isnotmovingtofilerapsagainstdeLima.

Afterthecongressionalhearing,despitethemanywitnessesagainst(deLima)includingthe
two[NationalBureauofInvestigation]officers,officialssayingthatintwoinstances,Secretary
deLimaandRonnieDayan,deLimasformerdriverlover,wereintheirhouseinParaaque
whentheyreceivedP5millioneach.ButtotheOmbudsman,thisisnotsufficient,Aguirre
toldreportersinaPalacebriefing.

Theseareaccusationsalthoughtestimonialevidenceonly.Butwhetheritistestimonial
evidence,thesearestillpiecesofevidenceagainstsomebodyforbeingchargedwiththe
violationoftheDangerousDrugsAct,hestressed.

Idontknowwhatswrongandwhysheisignoringit.MaybeitistheOmbudsmanherself
whocouldexplainherstand.

Amonthback,MoralessaidthatrapsagainstdeLimawillnotprospersayingthatitsnot
goingtohappen.

Moreover,Aguirresaidthattheyarecapitalizingonthesharedmandateforboththe
DepartmentofJusticeandtheOmbudsmantoprobedeLimasallegedinvolvementinthe
narcoticstrade.

DespitetheresistancefromtheOmbudsmantoinvestigateSecretaryorSenatordeLima,
wehaveconcurrentjurisdiction,theJusticeSecretarynoted.

Casescouldbeinvestigatedorcouldbeheardinpreliminaryinvestigationbythe
OmbudsmanandbytheDepartmentofJusticeatthesametime.Thatswhyweare
conducting,wearecontinuingourpreliminaryinvestigationinconnectionwiththesecharges,
hesaid.

PresidentDuterteandJusticeSecretaryAguirreareaccusingDeLimaofbeingacoddlerof
narcoticssyndicatesduringherstintintheDoJ.Hersenatorialbidwasallegedlygreasedby
druglords.

ThematterstemmedfromdeLimastextmessagetoherformerdriverbodyguardturned
loverandallegedbagman,RonnieDayan,tellinghimnottoheedthesubpoenaissuedbythe
Housecommitteeonjusticecompellinghisappearanceandorderinghimtotestifyonthe
chargesthatthesenatorhad,asalleged,receiveddrugmoneyfromhighprofileinmatesand
evendruglordstoformpartofhercampaignwarchestinthelastsenatorialrace.

AndunlikethetwootherpendingcomplaintsdeLimafacesbeforethepanelchairedby
MajorityLeaderVicenteSottoIII,itislikelythatthecommitteethathandlesallmatters
concerningtheconduct,rights,privileges,safety,dignity,integrityandreputationofthe
Senateanditsmembers,willproceedinundertakingafullblowninvestigation.

Thisearly,somesenatorshavealreadynotedthispossibilityastheissueonitsface,
indicatesthatthepanelhasjurisdictiontotakeupthecomplaintwhereinpublicorclosed
doorproceedings.

Thereisnoissueofjurisdictionhere.ItisclearthatthechargeagainstSenatordeLima
surfacedasasittingsenator,Sottosaid.

ItisabouttheunethicalconductofSenatordeLimainviolatingtheruleoflaw,violatingthe
rulesofCongressandviolatingheroathasapublicofficerinviolationofArticle11ofthe
publicofficeonpublictrust.Wewillleaveittothesoundjudgmentofthesenators,theethics
committeeandtheSenateatlarge,HousecommitteeonjusticechairandOrientalMindoro
Rep.ReynaldoUmalisaid.

Umali,whenaskedbyreporters,immediatelyafterhandingoverthecongressionalcomplaint
beforeSotto,iftheywouldbeamenableinmeetinghalfwaywithdeLimatoresolvetheissue,
UmalirepliedthatitisdeLimawhodidnotrecognizetheHouseinquiry.Whythenwillhaveto
compromise?heresponded.

PendingbeforethecommitteearetwocomplaintsfiledseparatelybyalawyerAbelardode
JesusandacertainRonilloPulamanowhoclaimstobeabiomedicaltech/germresearch
specialistinAlHammdiHspitalRiyadh,KingdomofSaudiArabia(KSA),whobothaccused
deLimaofsupposedlyreceivingtaintedmoneywhileshewasstillsecretaryofthe
DepartmentofJustice(DoJ)andvyingforaSenateseat.

Theseissues,consideringthatitconcernsactswhiledeLimawasstillnotyetamemberof
theSenate,isseentobeeventuallydismissedforlackofjurisdictionofthecommittee.

Wewilllikelysettleit(theseissues)soonbutIcannotsaythesamedirectlythatwewill
dismissitbecauseoneoftheoriginalcomplainanthasasecondsupplemental(affidavit
complaint)relatedtotheissuelodgedbythelowerhouse,Sottosaid.

ThesenatorwasreferringtothesupplementalaffidavitsubmittedbydeJesuscitingalleged
violationofArticle150oftheRevisedPenalCodecommittedbydeLimainvolving
disobediencetosummons.

Sen.PanfiloLacson,whenaskedontheprospectofhercasebeingsubjectedtoaprobeby
thesaidcommittee,saiditwilldependontheevidencepresentedtothembymembersofthe
HouseofRepresentatives.

ButIcanseenowthereisjurisdiction.TheoffensewasallegedlycommittedwhiledeLima
wasalreadyanincumbent.ThiswaswhatshehadinducedoradvisedRonnieDayannotto
attendthehearingandhideinstead.Clearlythereisjurisdiction.Thisnowalldependsonthe
evidenceandtheprobebyethicscommitteewhatpenaltyistobeimposed.Woulditbe
expulsionoradmonition?Itrangesfromalowofadmonitiontoahighofexpulsion,Lacson
said.

AstotheclaimsmadebydeLimaadmittingthatshedidsendDayanatextmessagebut
merelyadvisedhimnottoattendthelowerhouseproceedings,Lacsonpointedoutthat
whetherthelatterwasadvisedorcoercedtosnubthehearing,doesntmatterasthereisan
existinglawrelatedtothiskindofact.

Sotto,whenaskedabouttheprobabilityofdeLimascaseeventuallyendingupbeingtackled
bytheSenateconveningasaCommitteeoftheWholeortheentirebody,saidhecannot
makeanypredictionsatthispoint.

SottoindicatedthattherewillbenorushindeliberatingtheissuesagainstdeLimawhois
currentlyoutofthecountry,unlesshissevenpanelmemberspushestheconductofthe
proceedingsassoonaspossible.

IhavetoreviewitfirstandthenIwillgivecopiesofthecomplainttotheothermembers,then
IwillmakearecommendationonwhattodoafterIhavereviewedit,hesaid.

Tocallforahearing,eveniftheresarecommendationtoproceedwiththeprobe,willhaveto
waitwhentheSenateresumesitsregularsessionsinJanuaryasdeLimaisexpectedtohave
preparedheranswerstotheaccusationsbeingthrownather,theupperchamberleadersaid.
