COMPLAINT-AFFIDAVIT
I, IRENE BERNAL y VILLANUEVA, of legal age, Filipino citizen, legally married to
respondent ROMEL BERNAL y RODRIGUEZ and presently residing at 310 Lallana St.,
Tondo, Manila, after having been duly sworn to in accordance with law, hereby depose and
state that:
1.

I am filing this criminal complaint against my legal husband ROMEL BERNAL

y RODRIGUEZ and his concubine ANALIZA R. DE GUZMAN who are both
residing at 17 G. Soriano St., San Juan City for the Crime of Bigamy under
Article 349 of the Revised Penal Code and Concubinage under Article 334 of
the Revised Penal Code and against ROMEL BERNAL y RODRIGUEZ for
Violation of Republic Act 9262 or the Anti-Violence Against Women and
Children law (VAWC);

2.

Romel Bernal y Rodriguez and I were legally married on March 4,2010 in

the City of Manila as evidenced by a copy of the Marriage Contract with
registry number 2010-2435 issued by the National Statistics Office which is
hereby marked and attached as Annex A and made as an integral part of
this complaint-affidavit;

3.

Unfortunately, respondent Romel Bernal y Rodriguez and I are separated in

fact since 2010 which was primarily caused by his womanizing ways which
resulted to economic hardship on our part. He promised me that he will go
back to me after fixing his life in Dubai;

I waited for respondent Romel Bernal y Rodriguez to change but he never did
until I discovered that the reason he left and abandoned me and our child for
good is because he was already living with another woman, respondent
Analiza R. De Guzman. I confronted him about what I learned and he readily
admitted to me that they were really living together;

5.

All along, I thought that respondents are merely living together without the
benefit of marriage until I discovered recently that respondents married each
other as early as 4 November 2012. The existing marriage of the respondents

is shown by a copy of the Marriage Contract with registry number 2012327 issued by the National Statistics Office is hereby marked and attached as
Annex B. Furthermore, a Certification/Advisory on Marriages issued by
the National Statistics Office is hereby marked and attached as Annex C.
Both annexes are made as an integral part of this complaint-affidavit;

The subsequent marriage between the respondents is obviously prohibited,

illegal, void and a criminal offense under the Revised Penal Code ;

Due to the shameless betrayal of respondent Romel Bernal y Rodriguez to

whom I am legally married and the criminal complicity of her concubine and
mistress, respondent Analiza R. De Guzman, who willingly participated in
such illegal affair and prohibited subsequent marriage, I suffered severe and
irreparable emotional pain, trauma and suffering which is tantamount to the
emotional abuse and violence contemplated under Republic Act 9262;

Moreover, I also experienced sleepless nights, social humiliation, mental

anxiety and psychological torture which added to the emotional abuse and
violence that I have continuously suffered up to this present time;

To add insult to injury, respondent Romel Bernal y Rodriguez recently filed a

civil case to annul my marriage with him when it cannot be denied that it is his
subsequent marriage with respondent Analiza R. De Guzman which should
be declared null and void;

10.

My only intention of filing this criminal complaint against respondents Romel

Bernal y Rodriguez and Analiza R. De Guzman is to vindicate my name and
dignity and uphold my rights and reputation and to punish my legal husband
for running away from his legal, moral and natural obligation to observe
loyalty and fidelity to me as his legal wife;

I am executing this Complaint-Affidavit to attest the truth of the foregoing in

support of the filing of the case of Bigamy and Concubinage defined and
penalized under Article 349 and Article 334, respectively, of the Revised
Penal Code against my legal husband ROMEL BERNAL y RODRIGUEZ and
her concubine/mistress, ANALIZA R. DE GUZMAN and the case of Violation
of Republic Act 9262 (Anti-Violence Against Women and Children)
against ROMEL BERNAL y RODRIGUEZ.

AFFIANT FURTHER SAYETH NAUGHT.
