CAMDEN county BoaRD of eoucaTToN’ 174 Worth 343 camden, NC 27921 SUPERINTENDENT'S CONTRACT Tt is hereby agreed by and between the caMoeN coWNHHBSK0 oF EDUCATION located in Camden County in the State of North Carolina (hereinafter called "the Board") and Melvin L, Hawkins (hereinafter called the "Superintendent”) that the Board in accorcance with its action as found in the minutes of the meeting held on the 8th day ©f July, 2020 did and does hereby employ the said Melvin b. Hawkins a5 Superintendent pursuant to North Carolina General Statute (G.8.) Sec. 125¢-271 commencing July2A_, 2010 and, ending on June 30, 2014. Both parties agree that said employee shall perform the duties of Superintendent in and for the public scheols served by the Board as prescribed by the laws of the State of North Carolina and pursuant to the rules and regulations made thereunder by the Board WITNESSETH: (1) TBRH. The Board hereby employs the Superintendent as Superintendent of the Camden County Fublic Schools for a term commencing at 12:01 o'clock a.m. on JulyQ\, 2010, and ending at 11:59 o'clock p.m. on dune 30p-2024, (2) QUIZES. During the tezm of this Agreement, the Superintendent shall have the powers, duties and responsibilities of @ Superi ndent as prescribed by the laws of the State of North Carolina, including but not limited to, N.c. G.S, 115¢-276, and such rules and regulations shall be adopted by the Board from time to time. The Superintendent shall have charge of the administration of the school system under the direction of the Board. He shall be the secretary to the Board and chief Executive Officer of the school system. Subject to the approval of the Board, the Superintendent shall: (a) direct and assign teachers and other employees of the school system under his supervision; (0) organize, reorganize and arrange the administration ef the school system, including instruction and business affairs: (2) recommend the employment and discharge of all personnel; (4) recommend policies to the Beard: (e) establish procedures for the day-to-day operation of the school systems (9 provide administrative recommendations for items of business to be considered by the Board and its committees; and (g) perform such other duties as may be prescribed by the Board The Bowrd, individually and collectively, should promptly refer all criticism, complaints and suggestions called to its attention to the Superintendent for study and recommendations and shall refrain from individual interference with the administration 9f school policies except through Board action. (3) COMPENSATION. During the term of this Agreement, the Superintendent's compensation shall be as follows: (a| Salary. The Superintendent shall receive a base salary of $95,000.00. An increase in salary shall not be deemed to have extended the termination date of this Agreement. The salary paid Pursuant to this subparagraph (a) shall not be reduced during the term of this Agreenent o) th Benefits. ‘The Board shall provide medical insurance coverage for the Superintendent throughout the term of the Agreement. In addition, the Board shall pay for any insurance options selected by Superintendent from those options offered by the insurance plan sponsored by the Board (c) Longevity. The Superintendent may receive en annual longevity payment to the extent provided or approved by the state budget each. (4) Other Benefits. The Superintendent shall not Feceive any salary amounts which are not authorized in the Agreement or by specific Board action. (4) DISABILITY. Should the Superintendent be unable to Perform any or al} of his duties by reason of illness, accident, of other causes beyond his control and should said disability exist for a period of more than sixty (60) working days; or if said Gisability is permanent, irreparable, or of such nature as, in the determination of the Board will make the performance of his duties impossible, the Board may, at its option, terminate this Agreement, Whereupon the respective duties, rights and obligations hereof shall terminate. Determination of the existence or non-existence of total or permanent disability shall be made by the Board pursuant to an examination by a physician, psychiatrist, Psychologist or mental health pivfessional then currently Licensed 2 to practice in the State of North Carolina or the State of Virginia and selected, appointed or approved by the Board. (5) BUMUAL LEAVE. The Superintendent shall receive annual Leave as provided by the General Statutes of North Carolina and the regulation of the State Board of Education. (6) SICK LEAVE. The Superintendent shall receive annual sick leave earned © the sane rates provided for other employees of the Board. Earned sick leave days shall be cumulative (7) ‘TRANSPORTATION. The parties recognize that the administrative and professional duties of the Superintendent will requite extensive travel within and out of Camden County, North Carolina. During the term of this Agreement, the Superintendent shall be reimbursed for travel expenses as follows: 4. Expenses. In lieu of providing the Superintendent with automobile transportation or any other reimbursement for the maintenance and use of automobile transportation, the Board shall pay the Superintendent a travel allowance of Five Hundred Dollars and 00/100 ($500.00) per month. b. Superintendent shall be reimbursed for travel outside of the Albenarle Region (Camden, Chowan, Currituck, Dare, Gates, Pasquotank and Perquimans Counties) at the State reimbursement ©. The Superintendent shall be reimbursed for other carrier transportation expenses outside of county while conducting official business. The Superintendent shall file an itemized expense statement with the Chairman of the Board and shall be reimbursed for such expenses upon approval by the chairman, 4 d. The Board will provide the Superintendent with a cellular telephone and pay the cost of use and maintenance of such ©. Professions] Liability. The Board agrees that it shall defend and indemnify the Superintendent fron any and all demands, claims, suits, actions, and legal proceedings brought against the Superintendent in his individual or official capacity, provided the incident