ARCHITECTURAL GUIDELINES

Holiday Decorations
Holiday decorations include any outdoor decorations that are displayed for any holiday
throughout the year.(1) These guidelines apply to holiday decorations that are displayed
in public view.(2) The objective of these guidelines is to provide rules for decorations that
complement the appearance of the property and surrounding neighborhood while
maintaining safety and avoiding any public nuisances.

Location Decorations shall generally be located within or along the Lot boundary lines.
Decorations may also be located within the unpaved portion of the street
property adjoining the Lot. No portion of any decorations shall extend into the
concrete paved portion of the street property beyond the edge of the concrete
street curb. (3)(4)

Height Decorations located closer than ten (10) feet from the street curb shall not
have a height greater than 3 feet. (4)(5)

Display Period Decorations may be displayed no more than 45 days before the applicable
holiday and no more than 30 days after the applicable holiday.

Anchorage Large lightweight decorations that are easily blown by wind shall be positively
anchored to the ground and all pieces shall be positively anchored to each
other. (6)

Safety Decorations shall not create a hazard to public safety. (7)

Materials Decorations shall be constructed of suitable standard natural or man-made


durable materials capable of withstanding outdoor weather conditions while
maintaining an attractive appearance. (6)

Sound Decorations with sound elements may be turned on only during the hours of
8:00 am to 11:00 pm and shall not be so loud as to create a nuisance. (8)

Appearance Decorations installed at a location in public view shall not be distasteful,


controversial, inflammatory, offensive, vulgar, or an eyesore. (9)

Notes:
(1) Holidays include any common or nationally recognized holidays established by custom or by law.
(2) Public view is defined as being visible to anyone that is on any street in the subdivision or anyone on the golf course.
(3) As shown on the plat of the Heron Lakes Estates subdivision, the HLEOA street property of Heron Lakes Drive is 60 feet wide. The
concrete street paving including the street curbs is 28 feet wide and is located at the center of the 60-foot-wide property, which
means that the Lot line for houses located along Heron Lakes Drive is located (60-28)/2 = 16 feet from the street curb. The HLEOA
street property of all of the other streets in the subdivision is 50 feet wide and the width of the concrete paving is 25 feet wide,
which means that the Lot line for houses located along Fairway Drive, Maynard Place, Ranic Drive, East Cyrus Drive, West Cyrus
Drive, and Camino Oaks Drive is (50-25)/2 = 12.5 feet from the street curb.
(4) The measurement to the street curb is from the back edge of the concrete street curb closest to the house.
(5) Height restrictions are intended to ensure visibility of drivers at street curves and intersections and homeowners exiting driveways.
(6) If any decorations do not weigh enough to avoid being blown away during high force winds, the decorations could be dislodged or
uplifted from the base and possibly be blown into and damage the house on the Lot or a neighboring home. Poorly manufactured
decorations could be blown apart by high force winds and the pieces could become wind-driven missiles.
(7) The final judgment of whether any decorations are a hazard shall rest solely with the ACC.
(8) Please consider your neighbors when installing decorations with exterior speakers, loud music, horns, whistles, bells, fireworks,
spooky noises, or other loud sound elements. The final judgment of whether any sound elements of any decorations are loud
enough to be considered a nuisance shall rest solely with the ACC.
(9) The final judgment of whether any decorations are distasteful, controversial, inflammatory, offensive, vulgar, or an eyesore shall
rest solely with the ACC.
