Motion by Thomas Supported by Martin RESOLVED, to approve the minutes of the regular City Council meeting of November 7, 2016 2s presented Motion carried unanimously 6-0 CITIZENS TO BE HEARD: Sue Farrar of the Beautification Commission thanked the Flat Rock High School wood shop class for making the manger for the Nativity scene and thanked Mr. Masserant (wood shop teacher) for arranging the class project. She also annonnced many upcoming events including, 5 Santa Comes to Flat Rock on Tuesday, November 29, 2016 from 6:30-8:00 PM, with the tree lighting at 6:00 PM. The Christmas Home and Business Decorating Contest sponsored by DTE Energy will be judged on December 8° ‘between the hours of 7:00 — 11:00 PM. Senta’s mailbox is at the Library starting November 21" through December 16" and at City Hall only on November 29" when Santa comes to Flat Rock. REPORTS FROM DEPARTMENT HEADS: Recreation Director Rodney Wade reminded everyone, of the Flat Rock Senior Christmas Gathering at the Community Center. It will take place on Thursday, December 1, 2016 from 1:00 4,00 PM with dinner served at 2:00 PM, Director Wade spoke of Breakfast with Santa at the Recreation Center on December 3, 2016. Police Chief John Leacher thanked all the volunteers who helped with the Goodfellows drive approximately $3,100.00 was collected. The funds will help over 60 families. Chief Leacher announced on November 30, 2016 at the Blue Heron Trading Company. REPORTS FROM COUNCIL MEMBERS: Council Member John Bergeron wished all a happy Thanksgiving. Council Member Jim Martin wished all a happy and sale Thanksgiving Council Member Ken Wrobel wished all « happy and safe Thanksgiving and reminded all not to drink and drive. MAYOR COMMENTS: Mayor Dropiewski welcomed Nutrition Hub to Flat Rock and wished them much success. The Mayor spoke of the following upcoming events: (On November 29, 2016 Santa comes to City Hall for the Christmas Tree Lighting and Santa's Arrival. Thursday Dec 1, 2016 at 1:00 pam. is the Annual Senior Christmas Gathering at the Community Center for those ages 55+. Event is free for residents but preregistration is required. Call the Community Center at 734-379-1450, Santa returns on Saturday Dec 3, 2016 at 9:00 a.m, for Breakfast with Santa at the Community Center. There will also be a magic show. ‘There is a small cost for the event, Preregistration is required. Please call the Community Center at 734-379-1450 for more details. The Christmas Home and Business Decorating Contest judging, will take place on December 8, 2016. Registration is not required and winners will be notified On Friday December 9, 2016, the Community Center is offering a Kids Night Out from 5:00- 9:00 p.m. for kids ages 2-13. There is a small cost for this event but this drop off event includes @ pizza dinner and wide variety of activities, while giving parents a night out. Preregistration is, required. Please call the Community Center at 734-379-1450 for more details. Sunday December 11, 2016 from 1:00-4:00 p.m., Mrs. Claus arrives at the Munger General Store. Throughout the Christmas season Santa's mailbox will be available at the Flat Rock Library. Please include the child's name age and mailing address on the letter so that they may receive a response. The mailbox will be brought to City Hall for Santa's arrival on the 29th and retumed to the Library on the 30th. The deadline for letters is December 16, 2016 at 1:30 p.m, Already underway is the Flat Rock Our Hometown Christmas Passport program. Available in any one of the 40+ participating Flat Rock businesses or at City Hall, the Passport program is designed to encourage shopping within Flat Rock. With each purchase you receive a stamp. When you retum your Passport with 6 stamps from at least 3 different businesses you are entered into a drawing to win up to $500 in dollars to be spent at participating Flat Rock businesses, With 6 stamps from 6 different businesses you ate entered to win a large basket filled ‘with items from all of the businesses. On Thanksgiving Weekend (including Small Business Saturday) most businesses will be doing double Stamps. There is no limit to the number of passports you may’ turn in, so please Shop and Dine in Flat Rock! The Flat Rock Model Train Depot and Museum will be open during the Holiday Season with special Christmas displays. The Holiday Depot exhibit will be open from 1:00-4:00 p.m, with a small Admission fee on the following days during the upcoming weeks, November, 28, December 5, 13, 19, 23, 26, 30 January 2, 2016 ‘There are also a few 50th Anniversary Limited Edit Ornaments still