AFFIDAVIT OF THE DRIVER

I, MAXIMO A. MALUBAY, of legal age, married, Filipino, and presently

residing at Brgy. Naungan, Ormoc City, Leyte having been duly sworn to in
accordance with law, do hereby depose and say:

1. That I am currently employed as a TRUCK DRIVER

(Administrative Aide I) of the Local Government Unit of Ormoc City,
particularly assigned at the City Slaughterhouse;

2. That on April 6, 2017 at about 9:30 oclock in the morning, I was

traversing through Anubing Street, Ormoc City driving the City
Slaughterhouse Meat Van, a Mitsubishi truck van, on my way to
the New Ormoc City Hall to pick-up employees assigned at the City
Slaughterhouse;

3. That apparently however, an Isuzu Altera with plate number YEY

429 was parked at the road bedside along the New City Hall
Building and was accidentally hit by the truck van that I was
driving as I made a right turn to the corner going to the New City
Hall Building;

4. That when I was about to make the full right turn, I stopped the
meat van as a tricycle was also traversing the road;

5. Then when I came to a full stop, I heard a sound coming from the
back portion of the truck van I was driving and found out that said
portion scratched and broke the left rear tail light assembly of the
Isuzu Altera;

6. This affidavit is executed to attest to the truth of the above-

narrated facts and to further testify to the veracity of the foregoing
statement.

7. Further, I sayeth naught.
