AnActtoprovideforallocationofcoalminesandvestingoftheright,titleand
interestinandoverthelandandmineinfrastructuretogetherwithminingleases
to successful bidders and allottees with aview to ensurecontinuity in coal
mining operations and production of coal, and for promoting optimum
utilisationofcoalresourcesconsistentwiththerequirementofthecountryin
nationalinterestandformattersconnectedtherewithorincidentalthereto.
WHEREAStheSupremeCourtvidejudgmentdated25thAugust,2014readwithits
orderdated24thSeptember,2014hascancelledtheallocationofcoalblocksandissued
directionswithregardtosuchcoalblocksandtheCentralGovernmentinpursuanceof
thesaiddirectionshastotakeimmediateactiontoimplementthesaidorder;
ANDWHEREASitisexpedientinpublicinterestfortheCentralGovernmenttotake
immediateactiontoallocatecoalminestosuccessfulbiddersandallotteeskeepingin
viewtheenergysecurityofthecountryandtominimiseanyimpactoncoresectorssuch
assteel,cementandpowerutilities,whicharevitalforthedevelopmentofthenation;

3. (1) In this Act, unless the context otherwise


requires,

(1) additional levy means, the additional


levy as determined by the Supreme Court in Writ
Petition(Criminal)No.120of2012astwohundred
and ninetyfive rupees per metric tonne of coal
extracted;
(2) allotment order means the allotment
orderissuedundersection5;

(3) appointeddateinrelationto
(1)
ScheduleIcoalminesexcluding
ScheduleIIcoalmines,shallbethe24thdayof
September,2014beingthedateonwhichthe
allocation of coal blocks to prior allottees
stoodcancelled;and
(2)

Schedule II coal mines shall be

(7) corporation shall have the same
meaningasassignedtoitinclause(11)ofsection2
oftheCompaniesAct,2013;
(8) financialinstitutionshallhavethesame
meaningasassignedtoitinclause(m)ofsection2
oftheSecuritisationandReconstructionofFinancial
Assets and Enforcement of Security Interest Act,
2002;
(9) Government company shall have the
same meaning as assigned to it in clause (45) of
section2oftheCompaniesAct,2013;

2014 including those allotments which
mayhavebeendeallocatedpriortoand
duringthependencyoftheWritPetition
(Criminal)No.120of2012.
Explanation.In case a mining
lease has been executed in favour of a
thirdparty,subsequenttosuchallocation
ofScheduledIcoalmines,then,thethird
party shall be deemed to be the prior
allottee;

means,

(1) all the coal mines and

was cancelled by the judgment
dated 25th August, 2014 and its
order dated 24th September, 2014

deallocatedpriortoandduringthe
pendencyofthesaidWritPetition;
(2) all the coal bearing land
acquired by the prior allottee and
lands, in or adjacent to the coal
mines used for coal mining
operations acquired by the prior
allottee;

(3) any existing mine

public interest, by notification, modify
ScheduleIIIcoalminesbyaddinganyother
Schedule I coal mine for the purposes of
specifiedenduse.
8. (1) The nominated authority shall
notifythepriorallotteesofScheduleIcoal
mines toenablethemtofurnishinformation
required for notifying the particulars of
Schedule I coal mines to be auctioned in
accordance with such rules as may be
prescribed.

(2) The information required to be


furnished under subsection (1) shall be
furnished within a period of fifteen days
fromthedateofsuchnotice.
(3)Asuccessful bidder inan auction
conducted on a competitive basis in
accordance with such rules as may be
prescribed,shallbeentitledtothevestingof
Schedule I coal mine for which it bid,
pursuant to a vesting order drawn up in
accordancewithsuchrules.

successful bidder of the Schedule I coal mine shall be
granted a prospecting licence or a mining lease, as
applicable, by the concerned State Government in
accordancewiththeMinesandMinerals(Developmentand
Regulation)Act,1957.