available at City Hall. With the weather eventually changing, the DPS department will be getting the Ice Rink. ready for the season as well, Please stay tuned to the City’s website and Facebook for opening dates and detail City Hall will be closed on Thanksgiving Day, the Day after Thanksgiving, Dee 23, 26 (for Christmas Eve and Day) and Dec 30, Jan 2(tor New Year's Eve and Day). Please note also that due to Jan 2 being an official State and Federal Holiday the Flat Rock City Council meeting will be moved to Jan. 3rd at 7:30. UNFINISHED BUSINESS: None NEW BUSINESS ‘Item 9-A-Agreement with Community Action Alliance - Water Residential Assistance Program Resolution 11-21-03 Motion by ‘Thomas Supported by Wrobel RESOLVED, to approve the agreement with Community Action Alliance - Water Residential Assistance Program and to authorize the City Clerk to sign the agreement. The program which purports to provide assistance by the Great Lakes Water Authority for water bill assistance, water conservation measures, and planning for eligible households to assist the household toward self-sufficiency in the payment of waier and sewer bills. Under the Memorandum of Understanding, the households entering the program, the City would agree to the following: + Freeze arrearages for a period of up to 12 months. * Waive penalties. + Stop pending shut offs. + Exempt the water bill from being placed as a lien against the property while the household is eligible under the program, ‘The Agreement would further require the City to designate an individual within the City to coordinate with the Agency as to customers eligible for the program. As to back due water bills, the program would provide assistance per residence of up to $1,000 annually consisting of a $300 annual bill eredit and $700 annually in assistance for past due arrearage, Motion carried unanimously 6-0 Item 9-B-SMART Municipal Credit Contract, Fiscal Year 2017 (Resolution 11-21-04 Motion by Martin ‘Supported by Thomas RESOLVED, to approve the Municipal and Community Credit Contract between the City of Flat Rock and SMART for Municipal Credits for the fiscal year, 2017 in the amount of $9,728.00; and BE IT FURTHER RESOLVED, the Mayor is authorized to execute the Contract. Motion carried unanimously 6-0 Item 9-C Community Center Cardio Equipment Lease Renewal Motion by Thomas Supported by Martin RESOLVED, to approve the lease agreement with All Pro Exercise Ine. (as option #3) for the Flat Rock Community Center with the total cost over 3 years of $79,900; and BE IT FURTHER RESOLVED, the city agrees to waive the bidding process. Council Member Bergeron asked why this didn’t go out to bid. Director Wade responded he received two (2) quotes from other companies and the prices came in higher with fewer options, Motion carried unanimously 6-0 10. u. ‘Item 9-D-Bid Recommendation ~ Demolition of House at 29409 Red Cedar [Resolution 11-21-04 Motion by Martin, Supported by Wrobel RESOLVED, to reject the single bid received Pro Excavation Inc. in the amount of $36,000 and to rebid the project due to the high amount of the single bid. Motion carried unanimously 6-0 Item 9-E- Pavement Marking Invoice (Resolution 11-21-07 ‘Motion by Thomas Supported by Martin RESOLVED, to accept the revised Pavement Marking Invoice as described Invoice #216151 from RS. Contracting Inc. for the pavement markings and stripes project was approved at the October 17, 2016, council meeting. While the original contract amount was $13,685.00, the work performed totaled $16,799.90, partly due to additional work, and partly due to recent changes in required stop bar sizes, cross walk sizes and the sizes of the transverse bars for railroad markings. These items were brought up at the time the work was done, and since there were no unit prices for the sizes of cold applied plastic bars required, the unit price for 12” bars was used and the quantities were adjusted on the invoice accordingly (6" bars equal linear feet X .5, 18” bars equal linear feet X 1.5, 24" bars equal linear feet X 2). All quantities have been field measured and matched to the quantities invoiced, While this is a considerable increase from the original quote all work was done to current standards, Motion carried unanimously 6-0 CITIZENS TO BE HEARD (ADDITIONAL COMMENTS): None IRRESPOND None 12. Inspection, repair and routine maintenance of the facilities under its jurisdiction Water Main and installation of 2" pipe 1. Inepoction, repair and routine maintenance of the facilities under its jurisdiction 2, Water service connection with 2" diameter pipe or less, serving single customer ‘A separate permit will be required for any operations performed under the following conditions for Water and/or Sanitary related work: a. For all water service connections larger than a two inch (2) diameter. b. For any water service connection that serves more than one customer. ©. Whenever work is to be performed in a new subdivision. d. For any sanitary sewer service connection. Dust Palliative Applications 1. Dust palliative treatment shall be with calcium magnesium chloride in accordance with Wayne County specifications, 2. The municipality shall designate each road to be treated with dust palliative and pay the Contractor forall materials and service. 