3. It is not an impossible crime.

The elements of an impossible crime are: it would have been


ann offense against person or property, it is inherently impossible to commit because of its
impossiblilty or empliyment of inadequate or inffectual means; it must not be punished as
another crime in the Revised Penal Code. In the Present case, the act of A is punishable
under the Revised Penal Code as grave threats, thus it is no longer an impossible crime.

5. an ordinary mitigating circumstance can only lower the penalty by its period. It can be offset
by a pressence of an aggravating circumstance. A provilaged migrating circumstance on the
otherhand, can lower the penalty by degree. It cannot offset by the presence of an aggrivating
circumstance. Examples of privilaged migrating circumstance are; the presence of two
ordinary migrating circumstance without an aggrivating circumstance a minority or if the crime
be committed by a perso below 18 years of age but above 15 years old with discernment

1. A is incorrect. A crime is considered as a comlex crime under the revised penal code if (1) a
single act constitutes two or more grave or less grave felonies or (2) if one crime is a
necessary means in committing the other. In this case the crimes committed by A are 3 counts
of slight physical injries fallling under light fellonies. Thus being light feonies it cannot
