AFFIDAVIT OF UNDERTAKING
I, JASON O. CANOY, of legal age, Filipino Citizen, and a resident of Lutac
City of Naga City Cebu after having been sworn to in accordance with law hereby
depose and states:
1. That I am the one who managed / supervised the vehicles particularly this two ten
wheelers dump trucks bearing plate number RMV -341 and the other one with
temporary plate no. 130105 owned by Aldene M. Basera which are used in the
business of sand and gravel hauling;
2. That personnel from the office of the PENRO Cebu Province conducted a
checkpoint in the highway road of Naga City Cebu wherein the aforesaid vehicles
were impounded due to violations of the PENRO regulations and were brought to the
impounding area located at Tina-an Naga City Cebu;
3. That in order not to jeopardize our business operations considering that the
aforesaid vehicles are the backbone of our business of sand and gravel hauling, I was
tempted to surreptitiously take away ( speed away) the aforesaid vehicles from the
impounding area without the consent and permission and without being cleared for the
violation of the PENRO regulations;
5. That I successfully took away the aforesaid vehicles from the impounding area and
brought it back home and used them again in our business operations;
6. That when I went to the office of the PENRO of Cebu Province in order to pay and
settled for the violations, said office added another violation for ( SPEED AWAY ) due
to my act of taking the said vehicles in the impounding area without permission and
settling first the PENRO violations and requiring me to make an undertaking not to
commit the same offense again;
7. That I undertake not to do the same offense of (SPEEDING AWAY) in the future if
our vehicles be impounded for violations again and I understand that doing same
offense will subject me to a harsher penalty that the PENRO office will imposed on
me.
