A QUESTION OF RIGHTS

Individuals can make an impact on the


legal system in a number of ways, one of
which is the pursuit of cases through the
courts. In this area of study students
examine an instance where an individual
or group has suffered an abuse of their
rights and sought redress through the
court system. Students investigate an
Australian case and develop an
understanding of ways in which
individuals can shape the law, and
examine instances of people being
empowered by the legal system.
Students discuss the impact of this case
on the legal system and the rights of individuals.

You are a journalist and
you have been asked to
prepare a feature article
on one Australian case
where an individual has
sought redress through
the legal system.
(eg. Banton, Rowe,
Asylum Seekers, Mabo)

As part of your article, the editor has asked you to include:


a definition of a test case and how it can be used to protect rights.
the role that the individual or group played in launching the test case.
the specifics of the Australian case you have chosen
the facts and issues central to the case, including the right/s in question
the laws that applied to the case
the outcome of the case and its impact on the legal system and the rights of
individuals
conflicting attitudes in relation to the issues raised in the case. Have all issues been
resolved?
The editor has also asked you to provide three photos, graphs or maps that link to
comments that you make in the article.

Finally, the editor has asked for a headline for your article. She wants a headline of no more
than six words that sums up the most important point you make in the article.
