TIS AMENDED (OD RESTATED CONTRACT mae hs te ay of ay 2016 2 cen ‘se Edcnon-GhovenSchoels Boao Edson (he Bea) and Hedt Lhe tse Nope) WHEREAS, the Board desires to provide the Superintendent with a written employment contract in order to enhance administrative stability and continuity within the Board's schools Which the Board believes generally improves the quality of ts overall education program; and WHEREAS, the Board and the Superintendent believe that a written employment contract is necessary to describe specifically their relationship and to serve as the basis of effective communication between them as they fulfill thir govemance and administrative funetions in the operation ofthe education program of the Bosrd’s schools; NOW, THEREFORE, the Board and the Superintendent, for the consideration herein specified, agree as follows: 1, TERM. The Board, in consideration of the promises, hersin contained, hereby employs Robert L. Jackson as Superintendent of the Board's schools fora tem commencing July 1, 2015 and ending June 30, 2019. The Board and the Superintendent agree that this Contract is for employment for a limited term, that this Contract is not a continuing contract, and that there is no express or implied agreement by the Board for employment ofthe Superintendent beyond the term set forth i this Contract. Further, the Board may by specific action and with the consent of the Superintendent, extend the termination date of the existing contract to the extent permitted by State law, Extension or renewal ofthe centract shall only be undertaken by resolution ofthe Board pursuant to N.C. Gen, Stat 115C-271 2, PROFESSIONAL RESPONSIBILITIES OF SUPERINTENDENT. The Superintendent shall have charge ofthe administraton of the Boar's schools under the dcection of the Board. He shall be the chief execusive offcer of the Boards shall serve as secretary tothe Board; shall direct and asign teachers and other employees: of the schools under his supervision; shall have freedom to organize, reorganize and. arrange the administrative and supervisory staff, including instruction and. business firs, as best serves the Edenton-Chowan School System, subject tothe approval of the Board; shall select all personnel subject to the approval of the Board; shall have the authority to immediately accept resignations of personnel, for and on behalf ofthe Board, shall from time to time suggest regulations, rules and procedures deemed necessary for ‘the orderly administration of the schoo! district; and in general erform all duties incident {0 the office of the Superintendent and such other duties as may be prescribed by law, including but not limited to the provisions of N.C. Gen, Stat, 1.5C-276, or by the Board from cime to time. The Board, individually and collectively, promptly shall refer criticisms, complaint, and suggestions called to its attention 1 the Superintendent for appropriate study, recommendation, and response and shall reffain from individval interference with the administration of school policies except through Board action. The Superintendent shall have the right co attend all Board meetings and all Board and citizen ‘meetings, serve as an ex-officio member of all Board committees and provide administrative recommendations on each item of business considered by each of these ‘groups, except when the Superintendents performance, evaluation, contract oF Telationship with the Board are being discussed and considered by the Board in closed ‘The Superintendent shall have the authority to select atomeys to work with the School district on any specialized matters in which the superintendent considers it inthe best interest ofthe System, including special education-related issues, personnel, and any investigations. In any matter which involves the Superintendent in hearings ot presentation of evidence to the Board on behalf ofthe administration ofthe System and {inhis official capacity, the Board shall be represented by such attomey as the Board shell select and the Superintendent may select appropriate separate legal representation at the System's expense, This is an agreement for the performance of professional seivices as superintendent by the Superintendent, who shall not be assigned to any other position or hhave his duties reassigned to others without his consent. 3. COMPENSATION. ‘The annual salary forthe Superintendent for each year ofemployment pursuant to this Contract shall be One Hundred Twenty-Six Thousand Dollars ($126,000.00) per ‘year to be paid in twelve equal monthly payments. The salary paid hereunder shall be Tetronctive to and paid from the 1" day of July, 2015, The salary to be paid the ‘Superintendent shall be paid from a combination of state and local funds. In addition to his annual salary provided herein, the Superintendent shall be entitled to receive any ‘additional supplement or pay provided by the State for which he qualifies for advanced degrees, longevity or otherwise. 4. VACATION AND OTHER BENEFITS, ‘The Superintendent stall receive annual leave and sick leave and other benefits ‘generally provided to other twelve (12) month employees urder state law and North Carolina State Board of Education regulations. Annual leave and sick leave shall be ‘ken in accordance with Board policy and State Board of Education regulations. Except as otherwise provided in this section, annual and sick leave tray be carried forward as provided by law and Board policy, and payment for any accrued and unused annual leave at the termination of this Contract shall be made in accordance with State Board of Educaion regulations and Board policy. The Superintendent shall receive the same disability, life and health_insurance coverage, terminal pay, and other personal benefits generally arovided to other twelve ‘month (12) employees under state aw and Notth Carolina State Board of Education regulations. ‘The Superintendent should be a member of
