COMPLAINT - AFFIDAVIT
I, LENI RUGISTA, of legal age, Filipino Citizen, married, and
resident of Makati, Philippines, after being sworn to in accordance with law,
hereby depose and state that:
1. I am married to Atty. Rod Rugista, we got married on May 9, 2005
at Manila Cathedral as evidenced by a marriage certificate issued
by the office of solemnizing officer of the said Manila Cathedral
herein attached as Annex A,
2. After our wedding, we lived together as husband and wife in our
conjugal dwelling in Makati City.
3. On June 2014, I was in Cebu City to inspect one Manuela Realtys
projects, when I met Bonita Rugista, one of our Cebu Real Estate
Agents.
4. I learned that Bonita is also married to Rod Rugista in a civil
ceremony solemnized by Judge Juan Dela Cruz on June 12, 2013. I
also discovered that they have a one year old son. A copy of their
Certificate of Marriage is hereto attached as Annex B.
5. My marriage with Rod Rugista is still subsisting and has not been
annulled or dissolved. His act of contracting second marriage to
Bonita Rugista despite the subsistence of our marriage constitutes
the crime of bigamy punishable under Article 349 of the Revised
Penal Code.
6. I executed the foregoing complaint affidavit to attest to the truth
of the facts stated and for the purpose of charging respondent with
the crime of bigamy.

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed
of this Honorable Court that judgment be rendered in favour of the
complainant and that after judgment;
a. The respondent, Rod Rugista, shall be ordered to pay the
amount of PHP 200,000.00 for moral damages, plus cost of suit.
b. The respondent be convicted in violation of the crime bigamy
which is punishable under Article 349 of the Revised Penal
Code.
Such other reliefs and remedies under the premises are likewise
prayed for.

1. I am a complainant in the above stated case;
2. I caused the preparation of the foregoing complaint affidavit;
3. I have read the contents thereof and facts stated therein are true and
correct of my personal knowledge and/or on the basis of copies of
documents and records in my possession.
4. I have not commenced any other action or proceeding involving the
same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;
5. To the best of my knowledge and belief, no such action or proceeding
is pending in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;
6. If I should thereafter learn that a similar action or proceeding has been
filed or is pending before the Supreme Court, the Court of Appeals, or
any other tribunal or agency, I undertake to report that fact within five
(5) days therefrom to this Honorable Court.
TO THE TRUTH OF THE FOREGOING, I have signed this
Complaint Affidavit with a prayer on September 25, 2016.
