Social Security Act of 2018
COMPULSORY COVERAGE UNDER THE SSS LAW:

Coverage in the SSS Law shall be compulsory upon all employees… and

1. Kasambahays, or domestic workers not over 60 years of age and their employers:
Provided, That any benefit already earned by the employees under private benefit existing plans
at the time of the approval of this act shall not be discontinued, reduced, or otherwise impaired.

2. Spouses who devote full time to managing the household and family affairs, unless that are
also engaged in other vocation or employment which is subject to mandatory coverage, may be
covered by the SSS on a voluntary basis.

3. (SEC 9-A) Self-Employed


a. All self-employed professionals
b. Partners and single proprietors of businesses
c. Actors and actresses, directors, scriptwriters, and news correspondents, who do
not fall within the definition of the term “employee” in Sec 8(d) of this Act;
d. Professional athletes, coaches, trainers, and jockeys; and
e. Individual farmers and fishermen.

4. (Sec 9-B) Overseas Filipino Workers (OFWs)


a. Sea based OFW, and
b. Land based OFW- as defined under RA 8042, otherwise known as the Migrant Workers
Act of 1995. Provided, that they are not over 60 years of age.

SECTION 3: COMPULSORY MEMBERSHIP

1. Those who have not reached the compulsory retirement age, irrespective of employment
status, except members of the Armed Forces of the Philippines and the Philippine National
Police, subject to the condition, that they must settle first their financial obligation with the
GSIS, and contractual who have no employer and employee relationship with the agencies
they serve.

2. Appointive or elective
3. Whether temporary, casual, permanent or contractual w/ e-e relationship (so those under
job orders are not covered)
4. Who are receiving basic pay or salary but not per diems, honoraria or allowances; and
5. Who have not reached the compulsory retirement age of 65 years
