Plaintiffs MELITA WEBB and ETHAN WEBB are adult individuals, husband afd wi residing at the above address. 2. Defendant COMMONWEALTH OF PENNSYLVANIA - DEPARTMENT OF GENERAL ‘SERVICES (herein Commonwealth) is a political subdivision of the Commonwealth of Pennsylvania pursuant to 42 Pa. CS Section 8501 et seq., with a principal place of business at the above address. 3. Defendant MARGO L. DAVIDSON is an adult individual residing at the above address. 4. The within lawsuit is actionable against defendant Commonwealth of Pentigyivania - Department of General Services pursuant to 42 Pa. C.S.A. § 8501 et seq. 5 Atall times relevant, Defendant Margo L. Davidson was the agent:kervant 2 employee of defendant Commonwealth of Pennsylvania and acted atall times televant within thecourss and scope of her agency or employment 6 — Onor about September 1;.2015, at approximately 4:30 P.M., plaintiff Melita Webb was operating her 2010 GMC automobile, PA tag ZGF1234, south on Lansdowne Avenue, at or near the area of Fairview Avenue, in Lansdowne, Delaware County, PA, and was stopped for traffic, 7, At the above time and place, defendant Margo L. Davidson was operating the 2014 Dodge station wagon, Pennsylvania tag JKL5678, owned by defendant Commonwealth of Pennsylvania, south on Lansdowne Avenue, at or near the area of Fairview Avenue, in Lansdowne, Delaware County, PA, and was traveling immediately behind plaintiff's vehicle when she failed to stop and struck the rear of plaintiff's vehicle, causing injuries and damages to plaintiffs which will be set forth below with particularity 8. The aforesaid collision was due to the negligence of defendant Margo L. Davidson, which consists of some or all of the following particulars: {a) failure to stop; (b) failure to observe stopping or braking vehicle in roadway; (C) traveling at excessive rate of speed; (4) failure to observe the point and position of other vehicles in the roadway; (€) failure to observe the assured-clear-distance-ahead rule: (f) following too closely; (g) violations of statutes and ordinances of Pennsylvania Motor Vehicle Cade. COUNT ONE — PLAINTIFF MELITA WEBB v. DEFENDANTS, Plaintiffs incorporate by reference the foregoing allegations as if set forth fully at length. 9. Asa direct and proximate result of the aforesaid collision, Plaintiff Melita Webb suffered serious personal injuries including, but not limited to, the following: injury to the left shoulder: injury to the neck; injury to the back; pain and suffering and other injuries, some or alll of which may be Permanent in nature. 10. As further direct and proximate result of the aforesaid collision, Plaintiff Melita Webb incurred various medical expenses in an effort to effect a cure for her injuries, and she may be expected to incur such expenses in the future, all to her great detriment and loss. 11. