7TH INTRA MOCK TRIAL COMPETITION


16th March 2017

Notice

This is to inform you that the 7th Intra Mock Trial Competition shall take place on 30th March
2017. The last date for the registration is 25th March 2017. The rules for the competition is as
follows-
1. There shall be individual participation. Team is not allowed.
2. A memorial not exceeding 5 pages has to be submitted from one side. The side will be
allotted through email. The memorials shall be taken on the 29th March at 3:10.
3. The training session shall be conducted in the Moot Court Room on -
17th March 11:50 am
23rd March 11:50 am
23rd March 3:10 pm
27th March 3:10 pm
There shall be a special training session for all the participants which will be notified
later .
4. The main focus shall be on the art of cross examination which involves the exercise of
identifying leading and non-leading questions.
5. The scoring criteria shall include-
Understanding of the issue 25
Questions 50
Court etiquettes 20
Memorials 5
Total 100
6. The witnesses shall be provided to the participants from the Advocates Legion.
7. All the participants should appear in formal dress. Black/Grey Tie is compulsory for all
those who are wearing white shirt and black trousers.
8. Other information and queries shall be taken in respective training sessions.
Mock Preposition

Sandhya and Amrish were married for 5 years. The couple had no child. Apoorv, brother of
Sandhya used to reside with her sister and brother-in-law. He had witnessed many instances
where the husband and wife had estranged clashes over the issue of child. The parents of the
Amrish also used to insult Sandhya for not begetting any child. They also expressed their
unhappiness towards the daughter-in-laws behavior. On 1st February 2017 in a small altercation,
Amrish tried to throttle Sandhya and she in return pour kerosene oil over Amrish, who managed
to escape. She told her brother about it but no complaint was filed to the police.

In the night of 2nd February 2017, Apoorv was outside the house reading an advertisement for
Bank PO in the street light near the house of Keshav (friend of Apoorv). Suddenly Apoorv heard
a scream coming from the house. He along with Keshav opened the house of Ambrish and
entered. They found Sandhya lying on the ground in a semi-conscious state. She informed
Apoorv and Keshav that she had been administered 3 tablets by her husband while stating that it
will help her in getting pregnant. She insisted her brother to take her to the hospital. Apoorv was
about to call the ambulance but Ambrish intervened and Sandhya could not be taken to the
hospital.

On the next day, in the evening when Apoorv came back from the college, he could not enter the
house as it was locked from inside. With the help of hammer, he broke open the lock and he was
startled to see his sister hanging from a peg in the roof with the rope, one end of which was fixed
to a nail fixed in the wall. Apoorv immediately went to the house of next door neighbor Prakash
and informed him about the incident. Prakash told him that sometime back he had seen Ambrish
and one more person walking out of the house.

Apoorv tried to lodge an FIR in the police station, but mother of Ambrish, Smt Sushma and
Father, Mr. Jagdish stopped him stating that they had already instructed Kanika, Sister of
Ambrish to lodge an FIR of committing suicide.
On the same day, Apoorv along with Prakash went to the nearest police station to file an FIR
against Apoorv and his family. Investigating officer Vikram Singh recorded the statement
wherein Prakash stated that he had seen Ambrish and one more person walking outside the house
sometime before the incident. He also stated that he would be able to identify the second person
on seeing him again.

On the same day Ambrish was arrested and his statement was also recorded. In his statement he
made a disclosure statement whereby some weapons were recovered. At his instance, Anand, his
associate was also arrested but nothing was recovered from him.

During the trial of Ambrih and Anand, Apoorv stated that he had been told by Prakash that he
had seen Ambrish and one more person walking outside the house before the incident. Prakash in
his examination in chief supported Apoorvs version and also identified the culprit. In his second
statement Prakash deposed that he had not seen Ambrish or any other person outside the house
on the day of incident.

Dr. Mandeep Singh Dhaiya who conducted the post mortem stated that the following injuries on
the dead body-
1. Right side of the face of the deceased bloated and bleeding nose
2. The ligature mark in width over the thyroid cartilage, the mark of the knot on the right
side 1 x 1 width contusion of tissue underneath and fracture of thyroid cartilage.
3. Abraded contrusion 5 x 3 on the front side of the chest with fracture of second and
their ribs and laceration of right lung.
4. Abraded contrusion 6 x 4 on the front of left side of the chest and fracture of 2nd , 3rd
and 4th ribs anteriorly in the middle clerical line
According to Dr. Mandeep death was caused due to shock hemorrhage and asphyxia due to
above injuries.

Ambrish and Anand are charged with murder U/S 302/34 IPC. The case has been listed today for
cross examination(not examination in chief) by prosecution and defence.

Note- The witnesses shall be provided by Advocates Legion, however the participants will be
allowed to train their witness before appearing for the cross-examination.
