PROBLEM FOR MEDIATION

Ankit, aged 20, is a 3rd year student of Film technology in Pune, India. He is a very active youtuber.
He also has a YouTube channel called as Martial Gypsy. Through his channel, he broadcasts
compilations of funny martial art videos, satirical political videos and similar videos. He is also a
diehard fan of the Game of Thrones (GOT), a popular HBO series. Hence, he started hosting a
special place in his YouTube channel specifically dedicated for the Game of Throne series
showcasing various TV interviews of the cast, behind the scenes of the series and funny videos and
such other videos forecasting plots of upcoming episodes of the series. Once he created an episode
called as Let it Goooooo Goenkas!!!, which is a funny, political, satirical video comparing the
power play of the character Cersei Lannister and Joffrey Baratheon to the throne of seven kingdoms
from GOT with that of their current MLA in the district, one Mr. Rudra Goenka the son of Mrs.
Shubha Goenka, who is the chairman of the political party called as Yuva Kendra Government
(YKG).

YKG headed by Shubha Goenka is currently campaigning for the next MLA elections with
Mr. Rudra Goenka as the candidate again, and the election is due in January, 2018. The video, Let it
Goooooo Goenkas!!! becomes a smash hit in the internet receiving 10 million views within a week
of its release. People started sharing this video in all social networking sites including Facebook,
Instagram, Whatsapp etc. The subtle political humor and the technology used within paved its way
through the netizans mind. Thereafter, Ankit was approached by Netflix, an internet channel in
order to create the first episode for their new series on political satire. Netflix essentially wanted the
first video to be based on Let it Goooooo Goenkas!!!

On the other hand, the election campaign of the YKG was interrupted by the release of
Ankits video. The video had a negative impact on the minds of the people. Even the threads and
comments upon the video in various social networking sites showed the changed perspective
towards the political party. Even few of the NEWS channels noticed the same and started predicting
a fall for the political party. Perplexed by the whole situation Mrs.Shubha Goenka approaches Ankit
to remove the video as its causing a twirl in their election campaigns. Ankit refuses to oblige with
the offer as he had decided to accept the offer from Netflix. Mrs. Shubha tries to convince Ankit to
take down the video from the internet and even threatens him with legal consequences. Enraged
Ankit just walks out of the discussion. After two weeks Ankit as well as Netflix receives legal notice
from Mrs. Shubha Goenka on behalf of YKG seeking immediate deletion of the video or facing
legal consequence. Ankit and Netflix discuss the matter and decide to approach Mrs. Shubha to
resort mediation to amicably resolve their matter.

PROBLEM FOR NEGOTIATION

Keeping in mind the background in the problem for mediation-

Consider that Ankit and Netflix has amicably resolved the issues with Mrs. Shubha Goenka and
decide to enter into a negotiation to draft an agreement to employ Ankit as the screenplay writer and
editor for the first episode of new political satire series called Political Poker. Draft an agreement
between Ankit and Netflix discussing about the upcoming series of Netflix after negotiating the
terms and conditions for the screen writing and its related matters.

PROBLEM FOR CLIENT COUNSELING

Keeping in mind the background in the problem for mediation-

Consider that Mrs. Shubha Goenka is approaching you with respect to the issue regarding the video-
Let it Goooooo Goenkas!!! released in the Internet through a You Tube channel called Martial
Gypsy owned by One Mr. Ankit. This video has caused a negative attitude in the minds of people
which is affecting their current political campaigns for the upcoming MLA elections in January 2018.
Please render appropriate legal advice and possible remedies to Mrs. Goenka.
