BE IT RESOLVED BY the Council of the City of Atlanta that action of the Department of Law be
approved in authorizing payment to Carlton Grant and Mayme Grant the sum of $18,846.00 as full and
final settlement and satisfaction of all claims, past, present and future, of every kind and character, for
damages alleged to have been sustained as a result of a fallen tree on September 7, 2013 at 596 Peyton
Road, S.W. (Property) as is more particularly set forth in the within claim; said sum taken from and
charged to Account 5051/170201/5750002/4310000; and
BE IT FURTHER RESOLVED that as part of the settlement and satisfaction of all claims, described
above, the City is further authorized to amend and restate a portion of its current easement interests
located on the Property of the above referenced claimant, being an easement for the repair and
maintenance of the Citys North Utoy Trunk as such easement interests are recorded in the records of
Fulton County, Georgia, Deed Book 1599, Page 105 (North Utoy Trunk Easement), said amended and
restated easement will provide for a legal description of the Citys easement being approximately 40
wide, more or less, and shall also provide for the abandonment and release of the portion of the Citys
existing North Utoy Trunk Easement located on the Property in favor of the amended and restated
easement description. The amended and restated easement will be effective upon the execution of an
Amended and Restated Easement by the claimant and the City in a form acceptable to the City
Attorney in conjunction with the settlement and release of all claims against the City, as described
above; and
BE IT FINALLY RESOLVED that the Mayor, or his authorized designee, is hereby authorized to
execute all documents necessary and appropriate to effectuate the purposes described herein, including
without limitation, such settlement agreements and easements documents contemplated for the final
settlement and release of this claim.

WHEREAS, the Atlanta Fire Rescue Department and the Governors Office of Highway Safety
previously and successfully partnered to implement the Child Car Safety Seat Program which has gained
national prominence in its field; and
WHEREAS, this program provides Child Car Safety Seats, proper installation instruction and safety
education to residents of City of Atlanta and the state of Georgia free of charge; and
WHEREAS, the one hundred eighty-eight thousand, two hundred dollars and zero cents $188,200.00
will be used solely for the operation of the Car Safety Seat Fitting Program for the benefit of the
residents of the City of Atlanta and the State of Georgia.

WHEREAS, due to the City of Atlanta's ("City") financial constraints in Fiscal Year
2009 the City's Municipal Court went to a four-day work week; and
WHEREAS, the City's improved financial condition and the demands of the general
public now require the Municipal Court to operate at least five days per week; and
WHEREAS, the Municipal Court hours of operation had previously been set by the
Chief Judge pursuant to Charter Subpart A, Article 4, Courts, Section 4-105(b); and
WHEREAS, the City desires to add Section 62-48 to Part II, Chapter 62 Courts, Article
II Municipal Court, Division 1 of the City of Atlanta Code of Ordinances setting forth
hours of operation for the Municipal Court.
SECTION 1: That Section 62-48 titled Hours of Operation is hereby added to Part II,
Chapter 62 Courts, Article II Municipal Court, Division 1 of the City of Atlanta Code of
Ordinances which shall read as follows:
SECTION 2: This Ordinance shall take effect 90 days from the date of approval.
SECTION 3: All ordinances in conflict herewith are hereby waived for purposes of this

WHEREAS, the White House Office of National Drug Control Policy (ONDCP) grants funding to
High Intensity Drug Trafficking Area (HIDTA) program task forces responsible for disrupting and
dismantling violent drug trafficking organizations; and
WHEREAS, the Department of Police (Department) has been a participant in the Atlanta High
Intensity Drug Trafficking Area task force (Atlanta HIDTA) for over ten years; and
WHEREAS, as per Resolution 05-R-0680, the Atlanta Police Department (Department) acts as the
pass through agency to disburse payments for task force expenses that are completely federally
funded, and with no matching funds; and
WHEREAS, the ONDCP has awarded the City grant G14GA0003A (HIDTA grant), in the amount of
five million, three hundred one thousand, three hundred sixty dollars ($5,301,360.00), to continue
funding the Atlanta HIDTA task force initiatives, and this award was approved by the City Council of
Atlanta and the Mayor through ordinance 14-O-1234; and
WHEREAS, ONDCP modified grant award #G14GA0003A by adding modification #1 to the original
grant award of an additional forty-one thousand, five hundred dollars ($41,500.00), with no matching
funds, bringing the grant award to a new total of five-million, three hundred forty-two thousand, eight
hundred sixty dollars ($5,342,860.00), and this award was approved by the City Council of Atlanta and
the Mayor through ordinance 14-O-1429; and
WHEREAS, ONDCP further modified grant award #G14GA0003A by adding modification #2 to the
grant award of an additional one hundred twenty-five thousand dollars ($125,000.00), with no matching
funds, bringing the grant award to a new total of five-million, four hundred sixty-seven thousand, eight
hundred sixty dollars ($5,467,860.00); and
WHEREAS, the Department wishes to accept grant modification #2 to HIDTA grant G14GA0003A, to
continue funding the Atlanta HIDTA task force.

