TRAGIC SITUATION

Whereas, Paragraph (2), Section 3, of Article XV of the 1987 Constitution which states that
the State shall defend the right of children to assistance, including proper care and nutrition,
and special protection from all forms of neglect, abuse, cruelty, exploitation and other
condition prejudicial to their development. [OK]

Whereas, an orphan (there is a specific definition given by the UNICEF which is what we
use here in the office) is a human being that should also be given a livelihood that is equal of
those children with parents that support their needs in terms of a quality home, quality
education, basic human necessities, supported and guided by an acting parent or parents for
the emotional needs of the child and providing a family like institution. [We can put this sa
definition of terms pag dating sa part of the statute]

Whereas, there is an estimated 1.8 million orphans in the Philippines.

Whereas, in 2012, the Department of Social Welfare and Development

(DSWD) has facilitated the processing of the legal adoption of 6,558
children from 2006 to 2011, or an average of 1,300 children annually.

Whereas, the Inter-Country Adoption Board (ICAB), has placed 4,406

Filipino children for adoption in other countries from 2000 to 2011, or an
average of 400 children annually.

Whereas, the increase of birth rate in the Philippines which is also parallel with the increase
in poverty by the cause of spouses who do not care for family planning, especially for the
cases of those families who are not financially fit has more children than those families who
has the capacity to nurture plenty of children and the increase of illegitimate children will
result to the increase of orphans. (basis? may data ka nakuha related dito?)

Whereas, the Philippines is a country that has been torn by wars and disasters. The most
affected and vulnerable of these hardships are the children.

Whereas, armed conflict which is the same violence that created orphans is also the risk that
these children may get themselves involved to.

Whereas, these children of war often lack access to basic services such as education and
healthcare, these children are forced to join armed groups.

Whereas, natural disasters also caused children to become orphans, due to the latest storm
surge in Tacloban left thousands dead and so many others missing.

Whereas, such condition invites human traffickers to take advantage of the situation and
most especially the children who wander themselves alone through the rubble, looking for
someone to take care of them. (Gusto nga xa ipahati ni mam db kasi hindi xa nagcomply sa
one bill one subject)

Whereas, these numbers are not enough, still many children are still in
orphanages or child care agencies, and it would be for the best interest of
the children if they can be placed in the care of families legally.

Whereas, the DSWD and the ICAB agrees that there is lack of knowledge
and awareness about the legal process involved in adoption.

Whereas, this Act seeks to provide social justice by means of tracking orphans caused about
by armed conflicts and natural disasters, to tie up with concerned government agencies to
facilitate registration of said orphans, to increase public awareness on legal adoption to
prevent the exploitation of children and give them equal quality of livelihood like those of
children who are living with their legitimate parents.
