However, its also my understanding that you have contacted other state agencies regarding this matter. However, resolution ofthis iesue really must be addressed by the Department and | have reviewed this matter withthe relevant personnel before responding. Accordingly, ! would request that you accept this response and proceed accordingly Itis my understanding that you filed a document for recording with the UCC office. You subsequently contacted that office regarding the status of that fling. However, because of the large number of documents that are fled with SDAT, iti dificult to find any one document when itis in the processing stage. Accordingly, your document could not be immediately located upon your call. However, when the manager of that section did lear the status of your filing, she contacted you on October 27, 2015 to advise you that your document had been rejected for fling because it had utilized a color of ink other than black. Unfortunately, the Department's scanning equipment does not effectively copy ink that is not black and, therefore, the Department cannot accept those documents because they cannot be legibly recorded within the UCC database, Because of that rejection, the documents were returned to your above listed address, which was the only address known to the Department. Since that mailing was not returned by the post office, the Department assumed that it was delivered. However, you have indicated that you have never received these retumed documents, After receiving your letter, | have reviewed this matter with departmental personnel.