3. Prior to the application of Dust Palliative Materials, the Permit Holder shall provide at least seven (7) days notice to the Wayne County Roads Division (813-955-9920) to allow for preparation and inspection of the roads to be treated. Sidewark 1. Existing sidewalks may be repaired or replaced at existing alignment on existing grade. A soparate permit will be required for the construction of a new sidewalk, for the replacement of an existing ‘sidewalk on a new alignment or grade or for the construction of new sidewalk ramps to the County road. ‘Street Sweeping 1, Street sweeping shall be performed during daylight hours only. 2. Alltraffic control devices shall conform to the provisions of the current MMUTCD. Permit Conditions 1. A separate permit will be required for final pavement repairs when pavement is broken while making either emergency or non-emergency repairs. 2. Reports indicating all work performed or that no work was performed under the permit shall be provided to the Permit Office at the end of each month. 3. Proof of automobile liabilty shall be in amounts not less than $1,000,000 combined single limit for each aceldent, bodily injury per accident, and property damage per ‘accident, and in an amount not less than $1,000,000 for bodily injury each person, each occurrence and property damage liability $1,000,000 each occurrence. ‘The certificate of insurance must be provided by a person, the corporation, or by authorized representatives who signed personally either the application of permit. Insurance shall remain in force until the permit is released by Wayne County. ‘The Wayne County Department of Public Services shall be a Certificate Holder on the policy of insurance. Wayne County, drainage district, and its officers, agents and employees shall be named as additional insured parties. It is also required that the annual permit numbers are included on each certificate of insurance. ‘The insurance shall cover a period not less than the term of the permit and shall provide that it cannot be cancelled or reduced without thirty (80) days advance written notice to Wayne County, by certified mail, first-class, return receipt requested. The thirty (30) days shell begin on the date when the County received the notice, as evidenced by the return receipt Such insurance shall provide by endorsement therein for the thirly (30) day notice by the insurer to the Permit Otfice prior to termination, cancellation or material alteration of the policy. Licensee agrees to make application for renewal thereof al least sixly (60) days before the expiration date of the policy then in force and to file a certified copy of such renewed policy with the Permit Office. The policy shall also provide by endorsement for the removal of the contractual exclusion. Should insurance coverage be cancelled of reduced below acceptable limits, or allowed to expire, the authorization to continue work under the permit shall be suspended or revoked and shall not resume until new insurance is in force and accepted by Wayne County. Wayne County may, in such cases, take appropriate action to restore or protect the road and appurtenances. All costs incurred by this action shall be deducted trom any remaining inspection deposit, bond and/or Letter of Credit and, if necessary, the Permit Holder may be billed to defray actual expenses. Motion carried unanimously. IL Action Items * Acceptance of 2015 Audit Mr. William Brickey presented the 2015 Financial Report, prepared by Plante Moran. Mr. Brickey touched on some of the highlights of the Report, including the Audit Opinion, what he calls “the main deliverable as [the Court’s} auditor.” Mr. Brickey stated the Court’s financial statements are in compliance with all rules and regulations. He directed the Council to look at page 31, which compared the general operations of the Court compared to the budget. From a revenue perspective, the Court was $46,000 below