[ STATEMENT OF PROBABLE CAUSE / NARRATIVE ]

On 10/28/2016, deputies with the Santa Rosa County Sheriff’s Office responded to a complaint at the Santa Rosa Kids
House in Milton. DCF Investigator, Kelley Sanders, advised deputies that DCF was currently working a case involving an
8 year old victim at
The abuse was disclosed on 10/28/16 while was traveling to a doctor’s appointment
with a Families First Network (FFN) case worker. stated that Charles) has been touching him
"downstairs on his private part." advised that this has happened on a frequent basis, , and it
happens when the with at .

Due to this discloser, an investigation was initiated. Due to concern for the welfare of preparations were made to
while the initial report was being generated. DCF Investigator Sanders contacted
Charles McMullen and advised him that there were allegations being made against him by . Sanders stated
that Charles “began to cry”.

child was in school at the time of the initial report. DCF Investigator Kelly Sanders went to his school to speak with him.
During the initial meeting, disclosed to Sanders that he doesn’t feel safe
(Charles) had been touching him inappropriately. During this initial interview, disclosed the following.
stated that Charles touches him and inappropriately. stated that he is also made to touch Charles.
stated that this has happened more than five times. stated that Charles told him that this was “between you and
me” and to not tell anybody or Charles and Tammy would break up.

Due to this disclosure, a CPT exam was conducted on 10/28/2016 on The CPT exam was conducted by Stephanie
McBride and the Gulf Coast Kids House. During the interview, disclosed the following. was able to clearly
understand that he knew the difference between the truth and a lie. was asked if he knew why he was there to

speak with McBride. stated that it was because (identified as being “Chuck”) has touched his private
parts. pointed to his genitals and identified it as his penis.
Charles would then touch underneath his clothing on his penis. said
that this also occurred in
him on multiple occasions. recalled the first incident being
and that he was 7 years old. He was on 6/09/2016, which would have made 7 years old
at the time. stated that Charles has told him to put his finger in Charles’ “butt”. stated that Charles has also
placed his mouth on penis as well as made him put mouth on Charles’ penis.
described this activity as “gross” whenever he would have to do this to Charles. acknowledged that Charles put his
penis in “butt” at least four times. stated that the last time this occurred was yesterday (10/27/2016).
Charles made put his penis in Charles’ “butt” on at least one occasion. also acknowledged seeing Charles
touch inappropriately on his penis. was asked if anything else occurred. stated that Charles has also
made him touch on his penis. said he never wants to touch boys like that again.

On 11/01/2016, a CPT exam was conducted by Stephanie McBride on The interview was conducted at the Santa
Rosa Kids House in Milton, Florida. was able to clearly understand that he knew the difference between the truth
and a lie. was asked what he wanted to talk about. stated that he knew, but was “embarrassed”.
stated that he was there to talk about Charles (who he refers to as Chuck) touching his “private part”. stated that
Mr. Chuck was touching him “downstairs” (pointing to his penis) with his hand under clothing. stated
that Charles would slide his hand under his shorts . This
occurred at Charles’ residence stated, “He does it to too”. stated that
stated that Charles asks them to

that it happens more than once, mostly once a week, but not sure. stated that he is also made to rub Charles’

happens when you “rub it”. was making a hand motion simulating masturbation of a male penis while describing
this incident. stated that he has told Charles that he doesn’t like to be touched that way. Charles will stop,
however he makes continue to “rub” Charles’ private part. stated that the first time this occurred was in
also stated that he observed rubbing his “balls” on Charles’ “butt crack”.

It should be noted that the two children have not had contact with each other since initially reported the
inappropriate touching to the FFN worker. Neither one knew that the other had disclosed the abuse.

Charles McMullen came to the Sheriff's Office on 11/01/2016 for an interview. After being read Miranda Rights, he spoke
with me concerning the allegations.

McMullen continuously denied having any inappropriate

contact with either of the two victims. He stated that he has never touched them sexually.

ASA James Parker reviewed the two interviews of the victims, and also observed the interview with McMullen. Based on
the interviews and statements that were made, and after conferring with the ASA, I placed McMullen under arrest for
two counts of Capital Sexual Battery and two counts of Lewd and Lascivious Molestation/victim under 12 years of age.

This offense occurred in Santa Rosa County, FL.
