On January 18, 2018, |, Deputy Parker responded to the area of Loring Rd near Highway 51. Dispatch
advised me that the caller stated that a black Ford truck, bearing MS TAG # ‘was parked near
a gate and that chain appeared to be cut. Upon arrival, | observed a black Ford truck with a trailer that
displayed no tag on it parked near the gate in question. | then approached the vehicle and observed an
‘occupant in the passenger seat, | advised the occupant to step out of the vehicle and come speak with
me. The male complied and stepped to the back of the truck. | asked him if| could search his pockets
for weapons, due to seeing a rifle case on a trailer that did not appear to have a weapon in it. | also
observed several items that would be used for hunting in the bed of the truck. This would lead me to a
high possibility of more weapons being near or in the vehicle. He complied. While searching his
Pockets, | recovered a white piece of paper that to the touch felt as if there was something in it.| opened
the paper and recovered a small amount of marijuana. | then asked if he had anything else in the
vehicle to which he stated no. He was then identified by his social security number to be Andrew
Brooks. | then searched the immediate area of the vehicle, the passenger side area, in which Brooks
was occupying to search for more contraband. | observed a clear plastic bag that appeared to be a
vacuum sealed bag sticking out of the glove compartment where Brooks was sitting. | opened the glove
compartment and recovered approximately 8 grams of marijuana inside the clear vacuum sealed bag,
‘The vacuum seal type bag was not sealed but did contain marijuana. Brooks stated the marijuana
belonged to him when asking him. Brooks was then placed in custody for Possession of Marijuana and
placed in the rear of my patrol unit. Brooks was also given his Miranda Rights once he was placed in the
rear of my patrol unit.
| then waited for the owner of the truck to get out of the woods. Game and Fish was called to the scene
to investigate the area in which they were hunting due to Brooks advising me that they left on a
wheeler and told him they were going to put corn out and check food plots. Game and Fish arrived on
‘scene and awaited for the other two occupants to get out of the woods. After his investigation was
complete, | asked the owner of the vehicle if there was anything else illegal in the truck or if there were
any weapons in the truck. He stated no and was identified by his MS DL to be Tonarri Moore. | asked
Moore if he had ever been arrested for anything and he stated years ago and only traffic charges. He
then stated he had been in some trouble years ago and was a convicted felon. Moore verbally
consented to a search of his vehicle, which is registered in his name. | then began a search of the
vehicle with him being present as the owner. | recovered a loaded 45 cal, Kimber Ultra TLE Il located in
‘@ console area of the truck, near the dome lights, commonly where sunglasses and misc papers are
placed in vehicles. Moore stated the firearm belonged to his friend. His friend then stated, "Yes the gun
belongs to me”. | then had the friend who was identified by his MS DL to be Robert Ear! Wilson, step to
the rear of my patrol unit. | asked Wilson if the gun belonged to him and he stated "Actually No". Wilson
went on to say that Moore offered to take him hunting after he did some work for him. Wilson stated,
"He told me that he had a gun in the vehicle and that if we found it he would be in trouble”. Wilson
further stated, "He also asked me to tell you that it was my gun so he would not get in trouble". | then
‘approached Moore and advised him to place his hands behind his back and explained to him he was
being charged with Felon in Possession of a Firearm. | told Moore that | was just advised of what he told
Wilson. Moore then was placed in the back seat of my patrol unit and given his Miranda rights at 1729
hours. | then shut the door and continued to search the vehicle. As | got back to my patrol unit, Moore
stated the gun belonged to Andrew who was currently in the back seat and in custody with him. He then
stated, "Andrew go ahead and tell him its your gun”. Andrew then stated, "Yes its mine’. | then told
‘Andrew that | asked him already if he had any weapons in the vehicle and that he had advised me he
had not. | further advised Moore that he already told me it belonged to Wilson and that now he was
telling me it belonged to Andrew Brooks. Moore further stated that he lets people use his vehicle and
never knows who has firearms in there. | further advised him that with him being a convicted felon that
he should be extra careful and that a owner of a vehicle should always know what is inside his vehicle
at all times, Moore and Brooks were then transported to the Madison County Detention Center for
booking, It was later discovered through NCIC using a the serial number from the firearm that was
recovered that it was stolen and entered on NCIC through Flowood PD. Moore was also then charged
with Possession of a Stolen Firearm. The handgun was a 45 Cal. Kimber Ultra TLE Il (Serial Number
| ater met with Andrew Brooks at the detention center and obtained a statement from him stating that
Moore told him to claim the gun. A written statement from Brooks is added to the file. Photos of the
firearm are also added to the file. The handgun was handled properly to ensure no fingerprints could be
damaged from the gun. The marijuana was also properly sealed and logged into evidence.
