BINAY” IN CONNECTION TO THE MAY 9 2016 NATIONAL, LOCAL AND ARMM ELECTIONS, ee Promulgated: RESOLUTION NO. dh WHEREAS, Section 31 of Republic Act No. 8189 known as “The Voter’s Registration Act of 1996” on the Sealing of Precinct Book of Voters provides that: The Board shall notify within fifteen (15) days before the start of the campaign period of all registered political parties and members of the Board of Election Inspectors to inspect and verify the completeness of the voter's registration records for each precinct compiled in the book of voters. After verification and certification by the Board of Election Inspectors and party representatives as to the completeness of the voters’ registration records in the precinct book of voters, the Board shall seal the book of voters in the presence of the former at the start of the campaign period and take custody of the same until their distribution to the Board of Election Inspectors on election day. The Election Officer shall deliver the sealed precinct book of voters to the chairman of the Board of Election Inspectors when the latter secures its official ballots and other paraphernalia for election day.page 2 Reso 10076 WHEREAS, as early as September 22, 2010, the Commission En Banc in Minute Resolution No. 10-0940 resolved to adopt a policy wherein in case the Book of Voters are in the custody of the courts, House of Representative Electoral Tribunal, Senate Electoral Tribunal and Presidential Electoral Tribunal a request shall be made to the concerned tribunal/court for the retrieval of the Book of Voters to be used for the October 25, 2010 Barangay Elections. And in the event that the Book of Voters could not be returned even after earnest efforts, the presence of the Book of Voters on Election Day shall be dispensed with; WHEREAS, in Resolution No. 9046 dated on September 30, 2010, the Commission En Banc resolved to preserve the Book of Voters and other Election Documents used in the May 10, 2010 National and Local Elections relative to the Precautionary Protection Order (PPO) dated August 31, 2010 issued by the Presidential Electoral Tribunal (PET) Case No. 004 entitled “Manuel A. Roxas vs. Jejomar C. Binay”; WHEREAS, in Resolution No. 9630 dated January 31, 2013, the Commission En Banc resolved to dispense with the inspection, verification and sealing of the Book of Voters for purposes of the May 13, 2013 National, Local and ARMM Elections in observance of the foregoing PET Case No. 004; WHEREAS, in the Calendar of Activities for the May 9, 2016 National, Local and ARMM Elections, the inspection, verification and sealing of the precinct Book of Voters pursuant to Section 31 of Republic Act No, 8189 is scheduled from March 25, 2016 (Friday) to April 09, 2016 (Saturday); WHEREAS, the aforementioned Case No. 004 before the PET is still pending and the Precautionary Protection Order is still effective;page 3 Reso 10076 NOW THEREFORE, the Commission on Elections, by virtue of the power vested in it by the Constitution, the Omnibus Election Code, and other election laws, has RESOLVED, as it hereby RESOLVES, to DISPENSE with the inspection, verification and sealing of the Book of Voters for purposes of the May 9, 2016 National, Local and ARMM Elections in observance of the PPO dated August 31, 2010 issued by the PET, Let the Deputy Executive Director for Operations implement this Resolution.
