Below is an aerial image depicting the location of the Subject Property and the surrounding area. According to the survey as prepared by Fortin, Leavy, Skiles, Inc., dated October 31, 2017, the Subject Property has a gross lot area of 74,167 square feet or 1.703 acres and currently consists of mostly vacant and unimproved lots. The Applicant seeks to improve the Subject Property with a pedestrian oriented mixed use development which enhances the public realm in conformance with the intent and goals of Miami 21 and will afford more residents the opportunity to live within walking distance of a Metromover station and some of the City’s most important cultural and entertainment venues. The proposed commercial and residential uses will also facilitate the implementation of the OMNI CRA Redevelopment Plan (the “CRA Redevelopment Plan”). The Media and Entertainment District is in great need of additional housing options to serve the thousands of individuals who work in nearby areas. The Subject Property has unparalleled access to varied transportation options, including Miami-Dade County Transit MetroBus, MetroMover and MetroRail systems. The School Board MetroMover station is located one (1) block south of the Subject Property. Alley ‘An unimproved alley traverses the Property along its center in a north-south direction (the “Alley”). The Alley is not paved and is not utilized for vehicular or pedestrian access, including public service and emergency vehicles. ‘On January 8, 2015, the Miami City Commission adopted Ordinance No. 13492 permitting the vacation and closure of certain public alleys that were not being utilized for vehicular and pedestrian access, Please see a copy of the aforementioned ordinance and supporting documentation attached as Exhibit 1. The Alley is one of the unimproved and unused public alleys that were designated to be closed, vacated, and abandoned under Ordinance No. 13492. Specifically, the Alley is identified as No. 157 on the Public Works List of Public Alleys for Vacation and Closure which is incorporated by reference into Ordinance No, 13492. Ordinance No. 13492 reverted ownership of the vacated alleys to the abutting property owners “thereby enabling the owners to secure their property and maintain the alley as part of their yards.” Additionally, Ordinance No. 13492 expressly exempted the alleys being vacated from the replatting requirements of the City Code. Additionally, Ordinance No. 13492 utility easement on the alleys being vacated and closed. Section 4.1(b) of Ordinance No. 13492 states that “if the property owners whose land abuts the alley desire that an easement reservation be released, the property owners must petition the Director of the Public Works Department in writing to request the release of the easement reservation.” (On May 3, 2017, the Applicant submitted a petition to the Director of Public Works requesting that, the easement reservation on the Alley be released. The Applicant is in the process of finalizing this release of easement reservation, Attached as Exhibit 2, please find a copy of the petition for release of the easement reservation, IL FUTURE LAND USE The Future Land Use Map (the “FLUM”) of the Miami Comprehensive Neighborhood Plan (the “Comprehensive Plan”) designates the Subject Property as General Commercial. Additionally, the Subject Property is also located within the Urban Central Business District (“UCBD”) area of the City. Pursuant to the Correspondence Table of the Comprehensive Plan, as depicted below, the Subject Property's General Commercial land use designation is compatible with the proposed T6-24B-O zoning designation. As such, the Applicant is not seeking a FLUM amendment. The FLUM designation of the Subject Property i of the City’s desire to allow greater FLR at the site, Il, ANALYSIS OF REQUEST FOR REZONING Under Miami 21, the current zoning designation of the Subject Property is T6-24A-O. The Applicant requests to rezone the Subject Property to T6-24B-O pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21. As indicated in the Survey, the Subject Property exceeds 40,000 square feet in area and has more than 200 feet of street Frontage along both NE Miami Place and NE Miami Court, As such, the Property meets the threshold criteria for rezoning consideration, Further, for the reasons outlined below, the proposed rezoning is appropriate for the Subject Property, meets the criteria established in Article 7, Section 7.1.2.8 of Miami 21 and, therefore, should be approved (GREENBERG TRAURIG, PA, © ATTORNEYS ATLAW «= WWW/GTLAWCOM Mr. Francisco Garcia January 4, 2018 ‘Arts Luxury Rezoning 2. The Subject Property’s location within the Urban Central Business District supports the rezoning to T6-24B-O. The Subject Property is designated General Commercial and is located within