giving rise to any such demand, claim, cuit, action, or legal proceeding (a) is not criminal in nature and arose while the Superintendent was acting within the scope and course of his employment and (b) provision of such liability coverage is within the authority of the Board under North Carolina law. In no event will individual Board members be considered personally liable for indennifying the Superintendent against such denands, claims, suits, actions, or legal proceedings. Notwithstanding anything in this paragraph to the contrary, however, the Board shall be under no obligation under this paragraph in excess of any Liability policy lim on any liability insurance carried by the Board covering any demands, claims, suits, actions, or legal proceedings described herein. (8) RESIDENCY. Pursuant to N.C.G.S.115¢-272, the Superintendent is required to reside in camden County, North Carolina, during the term of his employment. (9) PROFESSIONAL DEVELOBMENT. The Superintendent should be @ menber of appropriate professional and community organizations. The Board shall pay annual dues for the Superintendent's menbership in The Anerican Association of School Administrators, The North Carolina Associetion of School Administrators and one local s club selected by the Superintendent. In addition, the Superintendent shall attend appropriate professional meetings at the local, state and national level, the expense of said attendance (beyond that provided in paragraph 7 above) to be incurred by the Board. The Superintendent shall file an itemized expense statement with the Chairman of the Board or the Finance officer. Reimbursement of the Superintendent's dues, registration fees and actual travel and subsistence expenses shall be limited to the appropriation for the purpose approved by the Board in its annual budget. Superintendent may also attend advanced degree course at @ university of his choice for professional development. then the tuition and fees for attending advanced degree courses are approved by the Board, they shall be reimbursed to superintendent (10) PROPESSIONAL CERTIFICATION. The Superintendent shall furnish to the Board, throughout the term of his employment, a valid and appropriate certificate to act as Superirtendent as Prescribed by the General Statutes of North Caroline and by the regulation of the State Board of Education (11) HEALTH CERTIFICATE. The Superintendent agrees to undergo @ medical examination once each year and to cause a statement certifying to his physical competency to be filed with the Chairman of the Board. Such examination shall be paid by the Board and the certifying statement shall be treated as confidential information by the Board. (12) CONSULTING AND OUTSIDE EMPLOYMENT. The duties of the Superintendent requize full time enployment and frequently require that the Superintendent attend to his duties during the evening, 6 weekends and holidays. The Superintendent snall not accept any outside employment that interferes with the performance of his duties under this Contract. The Board recognizes that certain outside employment may have a beneficiél impact on the Superintendent's professional growth and not interfere with the performance of his duties hereunder. The Superintendent may accept @ Limited anount of outside employment on weekends, holidays and on annual leave days provided that the Chairman of the Board has approved in advance the outside employment anc found same will in no manner interfere with the Superintendent's performance of his duties and responsibilities. The Superintendent sha! annually make @ written report to the Board listing all outside employment he has performed that year (23) CONFLICT OF INTEREST PROHIBITED. The Superintendent acknowledges that he has read and understands the conflict of ines st statutes of the State of North Carclina and agrees to comply with those statutes and any other laws or Board policies relating to conflicts of interest. (a4) anwurry. and in accordance with State Law, shall withhold and transfer any \e Board, at the request of the Superintendent amount of salary annually, semi-annually, or monthly, as determined by the Superintendent to provide a tax deferred annuity of his choosing (15) EILING OF CONTRACT. Pursuant to G.S. 115C-271, a copy of this Contract shall be filed with the North Carolina Superintendent of Public Instruction before the Superintenden: assumes office as Superintendent. (16) TERNTIATION OF ENELOYMENT CONTRACT. Throughout the term of this Contract, the Superintendent shall be subject to discharge for good and just causes, provided, however, that the Board does not arbitrarily or capriciously call for his dismissal and that the Superintendent shall have the right to written charges, notice of hearing, and a fair ring before the Board. At any said hearing before the Board, the Superintendent shall have the right to be present and to be heard, to be represented by counsel and to present through witnesses any testimony relevant to the issue. A transcript of the record of the proceedings before the Board shall be made available without charge to the Superintendent in the event fan appeal is taken by the Superintendent from any action taken by the Board. If the Superintendent chooses to be accompanied by legal counsel at the hearing before the Board, he will assume the cost of his legal expenses. (27) GORLS AND OBJECTIVES. During the term of the Contzact, the Superintendent shall prepare a draft of his goals and objectives for the upcoming year. The Board and the Superintendent shall meet on or before August 1 of each year to review the draft and establish the Superintendent's goals and ebjectives for the upcoming school year. Said goals and objectives shall be reduced to writing, establi hed by resolution of the Board, and shall be ‘among the criteria by which the Superintendent is evaluated pursuant to Paragraph 18 herein. (18) EVALUATION. During the term of his appointment as Superintendent, the Board shall provide the Superintendent with an annual evaluation of his performance of his duties as 8 (ce) No change or modification of this Agreement shall be valid unless the sane be in writing and signed by both parties.
