(b) Supposing the trial judge imposes a straight penalty of
imprisonment for one year, is the penalty correct in the context of
the Indeterminate Sentence Law? Explain your answer. (3%)

Under the Indeterminate Sentence Law, as applied to
an offense punishable by a special law, the court shall sentence the
accused to an indeterminate sentence expressed at a range whose
maximum term shall not exceed the maximum fixed by the special law,
and the minimum term not be less than the minimum prescribed.

b) No. The imposition of a straight penalty is erroneous.


There should be a range specified, a minimum and a maximum
according to definition given above in a).
