I. Moot Court Competition


1. ELIGIBILITY

Students enrolled in a full-time or part-time law programme at the time of the competition are
eligible to compete in the Competition. Each College/Law School or University may enter
one team ONLY.

2. TEAM COMPOSITION

A team consisting of three members that satisfies the eligibility Criteria can participate. Each
team shall comprise of two speakers and one Researcher. A team of two speakers may also be
allowed.

3. ROUNDS

The competition shall be of three rounds namely Preliminary, Semi-Finals and Final rounds.
Following shall be the rules for Oral Presentation in each round.

3.1. PRELIMINARY ROUNDS-

There shall be two Preliminary rounds each team shall argue for both sides. Matching of
each team shall be done by the Draw of Lots. Each team will be allotted 20 minutes for the
arguments (each speaker to speak for not less than 5 minutes) and in total 15 minutes and 5
minutes for Rebuttal and Sur-rebuttal. The division of time is at the discretion of the team
members. The division of time must be communicated to the court clerks before commencing
arguments.

If any speaker continues to speak after the completion of the allocated time, the additional
time which he or she speak for will be deducted from the time allocated to his or her co-
speaker, as the case may be. However, no speaker shall be allowed to present his arguments
beyond the maximum time.

Each speaker must introduce himself or herself to the court using only his identification code
and team code given to him/her at the time of memorial submission.

3.2. SEMI-FINAL

Total of four teams from the preliminary round will qualify for the Semi-Final round.
Matching of each team shall be done by the Draw of Lots. Each team will be allotted
20 minutes for the arguments (each speaker to speak for not less than 5 minutes) and in total
15 minutes and 5 minutes for Rebuttal and Sur-rebuttal. The Semi-Final Round will consist
of One (1) Mooting Session and will also be a Knockout Round where the winner of each
Semi-Final Round pairings will advance to the Final Round.

In case of tie, total scores allotted in Understanding of Law and Procedure will be considered
to decide the winner.

3.3 FINAL

Winners of each Semi-Final round will qualify for the final round. Each team will be allotted
30 minutes for the arguments (each speaker to speak for not less than 10 minutes) and in
total 25 minutes and 5 minutes for Rebuttal and Sur-rebuttal. The time may be exceeded at
the discretion of judges.

4. EX-PARTE PROCEEDING

At the outset, if a team fails to appear within 15 minutes of the scheduled time (in any of the
three rounds) or in case of odd number of teams, then the oral round of the attending party
may proceed Ex parte. In case failure of appearance of teams within stipulated time period,
the attending party is Respondent the party will be declared winner.

5. MEMORIALS

(i) Each participating team shall prepare both memorials in English.


(ii) All teams are to submit their copies to organizers in hard copy to before the deadline
specified by the organizing committee. Failure to do so will result in disqualification
from the competition.
(iii) Memorials from each side should not contain more than 20 pages (which constitutes
summary of facts & arguments, arguments advanced and prayer).
(iv) The memorial shall consist of following:
i. Cover Page ii. Table of Contents iii. Index of Authorities iv. Statement of
Jurisdiction v. Summary of Issues raised/questions presented vi. Summary of
Arguments/Pleadings (1or 2 Page) vii. Arguments Advanced/Pleadings [not more
than 15 pages ] viii. Prayer for Relief (1 Page) ix. Annexure (optional)

(v) All citations must adhere to Blue Book 9th Edition and fulfil the following
requirements: - Font type Times New Roman Font size 12 Footnotes Font type Times
New Roman Footnotes Font 10. Memorials that do not follow the above mentioned
specifications shall be penalized.
(vi) Memorial cover page shall follow the following Colour Scheme:
Petitioner/Appellants- Blue and Respondents Red
(vii) All participants must submit FOUR (4) copies of the Memorial for both sides.

(viii) The soft copy of the memorial shall also be sent through e-mail given below latest by
1st September before 5:00 pm. The memorial should be sent as an email attachment
in Word format/ PDF-file.
(ix) Subject of the email shall Memorial for team code. Please name the memorial
using your teams Code and P for Petitioner or R for Respondent. For example, if
you are assigned team number 555 the file name should be 555P.doc or 555R.doc.
(x) The submission of hard copies should be done latest by 7th September to the
Organisers.

