AN ACT
To amend chapter 579, RSMo, by adding thereto one new section relating to the offense of
falsifying a drug test, with penalty provisions.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 579, RSMo, is amended by adding thereto one new section, to be
2 known as section 579.088, to read as follows:
579.088. 1. For purposes of this section, the following terms mean:
2 (1) "Adulterant", any substance designed to be added to human urine or human
3 hair for the purpose of defrauding an alcohol, drug, or urine screening test;
4 (2) "Synthetic urine", any substance that is designed to simulate the composition,
5 chemical properties, physical appearance, or physical properties of human urine for the
6 purpose of defrauding an alcohol, drug, or urine screening test.
7 2. A person commits the offense of falsifying a drug test if the person knowingly or
8 intentionally distributes, offers for sale, sells, delivers, or finances the delivery of an
9 adulterant or synthetic urine with the intent to defraud or assist an individual in
10 defrauding an alcohol, drug, or urine screening test.
11 3. The offense of falsifying a drug test is a class B misdemeanor. However, the
12 offense is a class A misdemeanor if the offender has a prior unrelated conviction under this
13 section.