venturecompanyformedbysuchcompanyorcorporation

11. (1) Notwithstanding anything
containedinanyotherlawforthetimebeing
inforce,asuccessfulbidderorallottee,asthe
case may be, in respect of Schedule I coal
mines,mayelect,toadoptandcontinuesuch
contractswhichmaybeexistingwithanyof
the prior allottees in relation to coal mining
operations and the same shall constitute a
novation for the residual term or residual
performanceofsuchcontract:
Provided that in such an event, the
successful bidder or allottee or the prior
allotteeshallnotifythenominatedauthorityto
includethevestingofanycontractsadoptedby
thesuccessfulbidder.
(2)Intheeventthatasuccessfulbidderor
allottee elects not to adopt or continue with
existingcontractswhichhadbeenenteredintoby
thepriorallotteeswiththirdparties,inthatcase
allsuchcontractswhichhavenotbeenadoptedor
continued shall cease to be enforceable against
thesuccessfulbidderorallotteeinrelationtothe
Schedule I coal mine and the remedy of such

CHAPTER
IV
POWERSOFTHECENTRALGOVERNMENT
AFTERTHEAPPOINTEDDATE

17. (1) On and from the


appointed date, the Central
Governmentoracompanyowned by
the Central Government shall be
deemedtohavebecomethelesseeor
licensee of the State Government in
relation to each of the Schedule II
coal mines, in respect of which a
mining lease or prospecting licence
hasbeengrantedpriortothedateof
commencement of this Act, as if a
miningleaseorprospectinglicencein
relation to such coal mine had been
grantedtotheCentralGovernmentor
a company owned by the Central
Government and the period of such
leaseorlicenceshallbethemaximum
periodforwhichsuchleaseorlicence
couldhavebeengrantedbytheState
Government under the Mineral
Concession Rules, 1960, and
thereupon all the rights under such
mining lease, including surface,
undergroundandotherrightsshallbe
deemed to have been transferred to,
and vested in, the Central
Governmentoracompanyownedby
theCentralGovernment.

(2)Ontheexpiryoftheterm

ofanyleaseorlicence,referredtoinsub
section (1), such lease or licence shall be
renewed, by the State Government, in
consultation with the Central Government
for the maximum period for which such
leaseorlicencecanberenewedunderthe

date to provide the requisite
manpower,asmaybenecessary,to
ensure continuity in coal mining
operationsandproductionofcoal.

(7) The designated custodian shall
haverights,liabilitiesandobligationsasa
prior allottee or a successful bidder in
respectofcoalminesentrustedtoitunder
section18,tobeexercisedanddischarged
insuchmannerasmaybeprescribed.
(8) The designated custodian shall
have the power to perform such other
functionswhichmaybeconsequential or
incidentaltothefunctionsspecifiedunder
thissection.
(9) Notwithstanding anything
contained in any other law for the time
being in force, the designated custodian
shall, in exercise of its powers or the
performance of its functions under this
Act, be bound by such directions on
questions of policy, as the Central
Governmentmaygiveinwritingtoitfrom
timetotime.

Onandfromthedateof
commencement of this Act, the Coal
Mines(Nationalisation)Act,1973andthe
Mines and Minerals (Development and
Regulation) Act, 1957 shall stand
amended in the manner provided in
ScheduleIV.

31.
(1) The Central
Government may, by notification in the
Official Gazette, and subject to the
condition of previous publication, make
rulesforcarryingouttheprovisionsofthis
Act.

