Deed of Absolute Sale

KNOW ALL MEN BY THESE PRESENTS

This DEED OF ABSOLUTE SALE entered into by and between

SPOUSES ARMANDO D. CARUSO and DOLORES B. CARUSO,


both of legal age, Filipinos, and No. 7B Felipe St., Frisco, Quezon City,
Philippines, represented by their Attorney-in-Fact JOHNIE V. MAGNA, of
legal age, married, Filipino citizen, and a resident of No. 15 North Santo
Tomas Road, Baguio City, Philippines, hereinafter referred to as the
VENDOR; and,

SPOUSES JOSE NATIVIDAD and ROSALINDA NATIVIDAD, both


of legal age, Filipinos, and with address at JC 077 Barangay Buyagan, La
Trinidad, Benguet, Philippines, hereinafter called the VENDEE.

WITNESSETH

WHEREAS, the VENDOR is the true and lawful owner of a parcels of


registered land located in Baguio City, Philippines and more particularly
described as follows

TRANSFER CERTIFICATE OF TITLE NO. T-70643

A parcel of land (Lot 6- E-6-A, Psd-CAR-00550), being


a portion of Lot 6-E-6, Psd-1-06531, Free Patent No.
1441 (ct No.926), situated at Barangay Bakakeng,
City of Baguio, Island of Luzon. Bounded on the NW.,
along lines 1-2-3-4 by Creek (5-6 m. wide); on the
NE., along line 4-5 by Lot 6-E-7, Psd-1-06531; on the
SE., along lines 5-6-7-8 by Lot 6-E-6-B, Psd-CAR-
000530; on the SW., along line 8-1 by Lot 1, (LRC)
Psd-73793. Beginning at a point marked 1 on plan
being S. 13 deg., 05W., 1,257.97 m. from
Triangulation station Wright, Baguio Townsite;
thence N. 26 deg., 03E., 4.00 m. to point 2; thence
N. 26 deg., 03E., 18.26 m. to point 3; thence N. 26
deg., 03E., 2.00 m. to point 4; thence S. 72 deg.,
35E., 14.20 m. to point 5; thence S. 26 deg., 21W.,
2.00 m. to point 6; thence S. 26 deg., 21W., 21.02
m. to point 7; thence S. 26 deg., 19W., 3.99 m. to
point 8; thence N. 61 deg., 22W., 13.91 m. to point
of beginning, containing an area of THREE HUNDRED
FIFTY EIGHT [358] SQUARE METERS, more or less. All
points referred to are indicated on the plan and are
marked on the ground as follows: Points 1 and 4 by
P.S. cyl. conc. mons. 15x60 cms., All the rest by P.S.
cyl. conc. mons. 15x40 cms. Bearing true, Date of
Original Survey on Jan. 12-16, 1914; Date of
Subdivision Survey on August 10, 1990, executed by

Engr. John P. Cutiyog and was approved on January
24, 1990.

WHEREAS, pursuant to a survey duly approved by the Land


Management Service [LMS] of the Department of Environment and
Natural Resources of Cordillera Administrative Region [DENR-CAR] the
above-described property with improvements covered by Transfer
Certificate of Title No. T-70643 of the Registry of Deeds of Baguio City,
Philippines was partitioned into two lots designated as Lot 6-E-6-A-1 and
Lot 6-E-6-A-2 respectively, under Psd CAR-022538, with the technical
description of each lot set forth hereunder

A parcel of land (Lot 6-E-6-A-1, Psd-CAR-


022538) being a portion of Lot 6-E-6-A, Psd-CAR-
000530; situated at Rurban code 131102, Barangay
of Bakakeng Norte, City of Baguio, Island of Luzon.
Bounded on the NW., along lines 1-2-3 by Creek (5-6
m. wide); on the NE., along line 3-4 by legal
easement (3.00 m. wide) portion of Lot 6-E-6A-2;
along line 4-5 by Lot 6-E-6A-2 both of the subd. plan;
on the SE., along line 5-6 by Lot 6-E-6-B, Psd-CAR-
000530; along line 6-7 by Road Right of Way (4.00 m.
wide) portion of Lot 6-E-6-b, Psd-CAR-000530; on the
SW., along line 7-8-1 by Lot 1, (LRC) Psd-73793.
Beginning at a point marked 1 on plan being S. 13
deg. 05 min. W., 1257.97 meters from Triangulation

Containing an area of ONE HUNDRED EIGHTY SIX
[186] SQUARE METERS, more or less. All points
referred to are marked on the ground by PS. cyl.
conc. mons. 15 x 50 cms., except cor. 1,6&7 by Old
PS. cyl. conc. mons. 15 x 40 cms. Bearing true; Date
of original survey on 1/12-16/14; date of subd.
survey on March 3, 2014; executed by Engr. Primo S.
Menzi was approved on May 6, 2014.

WHEREAS, it has been agreed upon that in accordance with the


terms and conditions stipulated herein, the VENDEE shall purchase from
the VENDOR that subdivided parcel of land with an area of ONE
HUNDRED EIGHTY SIX [186] SQUARE METERS currently covered by
Transfer Certificate of Title No. T-70643 of the Registry of Deeds of Baguio.

NOW THEREFORE, for and consideration of the sum of THREE


HUNDRED EIGHTY THOUSAND PESOS [ 380,000.00] the VENDOR
hereby SELLS, TRANSFERS, CEDES, RELINQUISHES and CONVEYS in

a manner ABSOLUTE the above-described subdivided parcel of land with
an area of ONE HUNDRED EIGHTY SIX [186] SQUARE METERS
covered by Transfer Certificate of Title No. T-70643 of the Registry of
Deeds of Baguio City, Philippines unto and in favour of the VENDEE, their
heirs, successors and assignees, free from any and liens or encumbrances
whatsoever.

IN WITNESS WHEREOF, the VENDOR and the VENDEES set their


hands this 22nd day of December 2016 at Baguio City, Philippines.