AN ORDINANCE
BY PUBLIC SAFETY/LEGAL ADMINISTRATION COMMITTEE
WHEREAS, there exists single-family residences in an open and vacant status throughout the city, and
particularly in concentrated areas that have been ordered cleaned and closed (i.e. boarding) by the City
of Atlanta In Rem Review Board (Board) or the Atlanta Municipal Court (Court); and
WHEREAS, when property owners fail to effectuate such cleaning and closing within the time specified
by the Board or Court, the City is authorized to carry out such orders; and
WHEREAS, currently, Code Enforcement, through procured contractors, carries out such orders at great
public expense; and
WHEREAS, due to cost and the current backlog of structures ordered cleaned and closed but not yet
complied, the City, though its Department of Corrections, has deployed municipal inmates to clean and
close on a pilot basis to clean and close ten single-family structures (pilot program); and
WHEREAS, the pilot program has proved successful and the Mayor and City Council find it in the
public health, safety and welfare to authorize such program on a permanent basis, as needed, and to
codify such authorization in the City Code; and
WHEREAS, the City Council finds that the City will receive a substantial public benefit by use of
municipal inmates to effectuate the cleaning, both exterior and interior, and closing of residential
structures; and

WHEREAS, the substantial benefit includes the remedy of the deleterious effect open and vacant
residential structures has on streets, neighborhoods, and communities; and
WHEREAS, this deleterious effect includes drugs, crime, prostitution, ill health, insect and vermin
infestation, loss of community morale, substantial reduction in property values, loss of private
investment/lending, increased code enforcement resources, blight, to name a few; and
WHEREAS, the City Council finds that this substantial public benefit will far outweigh the private
benefit to the private property owner whose property is cleaned and closed at taxpayer expense, both
direct and indirect; and
WHEREAS, in addition to the remedying of this deleterious effect, the City will not use inmates free of
charge to the private property, but will aggressively seek re-payment of all costs, direct and indirect,
from the property owner, and if necessary lien of the property in order to recover costs expended by the
City and safeguard taxpayer funds.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA HEREBY
ORDAINS AS FOLLOWS:
Section 1: Atlanta City Code Section 98-166, currently reserved, is amended such that hereafter it shall
read as follows:
Section 98-166. Use of Inmates on Private Property
The Chief of Corrections may use inmates to carry out orders of the in rem review board or Atlanta
Municipal Court to clean and close structures on private property when the property owner fails to do so
within the time ordered by the board or court, as the case may be. Use of inmates is conditioned on the
following:
(a) The Director of Code Enforcement requests from the Chief of Corrections use of inmates;
(b) The inmates are under the watchful oversight of appropriate Corrections personnel;
(c) The public is notified of the use of inmates by the posting of a sign at the property; and
(d) Within 15 days of completion of the order, the Chief of Corrections, in consultation with the Director of
Code Enforcement and the Chief Financial Officer, remit a bill to the property owner, by certified mail,
for the work completed. Such bill shall notify the owner that if payment is not made within 15 days of
receipt of such bill, that the Chief Financial Officer shall cause a lien to be filed against the property in
the county records for the amount of bill plus, filing and mailing costs, plus 10% interest per annum.
(e) All funds collected shall be placed in the general fund.
Section 2: All ordinances or parts of ordinances in conflict are hereby repealed to the extent of any
conflict.

WHEREAS, the City of Atlanta has an interest in maintaining the public safety and welfare of citizens
of the City of Atlanta and its visitors; and
WHEREAS, the City of Atlanta has an interest in regulating, through the lawful exercise of its police
powers, the sale of alcoholic beverages within its territorial limits; and
WHEREAS, the City of Atlanta is authorized to regulate the locations of establishments which are
licensed to sell alcoholic beverages including businesses that sell malt beverages by the package; and
WHEREAS, Section 10-88.1 of the City of Atlanta Code of Ordinances sets forth the City's distance
requirements between businesses seeking licenses to sell alcoholic beverages by the package, including
malt beverages, and other businesses that sell alcoholic beverages by the package, residences, schools,
parks, libraries, churches, hospitals and daycare facilities; and
WHEREAS, the owner of the property located at 280 Elizabeth Street is in the process of renovating and
redeveloping such property and constructing new buildings to create a mixed use development of
restaurants, retail shops and housing; and
WHEREAS, this redevelopment will provide new dining and shopping opportunities for neighborhood
residents, residents of the city of Atlanta and visitors to the city of Atlanta; and
WHEREAS, portions of the retail section of 280 Elizabeth Street do not comply with the requirements
of Section 10-88.1 of the City of Atlanta Code of Ordinances to permit the sale of malt beverages by the
package; and
WHEREAS, following a vote by the Inman Park Neighborhood Association to support an effort to
create an exemption to the requirements of Section 10-88.1 of the City of Atlanta Code of Ordinances,
on June 16, 2014, the Atlanta City Council adopted Ordinance 14-0-1307 (later codified as City of
Atlanta Code of Ordinances Section 10-92 (b) (16)) to permit one (1) wine specialty shop to be located
at 280 Elizabeth Street which ordinance was approved without signature of the mayor on June 25, 2014;
and
WHEREAS, on October 15, 2014, the Inman Park Neighborhood Association, at a duly called meeting
conducted a vote of its qualified membership, and voted to support an effort to create an

exemption from the current distance requirements applicable to the issuance of a license to sell malt
beverages by the package to allow no more than one (1) business to sell malt beverages by the package
at 280 Elizabeth Street; and

current distance requirements in 10-88.1 to promote the effective redevelopment of this immediate area.

developing the area to accommodate a growing economy and population; and
WHEREAS, as such, the City of Atlanta acknowledges the Wildlife Habitat Conservation Program as
advocated by the National Wildlife Federation; and
WHEREAS, the City of Atlanta seeks to become an even more wildlife friendly community NOW,
THEREFORE, THE COUNCIL OF THE CITY OF ATLANTA HEREBY ORDAINS as follows:
Section 1: 158-12 (currently reserved) of the Code of Ordinances of the City of Atlanta,
Georgia, is hereby activated and shall provide as follows:
158-12. Properties exempt from vegetative growth, weed, grass and nuisance ordinances and
regulations.
(a) All properties and parcels of land certified by the National Wildlife Federation as wildlife habitats
shall be exempt from all vegetative growth, weed, grass and nuisance ordinances and regulations of the
city.
(b) To be eligible for certification, a property must have a food source, water source, cover for animals
and places to raise young animals.

WHEREAS, due to the City of Atlanta's ("City") financial constraints in Fiscal Year
2009 the City's Municipal Court went to a four-day work week; and
WHEREAS, the City's improved financial condition and the demands of the general
public now require the Municipal Court operate at least five days per week; and
WHEREAS, pursuant to the City of Atlanta Charter, 1996 Ga. Laws P. 4469, et seq.
(the Charter) Subpart A, Article 4, Courts, Section 4-105(b) ("Section 4-105") the
Municipal Court hours of operation are set by the Chief Judge and the City desires to
amend Section 4-105 to remove that responsibility; and
WHEREAS, the City, by separate legislation, has added Section 62-48 to Part II,
Chapter 62 Courts, Article II Municipal Court, Division 1 of the City of Atlanta Code of
Ordinances setting forth hours of operation for the Municipal Court; and
WHEREAS, the Charter Subpart A, Article 4, Courts, Section 4-104 (g) ("Section 4-
104") establishes Judge compensation; and
WHEREAS, the City desires to amend Section 4-104 to better align Judge
compensation with the newly established Municipal Court hours of operation.
SECTION 1: That the City of Atlanta Charter Subpart A, Article 4, Courts, Section 4-
105(b) is hereby amended by removing the stricken language as shown below:

(b) Duties. The chief judge shall be responsible for the general supervision of the
municipal court and shall promulgate all rules necessary for the supervision, conduct,
and administration of the court, including but not limited to the number of divisions
into which the court is divided and the assignment of judges to duty therein; the hours
of operation of the court; the preparation of calendars deemed necessary and proper;
and a system for keeping court records and shall require such reports from the judges,
solicitor, public defender, clerk/administrator, and other court personnel as deemed
necessary and proper. Such rules so promulgated shall be reduced to writing. The chief
judge shall be responsible also for the preparation and submittal of budgets of said court
to the mayor and city council and appropriate departments, committees, and agencies.
He or she shall further perform other duties as the council may provide by ordinance or
as required by law.
SECTION 2: That City of Atlanta Charter Subpart A, Article 4, Courts, Section 4-104
(g) which currently reads:
Compensation. The municipal court judges shall be paid an annual salary no less than
90 percent of the total annual compensation of the judges of the Superior Court within
the territorial jurisdiction of said court.
Is hereby amended to read:
(g) Compensation.
(1) The municipal court judges presiding over a court calendar at least five days per
week shall be paid an annual salary no less than 90 percent of the total annual
compensation of the judges of the State Court within the territorial jurisdiction
of said court.
(2) The municipal court judges presiding over a court calendar four days or less per
week shall be paid an annual salary no less than 8o percent of the total annual
compensation of the judges of the State Court within the territorial jurisdiction
of said court.
SECTION 3: That a copy of this proposed amendment to the Charter of the City of
Atlanta, Georgia 1996 Ga. L., et seq. as amended, shall be filed in the Office of the

Municipal Clerk of the City of Atlanta and in the Offices of the Clerks of the Superior
Courts of Fulton and DeKalb Counties and that a "Notice of Proposed Amendment to

made a part of this ordinance, be published in the official organ of the county of the legal
situs of the City of Atlanta or in a newspaper of general circulation in the City of Atlanta
once a week for three weeks within a period of 6o days immediately preceding its final
adoption, and that a copy of said advertisement be attached to this ordinance prior to its
final adoption by the Council of the City of Atlanta.
SECTION 4: All ordinances in conflict herewith are hereby waived for purposes of this

This legislation amends the Renewal provisions for Alarm Systems listed in Section
70-28(b)(2) of the Code of Ordinances. Currently an alarm user is responsible for
submitting an application annually to renew their alarm permit and is subject to a
$150.00 civil penalty if not done. This amendment changes the Code to reflect an
automatic annual renewal if there has been no change in the status of the property
or the alarm user. At the Tuesday, October 14, 2014 PSLA meeting, the Law
Department advised the operational group will provide an update to the Committee on
the proposed legislation.

WHEREAS, the implementation and use of drone technology throughout the United States and
in the State of Georgia remain unregulated in the area of privacy rights of individuals; and
WHEREAS, the continued absence of legal constraints for the use of drone technology for
surveillance and information collection creates a potential for government abuse through the
unchecked use of drones; and
WHEREAS, drones have the capacity to continuously monitor and track individuals
movements, store images and data, record phone text communications, and take photographs and
film individuals without regard to the distinction between public and private spaces; and
WHEREAS, drone capability for surveillance purposes is boudless as technology develops and
drones may be equipped with a variety of weapons; and
WHEREAS, armed drones and surveillance drones present an unreasonable ans serious threat to
the privacy, unconstitutional rights and general welfare of the residents of Georgia and the
American people.
NOW THEREFORE, THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA
HEREBY, calls on the General Assembly of State of Georgia to adopt legislation providing
legal restraints for the government and law enforcement's use of drone technology and
prohibiting the use of drones for surveillance, information gathering purposes, and acts of
aggression and violence against human beings.
BE IT FURTHER RESOLVED, that the Council of the City of Atlanta calls on the General
Assembly of State of Georgia to prohibit the domestic use of drone technology by police
departments without a probable cause warrant or in the case of an emergency.
BE IT FURTHER RESOLVED, that the Council of the City of Atlanta calls on the General
Assembly of State of Georgia to exclude the use of information illegally gathered from drones in
court such that no part of the information acquired and no evidence derived therefrom may be
received in evidence in any trail, hearing, or other proceeding in or before any court, grand jury,
department, officer, agency, regulatory body, legislative committee, or other authority of State of
Georgia or a political subdivision thereof if the disclosure of that information would be m
violation of this resolution.

of weapons, the Council of the City of Atlanta call on the General Assembly of State of
Georgia to preclude the use of weaponized drones in this state.
BE IT FURTHER RESOLVED, that where a warrant is sought to use drone technology in the
City of Atlanta, notice shall be given to the person or persons upon whom information is to be
collected.
BE IT FURTHER RESOLVED, that with the proper authorization, the operation of drones by
the Atlanta Police Department shall be limited to collect data only on the target, to avoid data
collection on individuals, homes, or areas other than the target, and to prohibit the use of facial
recognition or other biometric matching technology on non-targets.
BE IT FURTHER RESOLVED, that no data collected by the Atlanta Police Department on an
individual, home, or area other than the target that justified deployment may be used, copied, or
disclosed for any purpose and that such data must be deleted must be deleted as soon as possible,
and in no event later than 24 hours after collection.
BE IT FURTHER RESOLVED, any use of drones by the Atlanta Police Department, fully
comply with all Federal Aviation Administration requirements and guidelines.
BE IT FURTHER RESOLVED, that the Council of the City of Atlanta shall exercise oversight
over the use of drone technology and any implementation of a drone program by any entity in the
City of Atlanta.
BE IT FURTHER RESOLVED, that the Council of City of Atlanta requires that any entity that
intends to acquire and use drone technology in the City of Atlanta must submit for approval to
the Council a statement of purpose and guidelines for the use of drone technology.

WHEREAS, there are an estimated 424,000 out-of-hospital sudden cardiac arrests (0HSCA) occurring
in the United States annually; and
WHEREAS, the leading cause of death of residents in Fulton County is heart disease; and
WHEREAS, the survival rate for cardiac arrest patients in 2012, was 6.4% for the residents of Fulton
County, Georgia; and
WHEREAS, the mission of the Department of Fire Rescue is to provide prompt quality service our
stakeholders that promote safety, security, enhances sustainability, and enriches the quality of life
through professional development and dedication to service.
WHEREAS, the mission of The Better Outcomes Foundation, Inc. is to provide high-quality, highly
accessible, no cost training and education in 911/CPR/AED use to the historically at-risk populations of
Fulton County, Georgia and to the pre-hospital emergency care providers who serve them.
WHEREAS, the Department of Fire Rescue and The Better Outcomes Foundation, Inc. wishes to
combine resources to identify, target, and provide free CPR training to at-risk communities within the
City of Atlanta; and
WHEREAS, this agreement will enhance the Department of Fire Rescue abilities to teach
911/CPR/AED training to general lay persons and community leaders in community-based places of
worship, clinics, senior communities, shelters, civic organizations, schools, public gatherings, health
fairs, fire stations, and business districts in at-risk communities within the City of Atlanta.
THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, HEREBY RESOLVED, as follows:
SECTION 1: That the Mayor or his designee is hereby authorized to enter into an agreement with The

We follow up on previous audits to assess the extent to which responsible officials have taken
timely, appropriate corrective action in response to audit findings and recommendations. The
city charter requires my office to report on completed audits, major findings, managements
corrective actions, and significant findings that have not been fully addressed.
We followed up on three recommendations issued to the Atlanta Fire Rescue Department and
four recommendations issued to the Atlanta Police Department from two audits: Atlanta Fire
Rescue Staffing (October 2011) and E911 Communications Center (April 2013). The
recommendations range in age from 17 to 35 months old. Management agreed with all
recommendations and planned to implement them in six months to five years; for two of the
recommendations management stated implementation was under way. We conducted this
follow-up in accordance with generally accepted government auditing standards. Our methods
included:
obtaining and reviewing departments responses and data submissions to understand
how management addressed each audit recommendation
reviewing prior follow-up work related to recommendations
The Atlanta Police Department implemented all four recommendations we assessed. The
Atlanta Fire Rescue Department implemented two recommendations and is working on the

other recommendation we assessed from these reports. As a result of our follow up, we are
closing six recommendations and leaving one recommendation open for future follow up.
Appendices A and B summarize our assessment of each recommendation.
Generally accepted government auditing standards require that we plan and perform the audit
to obtain sufficient, appropriate evidence to provide a reasonable basis for our findings and
conclusions based on our audit objectives. We believe that the evidence obtained provides a