the UCBD. The Comprehensive Plan provides that properties designated “General Commercial” in the UCBD “allow a maximum floor lot ratio (FLR) of 37.0 times the net lot area of the subject property.” (emphasis added). Nonetheless, the current T6-24A-O zoning designation only permits a maximum FLR of 7.0 times the net lot area of the subject property. The proposed T6-24B-O zoning designation permits a maximum FLR of 16 which is more compatible with the thresholds set by the Comprehensive Plan. The Subject Property’s designation as General Commercial and UCBD reflects the City’s vision and intent for the Subject Property and supports the proposed rezoning. The FLUM designation of the Subject Property evinces the City’s desire to allow greater FLR at the Subject Property. The proposed rezoning to 16-24B-O will accomplish the City’s goals through the implementation of its very own Comprehensive Plan. 3. The Subject Property location within the Omni Community Redevelopment Area as well as the Performing Arts Center District supports the rezoning to T6-24B-O. ‘The Subject Property is also located in the OMNI CRA redevelopment area and the Performing Arts Center District (the “PAC Distriet”). In recent years, development of the PAC DISTRICT has made this area a hub of culture, dining, shopping and entertainment. High density and high intensity residential towers dominate the skyline along Biscayne Boulevard across the City’s Museum Park. The existing and proposed multi-family residential uses continue along Biscayne Boulevard into the OMNI and Edgewater areas. The OMNI area has long been seen as the point of connection between Downtown Miami and the areas of Design District, Midtown and Wynwood creating an ideal location for both residents and visitors to live, work and play. The proposed ground floor retail on the Subject Property will create active pedestrian areas by providing connectivity with the surrounding commercial spaces and create a gathering place within the OMNI area for visitors and residents alike. Additionally, the proposed residential development at the Subject Property will benefit the existing businesses in the area by providing a more permanent customer base. 4. The proposed rezoning will permit a cohesive and unified development with increased Floor Area at the Subject Property in accordance with the guiding principles of Miami 21. ‘The Subject Property’s existing T6-24A-O zoning designation permits bonus building floor areas 30% above what is permitted by right; whereas, the proposed rezoning to T6-24B-O will permit a cohesive and unified development by permitting a floor area 40% above the available floor area by right. This increase in floor area will permit increased development which will be consistent with the character, scale and uses of the surrounding area, The increased floor area will permit larger units as well as more functional balconies for the residents of the proposed development. Moreover, the proximity to Downtown Miami enhances the need for maximum lot coverage to further promote the much needed residential and commercial development in the area, as well as an activation of the pedestrian realm, Mr. Francisco Garcia January 4, 2018 Arts Luxury Rezoning 5. The current FLR under the existing zoning is inconsistent with the City’s Comprehensive Plan. ‘Attached as Exhibit 3, is a data sheet comparing the development standards under the existing T6-24A-O and the proposed T6-24B-O. The existing zoning permits a maximum FLR multiplier of 7 for the Subject Property which is inconsistent with the permitted development under the Comprehensive Plan and Miami 21. By right, the Subject Property is permitted development up to forty eight (48) stories, but the current zoning would meet its FLR maximum at approximately fifteen (15) stories. The rezoning to T6-24B-O would permit an FLR multiplier of 16, which would result in development that is consistent with the City’s vision for the Subject Property and the surrounding area given its Comprehensive Plan designation, as well as the availability of mass transit to serve residents and visitors. Additionally, the Subject Property’s Comprehensive Plan designation and current zoning permits a maximum density of 500 dwelling units per acre. Without the rezoning, the Subject Property would not be able to achieve a viable development potential in permitted stories or density under Miami 21 and the Comprehensive Plan. The rezoning will correct this inconsistency in the Subject Property’s current zoning thereby implementing the City’s Comprehensive Plan. 6. An analysis of the development and use pattern for the immediate vicinity of the Subject Property supports the proposed rezoning to T6-24B-O. Below is an analysis of existing and proposed structures in the neighbothood which support the