1. Yes, the real property covered by the subject deed of mortgage is paraphernal property.
The property subject of the mortgage is registered in the name of Corazon G. Ruiz, of legal
age, married to Rogelio Ruiz, Filipinos. Thus, title is registered in the name of Corazon alone
because the phrase married to Rogelio Ruiz is merely descriptive of the civil status of Corazon
and should not be construed to mean that her husband is also a registered owner.
2. No. We affirm the ruling of the appellate court, striking down as invalid the 10%
compounded monthly interest, the 10% surcharge per month stipulated in the promissory notes
dated May 23, 1995 and December 1, 1995, and the 1% compounded monthly interest stipulated
in the promissory note dated April 21, 1995. The legal rate of interest of 12% per annum shall
apply after the maturity dates of the notes until full payment of the entire amount due. Also, the
only permissible rate of surcharge is 1% per month, without compounding.
VIII. DISPOSITIVE PORTION:
IN VIEW WHEREOF, the appealed Decision of the Court of Appeals is AFFIRMED,
subject to the MODIFICATION that the interest rate of 36% per annum is ordered reduced to 12
% per annum. SO ORDERED.
