Guanzon J Xxx xxx Xxx yO san THE MATTER OF THE ADDENDUM TO COMELEC RESOLUTION NO. 10035, ENTITLED: “GENERAL INSTRUCTIONS FOR THE SPECIAL BOARD OF ELECTION INSPECTORS AND SPECIAL BALLOT RECEPTION AND CUSTODY GROUP IN THE CONDUCT OF MANUAL VOTING AND COUNTING OF VOTES UNDER REPUBLIC ACT NO. 9189, OTHERWISE KNOWN AS “THE OVERSEAS ABSENTEE VOTING ACT OF 2003” AS AMENDED BY REPUBLIC ACT NO. 10590 FOR PURPOSES OF THE MAY 9, 2016 NATIONAL AND LOCAL ELECTIONS” WHEREAS, COMELEC Resolution No. 10035 was promulgated on January 13, 2016, entitled: “GENERAL INSTRUCTIONS FOR THE SPECIAL BOARD OF ELECTION INSPECTORS AND SPECIAL BALLOT RECEPTION AND CUSTODY GROUP IN THE CONDUCT OF MANUAL VOTING AND COUNTING OF VOTES UNDER REPUBLIC ACT NO. 9189, OTHERWISE KNOWN AS “THE OVERSEAS ABSENTEE VOTING ACT OF 2003” AS AMENDED BY REPUBLIC ACT NO. 10590 FOR PURPOSES OF THE MAY 9, 2016 NATIONAL AND LOCAL ELECTIONS” WHEREAS, there is a need for an addendum to COMELEC Resolution No. 10035, which reads: “Sec. 38 Manner of Obtaining Ballots — 3. Before issuing the official ballot, the Chairperson shall » Read the serial number of the ballot; Enter in OAVF No. 2 opposite the name of the voter, the serial number of the ballot and affix his/her signature in the space provided for the purpose; c. Authenticate the ballot by affixing his/her signature at the back of the ballot. Failure to authenticate shall constitute an election offense; c d. Require the voter to affix his/her signature opposite his/her name in OAVF No. 2; and e. Fold the ballot in such a manner that its contents are hidden and only the portion where the setial number of the ballot coupon appears and, give the same to the voter,Pago 2 MF No, 16- 0138 Sec. 39. Manner of Voting. - Voting shall be conducted in the following manner: 1, The voter shall, using a ballot secrecy folder, fill the ballot by writing the names of the candidates and the name, acronym or raffle number of the party list of his choice; 2. After accomplishing his/her ballot, the voter shall fold the ballot in the same manner as when he/she received it, and exhibit the ballot coupon to the Member-Secrefary of the SBEI who shall, within the view of the voter and the Chairperson and without seeing its contents, verify its serial number against the number previously entered in OAVF No. 2 If the serial number of the ballot coupon is not the same as that previously issued, or the ballot coupon has been detached from the ballot not in the presence of any member of the SBE! or the ballot is accidentally defaced by the voter in a such a way that it cannot be lawfully used, the Chairperson shall write the word “spoiled” diagonally across the face of the ballot, affix his/her signature thereon. Such fact shall be noted in the OAVF No. 11 and recorded Opposite the name of the voter in the OAV Form 2. Thereafter, the spoiled ballot shall be placed inside the compartment for spoiled ballots. The voter shall not be issued another ballot. 3. If the serial number of the ballot exhibited by the voter is the same as that previously issued to hin/her, the voter shall, in the presence of the Chairperson of the SBEI, affix his/her right thumbmark in the corresponding space in the ballot coupon and opposite his/her name in OAVE No. 2. 4. The Member-Secretary shall then, in the presence of the voter and the Chairperson, detach the ballot coupon, deposi it in the ballot box compartment for spoiled ballot. 5. The voter shall then deposit it inside the ballot box compartment for valid ballots. 6. The voter shall after having cast his/her vote shall immediately depart.” NOW THEREFORE, the Commission RESOLVED, as it hereby RESOLVES, to approve the foregoing addendum to COMELEC Resolution No. 10035 in connection with the May 9, 2016 National and Local Elections The Education and Information Department is hereby directed to cause the Publication of this Resolution in two (2) daily newspapers of general circulation in the Philippines and to furnish the Department of Foreign Affairs, Department of otPage 3 MR No. 160138 Labor and Employment, Department of Transportation and Communications, Philippine Postal Corporation, Philippine Overseas Employment Administration, Overseas Worker's Welfare Administration, Commission on Overseas Filipinos, the Foreign Service Institute, the Social Security System and other government agencies concerned with the welfare of Filipinos overseas.