proposed rezoning. All of the properties analyzed below are located within a one-half mile radius of the Subject Property, as required by Section 7.1.2.8(c)(2\(g) of Miami 21. © The Filling Station Lofts located at 1657 N Miami Avenue, directly west of the Subject Property, consists of a 16-story, 81-unit multifamily structure with retail space on the ground floor. See Image 1 below. See Image 2 below. * The Canvas Condominium, currently under construction and located at 1630 NE 1 Avenue, directly east of the Subject Property, consists of a 37-story 513-unit multi- family mixed use development, See Image 3 below. The changing conditions and recent rezonings in the immediate vicinity of the Subject Property warrant the proposed rezoning to T6-24B-O, The rapid growth of the surrounding area supports and demands the zoning change to a higher transect zone designation which will promote growth along transit nodes. The character of the surrounding areas has evolved to consist of higher scale multifamily residential uses which has served as a catalyst in the revitalization of the area and stimulated economic growth and jobs in the Media and Entertainment District and surrounding neighborhoods. ‘The City has recognized the changing character of the surrounding area through the approval of similar rezoning applications. Properties located in the immediate vicinity of the Subject Property have recently been rezoned from T6-24A-O to T6-24B-O. All of the properties analyzed below are located within a one-half mile radius of the Subject Property, as required by Section 7.1.2.8(c)(2)(g) of Miami 21, Below is an analysis of these recent rezonings. Image 7 * On October 16, 2017, the City’s Planning, Zoning and Appeals Board voted to recommend approval of a proposed rezoning from T6-24A-O to T6-24B-O for assemblage of properties depicted below located one (1) block south of the Subject Property, pursuant to Resolution No. PZAB-R-17-065. This rezoning application is pending review by the City Commission. This rezoning application is pending review by the City Commission. See Image 9 below. Image 9 IV. CONCLUSION In light of the foregoing, the Applicant kindly requests that the proposed rezoning of the Subject Property to T6-24B-O be approved. The proposed rezoning is consistent with the scale and character of the structures and uses currently located, and planned, in the vicinity of the Subject Property, compatible with the established land use pattern in the area and complement the surrounding uses and structures. The proposed rezoning will allow the Subject Property to be redeveloped into a pedestrian oriented mixed use project that meets the intent and goals of Miami 21 and implements the Comprehensive Plan’s established goals for the area, ‘The Subject Property is ideally suited for the envisioned pedestrian oriented mixed use development given its location in the Media and Entertainment District and proximity to Downtown, Edgewater, Wynwood and Midtown, and convenient access to public transit and major highways. Approving the proposed rezoning will allow for greater development potential which will further encourage the Media and Entertainment District’s growth as a regional center of domestic and intemational commerce, culture and entertainment. The area is well buffered from other neighborhoods by major roadways which eliminates the potential for land use conflicts. The Subject Property is well served by existing transit infrastructure and would serve more efficiently if it permitted to reach its intended development potential. It is important to note that the multiplier for FLR is the only change in the development standards with the approval of the proposed rezoning. The proposed development at the Subject Property complements the existing developments in the immediate vicinity as well as the City’s efforts to expand the uses in the area to attract visitors and residents alike. The rezoning to T6-24B-O will allow redevelopment to meet the intent and goals of Miami 21, through development standards including required retail frontages, habitable liners, pedestrian friendly development, active facades, etc., improving the property and neighborhood overall Please note that pursuant to Article 7.1.2.8(c)(2)(g) of Miami 21, In conclusion, the proposed rezoning meets the criteria set forth in Secion 7.1.2.8(c)(2)(g) of Miami 21 because it is in conformance with the Comprehensive Plan, the established land use pattern for the adjacent properties and the immediate area, and is in scale with the needs of the neighborhood. Specifically, the Applicant’s proposed rezoning is consistent with Miami 21’s intent and the zoning and comprehensive plan designations for the adjoining properties and neighborhood of expanding mixed uses and urban development to the Omni area.
