Kobis is charged with the murder of his wife, Kang Kong. He is alleged to have committed the murder on 1 April 2015 by shooting her with a Smith & Wesson semi automatic pistol, in their matrimonial home at Bukit Beruang. There are no eye witnesses to the alleged murder. Consider the burden and standard of proof on all parties in the following situations: a. Kobis admits to causing the death of Kang Kong, but asserts that he did so in defending himself when Kang Kong had attacked him with a knife during a quarrel; b. Kobis denies murdering Kang Kong and in fact claims that at the material time he was in Bali, Indonesia. Kang Kong was killed in Bukit Beruang, Melaka; c. Kobis faces another charge of possession of a pistol without law full authority; d. Kobis pleads not guilty but does not raise any specific defence. His counsel instead attacks the case for the prosecution.