the budgeted revenue. As for expenses, the Court was under budget $220,000. Thus, the net impact was around $174,000.00 to the good. Mr. Brickey stated that, as in the past, the total amount will be distributed to the communities. He also compared 2015 to 2014, noting that expenses were nearly the same, and that the Court spent $10,000 less in 2015. Mr. Brickey then discussed the Retiree Benefit Trust Fund, which previously had a balance of around $74,000. He reminded the Council that $47,000 had been transferred out of the Pund and into the Capital Improvement Fund to help pay for the HVAC system in 2015. He explained that the delay in findizing the Audit was determining whether the transfer was an allowable transaction because transfers out of a Trust Fund can normally only be used for their initial intentions. Mr. Brickey explained that they looked back to the time when the Trust was created and concluded that the Trust was not actually a legal trust, Thus, the Financial Statements had incorrectly reported its status as a ‘Trust over the years. To correct it, the Financial Statement moved those dollars from a separate fund and placed them into the General Fund as a committed line item. This action is called a Prior Period Adjustment, and the impact of said adjustment is noted in the Report on page 29. Amy Zawacki informed the Council that she spoke to the Court’s labor counsel to ensure that reclassifying the Fund would not create a grievable issue with the Court's unions, Labor counsel advised that because the Court is still providing the benefit, the unions would not have a meritorious claim. Mr. Brickey reminded the Council that because of how itis structured, not many employees ever become eligible for the benefit. Mr. Brickey also clarified that because the retiree benefit is designated as a committed line item, the Pund balance includes the standard $170,000 established by the Council plus the $27,000 remaining from the Retiree Benefit Trust Fund, He also said the Council can un-commit the money or recommit it to something else. Mr. Brickey also reviewed the Sobriety Court Fund, the Chemical Awareness Fund, and the Work Program Fund. Notably, the Work Program Fund brought in $14,000 more than the required $10,000 fund balance policy, so the excess amount will be distributed to the communities. Mr. Brickey also pointed out the Schedule of Amounts payable to the communities listed on page 38. Mr. Brickey discussed the letter provided to the communities where a deficiency was noted. Mr. Brickey explained that the deficiency relates to the Prior Period Adjustment conceming the Retiree Benefit Trust Fund. He also said that other than the Prior Period Adjustment, there were no other problems and the books and records were in great shape. Mr. Penix asked about the excess money in the salary line item and Judge McNally explained that seasoned employees with higher wages retired, and that these employees were replaced with new employees making lower wages. A copy of the Agreement is attached. Under the Agreement, the Developeragreed to develop Bradbury Park (202 acres) asa single family residential district, consisting of a maximum of 170 single family site condominium lots, 48 single family detached condominium units, and 74 duplex condominium units, Further, the Agreement provided for the construction of 290 stacked condominium units to be located in 29, 10 unit buildings. Also, under the Agreement, the Developer was to develop approximately 2.96 acres of the development for neighborhood commercial/office uses. Unlike a subdivision, sanitary and storm lines, water lines, and roadways are not automatically dedicated to the City in a site condominium development. In 2008, the Developer tendered the transfer ofthe utility lines and roadways to the City, but because of lack of compliance of many of the requirements of the Agreement (by way of example, lack of streetlights) these items have never been accepted by the City. It now appears that the City is in the position to accept the utility lines, easements, and roadways. The City Engineer and Director of Public Services have represented that the Developer, at least as to these items, is now in compliance with the Agreement. Enclosed for your consideration, please find a Resolution accepting the roadways, utility lines, and easements. If acceptable, please approve. ‘Though there are other items yet to be completed or paid by the Developer, because street lights have now been installed at the Developers expense in the roadways, the City is now in the position to accept these improvements.
