Legal Basis Republic Act No. 7157, The Foreign Service Act of 1991, Section 6 states that the Undersecretaries “shall advise and assist the Secretary in the formulation and implementation of the Department objectives and policies, and to coordinate and oversee the operational activities of the Department of Foreign Affairs.” Department Order 194-95, The Implementing Rules and Regulations of the Foreign Service Act, Section 4, authorizes the Secretary to “establish policies and standards for the efficient and effective operation of the Department’, and “delegate authority for the performance of any function to officers and employees of the Department’; Executive Order No. 292, The Administrative Code of the Philippines, states that “The Secretary shall have supervision and control over the bureaus, offices, and agencies under him, subject to the following guidelines: (a) Initiative and freedom of action on the part of subordinate units shall be encouraged and promoted, rather than curtailed, and reasonable opportunity to act shall be afforded those units before control is exercised”; Republic Act No. 9485, The Anti-Red Tape Act of 2007, promotes the adoption of simplified procedures that will reduce red tape and expedite transactions in Government; Section 5 of Republic Act No. 9184, The Government Procurement Reform Act provides “that in a department, office, or agency where the procurement is decentralized, the Head of each decentralized unit shall be considered as the Head of the Procurement Entity subject to the limitations and authority delegated by the head of the department, office or agency.” Section 2, Policy It is the policy of the government to promote economy, efficiency, and effectiveness in the delivery of public services. Delegation of Administrative Authority and Functions Subject to existing laws and regulations, the mandate and authority of the Secretary on administrative matters and the power to act pursuant to said mandate and authority are hereby delegated to the Undersecretary for Administration, All documents and papers specifically requiring the Secretary's approval under existing laws, rules, and regulations shall be signed by the Undersecretary for Administration under the phrase, "By Authority of the Secretary of Foreign Affairs”. Section 4. Exceptions The above shall not cover the following: a. Foreign assignment, cross-posting, extension of tour of duty, or recall of personnel. b. New and special’ non-recurring charges against the Passport Revolving Fund. ¢. Major Department projects, contracts, and agreements in the amount of PHP500 million or'higher; and d. Other matters which the Secretary may himself sign in the interest of public service. Section 5. Retention Clause The Secretary shall retain power of control as Head of the Department. The delegation of authority as provided under this Order to the Undersecretary for Administration shall not in any way divest the Secretary of said authority or to act pursuant to the same, and to revoke prior acts based on delegated authority. Section 6. Repealing Clause All Department Orders, Memoranda, rules, and regulations inconsistent with the provisions of this Order are hereby modified accordingly. ALBERT F.
