SECTION 16 OF RA 6657 (Comprehensive Agrarian Reform Law of 1988)

Section 16. Procedure for Acquisition of Private Lands. For purposes of acquisition of private
lands, the following procedures shall be followed:

IDENTIFY THE LAND, THE LAND

OWNERS AND BENEFICIARIES

The DAR shall send its notice to acquire the land to the owners

The landowner, his administrator or representative shall inform the DAR of his
acceptance or rejection of the offer

a deed of transfer in favor of the Whithin 15 days the DAR shall conduct summary
government and surrenders the administrative proceedings to determine the
Certificate of Title and other muniments compensation for the land requiring the landowner

Within 30 days the Land Bank of the

Philippines (LBP) shall pay the landowner The DAR shall decide the case within thirty (30)
the purchase price of the land. days after it is submitted for decision

Receipt by the landowner of The DAR shall deposit with an accessible bank
the corresponding payment designated by the them of the compensation in cash
or in LBP bonds in accordance with this Act

The DAR shall thereafter proceed with the redistribution of the

land to the qualified beneficiaries

* Any party who disagrees with the decision may bring the matter to the court of proper
jurisdiction for final determination of just compensation
