If you fail by one point in midterms, she will make that a 5 and you should
drop.

How to prepare for recits
Youll only be on deck for a few cases but be prepared to know everything
about the case. If you cant answer a certain question, shell let others
answer but then shell go back to you.

Always read cases in the original (heavy on both facts and doctrine). Shell
want you to be able to explain the little details of stories she finds
interesting.
As much as possible, be pro-labor and pro-gender equality.
Expects provisions to be recited almost verbatim. Dont look at your notes
as much as possible.
No TV/Radio or shell give a 5
Dont use gender-bias pronouns/words, use HE/SHE, (i.e. fisherperson
and not fisherman, etc.)
Memorize the provisions, kabisado nya eh so mahirap i-BS

Things we should know:
No electronic gadgets, printed notes allowed

No gadgets.

Perfect attendance premium

Basta no electronics, no clothes that are distracting

Likes to hold joint classes, at one point the rest of the semester will be
joint classes.

She asks for volunteers for joint classes. Volunteer and fill your recit
quota early (2-3 recits for the sem). If she draws your card and see

that you have more recits than the rest, she will draw another card
instead. At least when you volunteer you are more prepared knowing
that you will be called to recite on a given coverage.

Do well in the recits. More generous during volunteer recits, but

How to prepare for recits:


Memorize the facts and issues of the case. The less you glance at your
notes, the better

FACT HEAVY, call them by their first name if theyre the workers,
doctrine mostly repeats but she prefers an almost verbatim reading

Very specific, read cases, although a good digest can be sufficient

Sometimes asks for other doctrines not relevant to the topic, what
else do have to remember about this case

Dont paraphrase while reciting codal provisions, shell correct you


and shell recite the provision down to the comma.

Just read the cases, be able to tell its story, read the reviewers for the
doctrine and other objective stuff.

SUBJECT: PROPERTY

Things we should know:
Required handwritten digests to be passed at the end of the sem (but di na
ata required yung oblicon niya last sem so baka di na to irequire sa inyo)
4 written exams. Midterms (mcq and t/f) plus finals (midterm questions plus
additional questions). Kaya naging 4 kasi pinaretake niya nang pinaretake
until pumasa. I think 70 yung passing. Good luck.
For the written exam, you will really need to study. There are a lot of
questions where you will have to match the facts to the case. I suggest you
take note of the questions already so if he asks you to retake, you will be
ready.
Orals. Take it agad! Hirap hagilapin ni sir.

Particular about details of the facts of the case, especially the

Mostly doctrine and codal reference but know the facts so you know
why the law was applied correctly/incorrectly

Read the cases thoroughly, some details are often ignored by the
ponente but sir likes asking about them because theyre the legit stuff
haha and write your codal summer palang. Your digests dont have to

be so long and detailed if you read the case well cause a lot of his
cases are very memorable.

Ask him to clarify passing grades and grading system. He told us


nobody will fail the midterms when he returned them, but he later
mentioned that the cut-off grade was 75. So always assume that 75 is
the passing grade.

Property relies on clear understanding of the facts, so understand the facts
and how that affects the doctrine, especially when it comes to the BuilderPlanter-Sower Part.

Midterms is rules-based, so memorize the rules verbatim. May minus
pag di verbatim.
Finals is case-based. So magbasa ka ng kaso during the sem para di
mo i-cram sa finals.

Write down everything she says, especially the procedures. She likes
to review previous lessons.

He asks for handwritten notes, thought we had classmates na face to face

and since hes a super adorable prof, handwritten notes please

(like warranties).

No need to memorize provisions. Just understand the concepts

Her finals are one of the hardest Ive taken in Malcolm, so theres
that.

SUBJECT: Torts and Damages


A AND B:
Name of Prof: Professor Rommel Casis
Things we should know:
Buy his two books;
Coverage is around 35 pages of the book for Torts, and 50 pages for
Damages;
Allows anything to be used during class (tablet laptop etc.), though his
patience is short when you do not respond promptly
(naghahanap/nagbabasa pa sa notes), leading to Sir calling another person;
Discusses through powerpoint;
At the first part of the course (Torts), recitations are rarely as simple as
reciting cases. Instead Sir presents problems in his powerpoint which have
slightly tweaked facts from the cases assigned. These problems can be
answered by synthesizing the lessons from his book, provisions, as well as
the cases;
At the latter part of the course (Damages), problems from his powerpoint
become fewer;

His Finals consisted of 6 items, all of which do not have a correct answer
according to Sir (e.g. Alma Moreno interview napahiya, can she sue for
damages?);
Sirs grading system for each question in the final is relative, which means
that kung kaninong answer pinaka maganda, siya highest. Hindi daw pwede
na 2 persons same yung score.

and full cases because sir likes to ask how is the case different from his
problem. Take note of provisions, what are the keywords in each since those
usually make and break the difference of the case with his problem

What is the rule? What are the exceptions?

Study tips for the subject: You can never be fully prepared for Sirs tricky
problems. When answering the problems, read it carefully and take note of
the things which are important and different. Answer by citing the rule or
exception, your legal basis, and distinguishing the case from the problem
given by Sir.
C:

Things we should know
Anything goes

Magpaka-Magis
Dont read your notes, just glance. Hell call you out if youre looking
at your notes for more than a few seconds and do it often
Digresses a lot

The class is hell while youre in it but when you look back youll
surprise yourself at how much you remember. Kayod lang.

Reference materials used:

None

Recommends Jarencio, which includes summaries of Philippine cases.


Will ask about what Jarencio said about the topic, if applicable.
Sometimes asks about cases cited in Jarencio as well (bonus points if
you get them)

How to prepare for recits:

Master the facts. Hell ask very specific questions about the smallest
details, and he expects you to answer them confidently. Research
about weird or arcane terms used in the English cases

The facts matter because the slightest variations influence the


doctrine. Understand why the cases, although having similar but not
identical facts, were decided differently.

Sometimes has the codal provisions recited verbatim.

If he asks to recite/explain a provision, it simply means to recite it


verbatim. You could also add additional information afterwards, if
necessary.

Know everything there is to know about the English cases (names,


weird terms, diseases that come up, how high the wall was, how far
the street was, how the car was positioned, etc.). Again, he often asks
students to illustrate the situation.

English cases include all opinions and no majority opinion so try to


quickly read through the entire thing to figure out which side won and
whose opinions matter. (or look it up on Wikipedia)
Try to visualize the cases because hell eventually ask you to do so in
class.
Know how to pronounce words properly [properly = British
English/Zaldy English]

Always bring a whiteboard marker.

Study tips for the subject:

He assigns English (as in cases decided by the House of Lords) cases


for the first part of the sem. These cases are written in a completely
different way, so take time to read them.

Helps to be familiar with the codal.

Actually, master how interest (when it comes to damages) is applied.


Make a chart and everything.

He comes in late most of the time, use the extra time to review the
facts of each case.

Comprehensive finals with one set of facts with many questions
