Adoption
The procedure of adoption is a procedure of taking under care of
children, who for different reasons are not under the care of their
parents, in order to provide children with a family. Courts are
competent for allowing the adoption of a child.
The child adoption is allowed if it serves the welfare of children and if
it is expected that between the adopting parent and the child a
parent-child relationship will be created.
Only the adoption of minor children is permissible.
The child adoption can be done by:
Spouses with mutual consent with the exception of extraordinary
cases. At least one of the spouses must be at least 25 years of
age whereas the other spouse can be 21 years of age.
The unmarried persons only if they are at least 21 years of age.
In case the child is older than 14 years the consent of the child is
required.
After the adoption the period of first three months is considered as
probation period during which the court will oversee and assess the
custodianship.
Persons who are not citizens of Kosovo must meet special conditions
for adoption that are determined by law.
