Section 3. (i) Right to control refers to the right reserved to the person for whom the
services of the contractual workers are performed, to determine not only the end to be
achieved, but also the manner and means to be used in reaching that end.

This sections were related to the internet services given by the network
providers, stated by DOLE that developing internet-based monitoring system and
datebase. It is necessary to become advance in technology in order to make their
job easy. It is for the communication purposes around the world, for emergency
purposes.
Justification:
As noted above from previous statutory constructions, it must have
internet protocols and allocations for the frequency for voice over internet or for
telecommunications servives. This two numbers in section 4 includes network
providers telecommunications services must be used for transportation and
communication purposes and necessary for economic recovery.
Justification:
This is a direct construction and amendment of the NTC memorandum
circular 04-06-2007 Sec.3 for allowing the complainant to see his access to the
records upon a formal written request and only in connection with a complaint file
and pending with the NTC. The records shall not be made available to any other
person or party without a court order or a written consent from the subscriber
concerned.
9.5. Constitution of the Philippines
The 1987 Constitution of the Republic of the Philippines
Article II, Section 24. The State recognizes the vital role of communication and
information in nation-building.
Article XVI, Section 10. The State shall provide the policy environment for the full
development of Filipino capability and the emergence of communication structures
suitable to the needs and aspirations of the nation and the balanced flow of information
into, out of, and across the country, in accordance with a policy that respects the
freedom of speech and of the press.
Article XVI, Section 11(2). The advertising industry is impressed with public interest,
and shall be regulated by law for the protection of consumers and the promotion of the
general welfare.
Justification:
Taken as a whole, all the aforementioned laws, rules, and regulations are
of non-existence when the Philippine Constitution does not support them. Indeed,
it is difficult to imagine a national development process without communication
playing an essential part, as stated in Article II, Section 24. The Philippines is a
country with diverse society which leads to having a complex set of socio-
economic and cultural stratifications. The great division between societies can be
bridged by an effective means of communication and information sharing.
Through communication a shared vision will be nurtured thus as an ECE student
we are to be a nation builder in the future.