5.2. ANONYMITY

Each team will be awarded a code number after registration and that number alone shall be
marked on the memorials. Identity of the team or the names of the participants must not be
revealed in the Memorial in any manner whatsoever and all teams must send the Memorial
with a covering letter specifying the name and contact details of the Team Members and their
designated Team Code. Name of the school/University shall not be mentioned on any
compendium or material to be presented the bench. Failure to compliance will lead to
disqualification of such compendium or material from presentation.

6. SCORING

Following schematics will be followed in the competition for the scoring of the teams.

6.1. SCORING OF ORAL ARGUMENTS

Each speaker shall be marked on total of 100 marks by each Bench Judge. The
following will be the Marking Criteria and the Marks Allocated to each category:

1. Understanding of Law and Procedure 30 marks


2. Application of Facts 20 marks
3. Ingenuity and Ability to Answer Questions 20 marks
4. Reference to Memorials - 20 marks
5. Advocacy Skills, Court Craft and Demeanour 10 marks
Total 100 Marks and marks allotted by the judges shall be final.

6.2. SCORING OF MEMORIAL

1. Knowledge of Law and Extent of Research 30 marks


2. Proper and Articulate Analysis, Clarity and Organization 20 marks
3. Knowledge of Facts 20 marks
4. Evidence of Original Thought and grammar 20 marks
5. Correct Format and Citation -10 marks
Total 100 Marks and marks allotted by the judges shall be final.

7 DRESS CODE shall be strict formal wear.

Ladies- Black and white salwar/sari or pant/suit with black tie and black coat.

Gentlemen- White shirt with black tie, black trousers, black coat, white socks and black
shoes.

8 MISCELLANEOUS

All participants are expected to maintain the decorum in the court during the competition and
are expected to conduct themselves in a manner befitting the legal profession. The
Competition committee reserves the right, at its sole discretion, to take appropriate action for
any unethical, unprofessional and wrongful conduct during the entire period of the Moot
Court competition. Upon completion of the competition, the competition committee reserves
the exclusive right to use the memorials submitted to them, as they deem appropriate.
Participating teams should carry with them required study or reference materials for their
own use during the oral rounds of competition. Team found attempting to approach and
influencing Judges/Administrators/Organizers shall be disqualified. No member of any team
will be permitted to hear the arguments in any court rooms in which that team is one of the
contesting teams whilst that team is still in the competition.

Rules are subject to change by the organisers.

10 AWARDS
There shall be a winner of the Competition and other awards and prizes may be
declared during the prize distribution of the Competition.

12 ACCOMODATION

1. The accommodation for all the participating teams shall be provided from evening
of 13th September 2017 till afternoon of the 15th September 2017.
2. Travel of the teams from outstation and to/from venue of the Competition must be at
teams own expense.

3. The maximum of three members are allowed to participate in the Competition. No


teams coaches shall be allowed to accompany the teams or to witness their rounds.
4. The participating teams are requested to carry their own set of lock and keys for the
accommodation.
5. No internet facility shall be provided to the teams at their respective
accommodation.
6. The teams coming by their own conveyance shall not be allowed to park their
vehicle on the campus. Such team shall be required to park their vehicle outside the
campus only.
7. Himachal Pradesh University is a no smoking campus. No participating team shall
indulge in smoking, drinking or any other objectionable activities. Indulgence in
such activities shall invite disciplinary action and instant disqualification.

Envision 2017
Moot Problem

Abhimanyu and Rohan are two best friends. They live in the metropolitan city of Volantis
which is the capital of the country Indistan. Shanaya, their college friend was in a romantic
relationship with both of them and neither Rohan nor Abhimanyu are aware of the
relationship with the other
On 4th December 2016 Abhimanyu accidently reads an SMS conversation between Shanaya
and Rohan that clearly shows a romantic relationship and confronts Shanaya about it.
Shanaya confesses everything; she professes her love to Abhimanyu and promises to leave
Rohan. But in the very same week on 7th December, Abhimanyu goes to Shanayas apartment
and sees her in a compromising position with Rohan and has a big argument with them,
where they nearly come to blows.
Angry and upset, Abhimanyu plans to confront Rohan separately and make him sorry for
being involved with Shanaya. On the morning of 9th December, which was a Friday,
Abhimanyu calls up Rohan and asks to meet him at X bar for a weekend party. All the while
Abhimanyu plans to get Rohan drunk and subsequently physically assault him.
On 9th night, while they are at the bar and Abhimanyu first asks Rohan to have a drink with
him, Rohan says no. So Abhimanyu challenges Rohan to drink in one go, a large mug of a
non-alcoholic mocktail that Abhimanyu orders for him, while he himself has an alcoholic
drink.
Rohan finishes the entire glass and only then realises that there was alcohol in the drink,
which had been purposely mixed by Abhimanyu. Due to this rapid intake of a large amount
of alcohol, Rohan gets very intoxicated and decides to go home. Abhimanyu feels bad for
deceiving his friend and realises that Rohan was heavily intoxicated and decides to drive him
back home.
On their way back to home, a very drunk Rohan tells Abhimanyu that he loves Shanaya.
Listening to this Abhimanyu feels very sad and just as they are about to reach Rohans home,
Shanaya calls up Abhimanyu and breaks up with him telling him that she doesnt love either
Abhimanyu or Rohan. Abhimanyu becomes very agitated after this and tells Rohan about
Shanayas call. At Rohans home, Abhimanyu started drinking heavily to drown his sorrows
and gets very drunk, he also encourages the already drunk Rohan to drink with him. Finally
when Rohan and Abhimanyu are sitting and drinking alcohol together Abhimanyu starts

