Notice to Explain

The matter of your frequent absences has been brought to our attention.

In particular, your attendance records from (date) to (date) show that of the (total of the
working days) working days in the said period, you reported for work only for (number of days
she was present) days. Records show that your absences were not authorized under an
approved leave application. Thus, your absences constituted approximately (percentage of
absences) of the official work days of the said period.

In this regard, please be informed that habitual absenteeism constitutes gross and habitual
neglect of duties, which is a ground for termination under Article 282 of the Labor Code.

In view of the foregoing, you are hereby required to submit a written explanation to this office
within (5) days from receipt of this notice, stating why the Company should not impose the
penalty of dismissal for the act mentioned. Furthermore, you are invited to a conference on
(date of conference) at (venue) where you shall be accorded the opportunity to express
your side on the matter.

Your failure to submit your written explanation within the period provided shall be construed
as a waiver of your right to be heard and the Company shall decide the matter on the basis
of all records and evidence available to it.
