ROAD TRAFFIC

The Traffic Signs (Units of Measure) (Scotland) Regulations and


Directions 2017

Made 7th October 2017

Laid before the Scottish Parliament 21st October 2017

Coming into force 3rd January 2018

The Scottish Ministers make the Regulations in Part 1 of this Instrument in exercise of the powers
conferred by section 64(a) of the Road Traffic Regulation Act 1984(b).

The Scottish Ministers give the Directions in Part 2 of this Instrument in exercise of the powers
conferred by sections 65 and 85(2)(c) of the Road Traffic Regulation Act 1984.

In accordance with sections 65(3ZC) and 134(7) of that Act, the Scottish Ministers have consulted with
the Secretary of State.

PART 1
THE TRAFFIC SIGNS (UNITS OF MEASURE) (SCOTLAND) REGULATIONS 2017

Citation, commencement and extent


1. The Regulations in this Part
(a) may be cited as the Traffic Signs (Units of Measure) (Scotland) Regulations 2017;
(b) may be cited together with Part 2 as the Traffic Signs (Units of Measure) (Scotland)
Regulations and Directions 2017;
(c) come into force on 3rd January 2018; and
(d) extend only to Scotland.

The Traffic Signs Regulations 2002


2. The Traffic Signs Regulations 2002 (S.I. 2002/3113) have effect subject to these regulations.

(a) Section 64 was amended by the Scotland Act 2016 (c. 11), section 41(3) to provide that the powers
previously exercisable by the Secretary of State were also to be exercisable by the Scottish Ministers in
consultation with the Secretary of State.
(b) 1984 c. 27.
(c) Sections 65 and 85 were amended by the Scotland Act 2016, sections 41(4) to (9) and 42(10) to (16) to
provide that the powers previously exercisable only by the Secretary of State were to also be exercisable
by the Scottish Ministers in consultation with the Secretary of State.
Distances to be expressed in metres and kilometres
3. Where the Traffic Signs Regulations 2002
(a) provide that a distance is to be expressed in yards or miles, or
(b) specify a description of a traffic sign where a distance is expressed in yards or miles,
those Regulations have effect as if
(i) any distance expressed in yards were to be expressed (or were expressed) in metres, to
the nearest 10 metre increment, and
(ii) any distance expressed in miles were to be expressed (or were expressed) in kilometres,
to the nearest kilometre increment.

Speed limits to be expressed in kilometres per hour


4. Where the Traffic Signs Regulations 2002
(a) provide that a speed limit is to be expressed in miles per hour,
(b) specify a description of a traffic sign where a speed limit is expressed in miles per hour,
those Regulations have effect as if the speed limit were to be expressed (or were expressed) in
kilometres per hour.

PART 2
THE TRAFFIC SIGNS (UNITS OF MEASURE) (SCOTLAND) DIRECTIONS 2017

Citation, commencement and extent


1. The Directions in this Part
(a) may be cited as the Traffic Signs (Units of Measure) (Scotland) Directions 2017;
(b) may be cited together with Part 1 as the Traffic Signs (Units of Measure) (Scotland)
Regulations and Directions 2017;
(c) come into force on 3rd January 2018; and
(d) extend only to Scotland.

Traffic signs to be replaced


2.(1) A local traffic authority (within the meaning of section 65 of the Road Traffic Regulation
Act 1984) must, on or before the appointed day, where a traffic sign
(a) expresses a distance or yards or miles, or
(b) expresses a speed limit in miles per hour,
replace that traffic sign with, or convert that traffic sign into, a traffic sign which complies with the
Traffic Signs Regulations 2002 as amended by the Traffic Signs (Units of Measure) (Scotland)
Regulations 2017 and as further amended from time to time.
(2) Where a local traffic authority replaces or converts a traffic sign pursuant to paragraph (1)(b),
the speed limit expressed by the replacement or converted sign must be as specified in the below table.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Children and Young People (Scotland) Act 2014 to mandate that local
authorities provide the equivalent of 25 hours of childcare per week (1300 hours per year) for
eligible pre-school children, as defined in section 47(2) of that Act.