whileitisinsession,foratotalperiodofthirtydayswhichmaybecomprisedinonesession
orintwoormoresuccessivesessions,andif,beforetheexpiryofthesessionimmediately
followingthesessionorthesuccessivesessionsaforesaid,bothHousesagreeinmaking
anymodificationintheruleornotification,orbothHousesagreethattheruleornotification
shouldnotbemade,theruleornotificationshallthereafterhaveeffectonlyinsuchmodified
formorbeofnoeffect,asthecasemaybe;so,however,thatanysuchmodificationor
annulmentshallbewithoutprejudicetothevalidityofanythingpreviouslydoneunderthat
ruleornotification.
32.(1)IfanydifficultyarisesingivingeffecttotheprovisionsofthisAct,theCentral
Governmentmay,byorderpublishedintheOfficialGazette,makesuchprovisions,not
inconsistentwiththeprovisionsofthisAct,asappeartoittobenecessaryorexpedientfor
removingthedifficulty:
Providedthatnosuchordershallbemadeaftertheexpiryofaperiodoftwoyearsfrom
thedateofcommencementofthisAct.
(2)Everyordermadeunderthissectionshall,assoonasmaybeafteritismade,belaid
beforeeachHouseofParliament.
33.(1)TheCoalMines(SpecialProvisions)SecondOrdinance,2014isherebyrepealed.
(2)Notwithstandingsuchrepeal,anythingdoneoranyactiontakenunderthesaid
Ordinance,shall,withoutprejudicetothejudgmentoftheSupremeCourtdated25thAugust,
2014anditsorderdated24thSeptember,2014passedinWritPetition(Criminal)
No.120of2012,bedeemedtohavebeendoneortakenunderthecorrespondingprovisions
ofthisAct.

1. IntheCoalMines(Nationalisation)Act,1973(hereinreferredtoastheprincipal
Act),insubsection(1)ofsection1A,afterthewordandfigure"section3",theword,
figureandletter",section3A"shallbeinserted.

After section 3 of the principal Act, the following section shall be inserted,
namely:

companies,
may carry on coal mining operations in India, in any form either for own
consumption,saleorforanyotherpurposeinaccordancewiththeprospecting
licenceormininglease,asthecasemaybe.
(2)TheCentralGovernmentmay,withaviewtorationalisesuchcoalmines
soastoensurethecoordinatedandscientificdevelopmentandutilisationofcoal
resourcesconsistentwiththegrowingrequirementsofthecountry,fromtimetotime,
prescribe
(i)thecoalminesorcoalbearingareasandtheirlocation;
(ii)theminimumsizeofthecoalmineorcoalbearingareas;
(iii)suchotherconditions,
whichintheopinionofthatGovernmentmaybenecessaryforthepurposeof
coalminingoperationsorminingforsalebyacompany.
Explanation.Forthepurposesofthissection,"company"meansacompanyas18of
2013.definedinclause(20)ofsection2oftheCompaniesAct,2013.'.

Amendmentof
section34.

3.Insection34oftheprincipalAct,insubsection(2),afterclause(a),thefollowing
clauseshallbeinserted,namely:
"(aa)thecoalminesorcoalbearingareasandtheirlocation,theminimumsize
of the coal mine orcoal bearing areas,and such otherconditionswhich maybe
necessaryforthepurposeofcoalminingoperationsincludingminingforsalebya
companyundersubsection(2)ofsection3A.".

licenceorminingleaseinrespectofanyareacontainingcoalorlignitetosuchcompany
asselectedthroughauctionbycompetitivebiddingorotherwiseunderthissection:
Providedthattheauctionbycompetitivebiddingunderthissectionshallnotbe
applicabletoanareacontainingcoalorlignite
(a)wheresuchareaisconsideredforallocationtoaGovernmentcompany
orcorporationorajointventurecompanyformedbysuchcompanyorcorporation
orbetweentheCentralGovernmentortheStateGovernment,asthecasemay
be;
(b)wheresuchareaisconsideredforallocationtoacompanyorcorporation
orthathasbeenawardedapowerprojectonthebasisofcompetitivebidsfor
tariff(includingUltraMegaPowerProjects).
Explanation.Forthepurposesofthissection,"company"meansacompany
asdefinedinclause(20)ofsection2oftheCompaniesAct,2013.'.
