JudgmentinAssociationforCivilRightsinIsraelvMinisterofJusticeetal
(5917/97),explicitlysaysthatthereisnorequirementforfilinganyrequestfor
inspectionofdecisions,whicharenotlawfullyprohibitedforpublication.
However,theOfficeoftheClerkroutinelydeniesaccesstoinspection,whichis
lawfullypermitted.
b)Instantrequestisfiledaspartofmyacademicresearch,goingonforseveralyears,
regardingITsystemsoftheIsraeliandUScourts,andadministrationofpublic
accesstocourtrecords.Myresearchonsuchsubjectshasbeenpublishedand
presentedininternationalacademicconferencesintherelevantfields,subjectto
internationalexpertreview.Hisreportsonsuchsubjectshavebeenincorporated
intoUNHumanRightsCouncilReportspertainingtotheUnitedStates(2010,
2015)andIsrael(2013),followingtheCouncil'sProfessionalStaffreview.My
reports,pertainingtotheIsraelicourts,arealsoroutinelypublishedbymediain
theUS,subjecttoeditorialreview.[iiii]

c)InstantcourtfileappearsintheelectronicpublicaccesssystemoftheSupreme
Courtassealed.However,theobviousconcernisthereisnolawfulpublication
prohibitionininstantcourtfile.Worseyet,bothinthecaseofwhistleblowerShuki
Mishol,[i]andinthecaseofsocialprotestactivistMotiLeybel,[ii]theSupreme
Courtengagedinseriousperversionsofrecordsandprocessunderunlawful
sealing,whichshouldbedeemedFraudUpontheCourt.
d)Therefore,concernsarisethattheIsraeliSupremeCourtisengagedinserious
violationsofHumanRightstherightforFairandPublicHearing,andthe
InternationalCovenantonCivilandPoliticalRightstherightforDueProcess.
Moreover,suchcircumstancesgeneratevagueandambiguousconditions,which
permitarbitraryandcapriciousenforcement,andraiseconcernsregarding
FreedomofSpeechandFreedomofthePressinIsrael.ConductoftheSupreme
Court,pertainingtowhistleblowersandsocialprotestactivistsalsoraisesconcerns
thattheSupremeCourtitselfisengagedinsabotageandsubversionofprocess
andinstitutionsofthedemocraticregime(ShinBetAct2002).Such
circumstancesalsounderminepublictrustinthejusticeandlawenforcement
system.
4.RelationshipoftheRequestertotheCourtFile(directorindirect)
TheRequesterhasnodirectrelationshiptoinstantcourtfile.TheRequesterknows
PetitionerLoriShemTovasasocialprotestactivist,particularlyinrelationshiptoher
effortstofreeJoelleBenSimon.BenSimonwasconfinedunderforcepsychiatric
hospitalizationthroughcoordinationoftheMinistryofJustice,aftersheprotested
againstcorruptionofthefamilycourtsinfrontoftheJusticeMinistersoffice.[iii]