crying and says that he doesnt want to live anymore and that he thought Shanaya was the
woman he was going to marry. Rohan tells him that he should do what he feels is right.
Abhimanyu goes inside and gets a rope to hang him from the fan; Rohan doesnt dissuade
him and helps him tie the rope to the fan. He then tells Rohan that he wants someone to push
the stool while he stands on it, Rohan argues and refuses to do so. While they are arguing, the
drunken Rohan trips and accidently pushes the stool, thus Abhimanyu gets hanged and dies.
After all the drinking of alcohol and the emotional evening, Rohan falls unconscious. On 10th
December the milkman after continuously ringing the bell and when no one answers the door,
calls the building security guard. The security guard remembers an intoxicated Rohan
accompanied by a friend entering the apartment. He decides to call the Building Secretary
and they all chose to break open the door as they are worried about Rohan and his
companion.
Finally, after breaking the door open, they find Abhimanyu hanging from the living room
ceiling fan and Rohan unconscious on the floor. The Building Secretary immediately calls the
police. The police inform Abhimanyus family and take Rohan in for questioning. The post-
mortem report states that Abhimanyu died of asphyxiation as a result of the hanging and also
there was a large amount of alcohol present in his blood.
Abhimanyus family blames Rohan for helping and encouraging Abhimanyu to commit
suicide as they were both in love with Shanaya and on 11th December 2017, they lodge an
FIR against Rohan for abetment of suicide. After the police investigation, Rohan is charged
with the offence of abetment to suicide under section 305 of the Penal Code of Indistan and
subsequently arrested. The case was heard in the Sessions Court and charges were frame by
the court on 20th December. Rohan applied for bail but was unable to attain it as the next
hearing was due only on re-opening of the Court after its winter break.
After consulting with his advocate, on re-opening of the Courts on 2nd January 2017, Rohan
files a petition in the High Court of Volantis for quashing of the FIR and the proceedings in
the Sessions Court under section 482 of the Code of Criminal Procedure. Also, the Parliament
of Indistan has passed an amendment to the Penal Code of Indistan, that decriminalises
Attempt to commit suicide that was an offence under section 309 of the Code. Thus Rohan
has preferred a petition to the High Court stating that since suicide is no more an offence, its
abetment, under which he has been charged should also not be an offence; also adding that it
violated his right to life and liberty that is guaranteed by the Constitution of Indistan.
These petitions for quashing proceedings and challenging the validity of section 305 of the
Penal Code of Indistan are slated for hearing by the High Court of Volantis.

The laws and institutions of Indistan are pari materia to that of India except where mentioned
otherwise.

II CLIENT COUNSELLING
1. TEAM COMPOSITION

(i) Each team must consist of two participants only.


(ii) The two participants may be from any of the 3 year or 5 year LLB course. Teams
may not be altered after registration.

2. COMPETITION FORMAT

(i) There shall be 2 Rounds of Counselling session. The Preliminary Counselling Session
and two teams with highest score will be selected for the Final Counselling Session.
Rules given below shall apply to both rounds.
(ii) Each Counselling Session is divided into three parts:
Consultation, Post-Consultation and Critique

CONSULTATION:

(i) The consultation period shall be for 25 minutes.


(ii) The time period will start from the moment the client enters the chamber.
(iii)The time period is meant to be used for inter alia consultation with the client during
which participants are expected to elicit the relevant information, outline the problem,
find the clients expectations and propose a solution or other means of resolving the
problem.
(iv) During the consultation and post-consultation, the team may use books, notes and
other materials. The team may also use office props (Dictaphones, Files, desktop,
furnishings, bookshelves etc.) and any other material to furnish their consultation
room or for other relevant purposes.
(v) The time period is to be strictly adhered to but the judges may, in case of any
reasonable circumstances provide an extra one minute to the team after which the
client would necessarily leave and the post-consultation period would begin.
(vi) If the extended consultation session allowed an opportunity for a team to gather more
information than other teams, this circumstance should be taken into consideration by
the judges in making their decision. Judges may, in their discretion, penalize teams
that allow the interview session to run longer than the stipulated time period.

POST CONSULTATION:

(i) In the post-consultation period the participants may talk to each other loudly so as to
be audible to the judges or may indirectly address them in any other manner.
(ii) Participants may summarise the interview, indicate the scope of the legal work to be
undertaken, and state the legal issues that should be researched. Explanation of the
position or attitude taken by the students may be useful.
(iii)If the students feel that some documents are appropriate, like a letter to the client
confirming their retention as attorneys, the fee arrangement etc, or a letter to

opposing counsel or to the party with whom the client is having their legal problems
etc., they may dictate such a document at the post consultation stage.
(iv) The time period for post consultation is 5 minutes.
(v) At the completion of the time period of Post-Consultation the judges shall stop the
participants or signal them to stop in an obvious manner. Failure of the participants to
comply with the above rule will attract negative marking as prescribed by the
Organiser to the judges.

CRITIQUE

(i) After the completion of the Post-Consultation period the judges may question the
participants on matters deliberated upon or mentioned by the participants or the client
during the consultation of post-consultation period.
(ii) The judges may ask any question which they consider material and questions meant to
test the participants understanding of the facts and/or law applicable or applied by the
participants in the case.
(iii) The time period for this session is 3 minutes and the judges may extend it by another
2 minutes at their discretion.

3. LAW APPLICABLE

The problems shall be broadly based on but not completely limited to the following
laws and participants are expected to have knowledge of any other ancillary laws and
procedures:
(i) Family Law
(ii) Contracts
(iii) Torts
(iv) Criminal Law
(v) Procedural Law
(vi) Writs, etc.

4. JUDGING CRITERIA (total 100 marks)

1. Alternative Courses of Action (10 marks): Consistent with the analysis of the clients
problem, developed a set of potentially effective and feasible alternatives, both legal and non-
legal.

2. Clients Goals and Expectations (20 marks): Learned the clients goals and initial
expectations; modified or developed these as necessary.

3. Moral and Ethical Issues (10 marks): Recognised, clarified and responded to any moral or
ethical issues which may have arisen, without being prejudicial in judgments.

4. Post-Interview Reflection(20 marks): During the follow up phase, gave evidence of having
recognised their own and the clients feelings, the strengths and limitations of their
interviewing and counselling skills, their handling of the substantive aspects of the clients
problems (legal and non-legal), provided for an effective follow-up.

5. Problem Analysis and Effective Conclusion (20 marks): Analysed the clients problem
with creativity and from both legal and non-legal perspectives, resulting in a clear and useful
formulation of the problem.

6. Teamwork (20 marks): As collaborating counsellors, worked together as a team, with


flexibility and an appropriate balance of participation.

Marks allotted by the Judges shall be final.

III JUDGEMENT WRITING COMPETITION


1. ELIGIBILITY

The participants must be a 3 years LLB or 5 years B.A.LLB pursuing student.

2. STRUCTURE

The structure of the judgment will reflect the forum / court in which the provided case is
set and argued. The structure also follows the Criminal Laws as the competition is based
upon the criminal judgement writing.

3. SUBMISSION

a. There shall be an on spot judgement writing competition.

b. The related question/case shall be provided two (2) hour before the competition.

c. The participants shall compile their judgement within the word limit of 2500 words.

4. EVALUATION CRITERIA (total 100 marks)

i. Format (All the steps of a judgment) 20 Marks

ii. Language, style and Creative interpretation 20 Marks

iii. Facts in brief and Issues 10 Marks

iv. Application of law and justification of decision 20 Marks

v. Ratio Decidendi 10 Marks

vi. Obiter dicta (the judges mind) 20 Marks

5. PRIZE AND CERTIFICATES

Prizes and certificates shall be awarded to the winning participant.

Any other award/prize may be given.

6. JURY

The results announced by the juries will be final. Rules are subject to change.
