalf of said County in full compliance with the terms and
conditions of this agreement; and, shall provide immediate and direct supervision of all of the
Sheriffs Department employees, agents, contractors, sub-contractors, and/or laborers, if any; in
the furtherance of the proposes, terms and conditions of this Agreement of the mutual benefit of
Hays County and Contractor.
IV.
Hays County agrees to indemnify and hold harmless Contractor, its agents, and employees, from
and against all suits, claims, damages, losses, and expenses, including reasonable attorney's fees,
arising out of Contractor's performance or non-performance of the services and duties herein
stated, but only in regard to the transfer of prisoners by Hays County and duties herein assigned

to Hays County, and specifically excluding the actual incarceration of prisoners by Contractor.
Hays County retains full liability for each prisoner until that prisoner has been processed and
booked into Contractor's Facility.
V.
Contractor agrees to indemnify and hold harmless Hays County, its agents, and employees, from
and against all suits, claims, damages, losses, and expenses, including reasonable attorney's fee,
arising out of Contractor's performance or non-performance of the services and duties herein,
stated, but only in regard to the actual holding and incarceration of prisoners by Contractor in
Contractor's facilities and specifically excluding the transfer of prisoners to and from Contractor.
VI.
Contractor shall be solely in charge of all control, techniques, sequences, procedures, and means,
and the coordination of all work performed under the terms and conditions of this agreement in
regard to the holding and incarceration of all properly delivered prisoners, shall insure, dedicate
and devote the full time and attention of those employees necessary for the proper execution and
completion of the duties and obligations of Contractor stated in this agreement, and give all
attention necessary for such proper supervision and direction.
VII.
Hays County agrees to and accepts full responsibility for the acts, negligence, and/or omissions
of all Hays County's employees, and agents, the Hays County's sub-contractor, and/or contract
laborers.
VIII.
Contactor agrees to and accepts full responsibility for the nets of negligence and/or omissions of
all Contractor's employees, and agents.
IX.
Hays County agrees to and accepts the duty and responsibility for and overseeing all safety
orders, precautions, programs, and equipment necessary to the reasonable safety of Hays
County's employees, and agents, Hays County's sub-contractors, and/or contract laborers.
Hays County further agrees to bring with each prisoner delivered to the Contractor Facility all
packets, jail cards, classification data and other information in the possession of Hays County
regarding each prisoner, and has the duty to advise Contractor of any known dangerous
propensities of each prisoner delivered to Contractor.

X.
Contractor agrees to and accepts the duty and responsibility for and overseeing all safety orders,
precautions, programs, and equipment necessary to the reasonable safety of Contractor's
employees, and agents, Contractor's subcontractors, and/or contract laborers, and all other
persons doing work under a contract or agreement with said Contractor.
XI.
Contractor understands and agrees that Contractor, its employees, servants, agents, and
representatives shall at no time represent themselves to be employees, servants, agents, and/or
representative of Hays County.

XII.
Hays County understands and agrees that Hays County, its employees, servants, agents and
representatives shall at no time represent themselves to be employees, servants, agents and/or
representative of Contractor.

XIII.
For the services hereinabove stated, Hays County agrees to pay to Contractor, for the
performance of this agreement, the sum of THIRTY FIVE AND NO/100 DOLLARS ($35.00)
per day of each prisoner confined in Contractor facilities. A day shall constitute any portion
during a twenty-four (24) hour period beginning and ending at midnight.
Hays County agrees to reimburse Contractor for all extraordinary medical care and prescription
drugs of Hays County prisoners.
Hays County further agrees to reimburse Contractor for damages, which directly caused to
Contractor facilities or employees by the direct action of Hays County prisoners.

XIV.
Hays County agrees to pay to and reimburse Contractor, in Burnet County, Texas, on a monthly
basis, and upon the submission of documented invoice by Contractor, for the cost of the items
and expenses specified in and in accordance with paragraph XIV of this agreement during the
term of this agreement.
XV.
This agreement may be terminated at any time, by either party giving thirty (30) days advance
written notice to other party. In the event of such termination, by either party, Contractor shall be
compensated for all services performed to termination date, together with reimbursable expenses
then due and as authorized by this agreement. In the event of such termination, should Contractor
be overcompensated for reimbursable expenses as authorized by this agreement, Hays County
shall be reimbursed for all such overcompensation. Acceptance of said reimbursement shall not
constitute a waiver of any claim that may otherwise out of this agreement.
XVI.
This agreement represents the entire and integrated agreement between Hays County and
Contractor and supersedes all prior negotiations, representations and/or agreements, either
written or oral. This agreement may be amended only by written instrument signed by both Hays
County and Contractor.
XVII.
The validity of this agreement and any of its terms or provisions, as well as the rights and duties
of the parties hereto, shall be governed by the laws of the State of Texas. Further, this agreement
shall be performable and all compensation payable in Burnet County, Texas.
XVIII.
In the event that any portion of this agreement shall be found to be contrary to law, it is the intent
of the parties hereto that the remaining portions shall remain valid and in full force and effect to
the extent possible.
XIX.
The undersigned officer and/or agents of the parties hereto are the properly authorized officials
and have the necessary authority to execute this agreement on behalf of the parties hereto, and
each party hereby certifies to the other that any necessary resolutions extending said authority
have been duly passed and are now in full force and effect.
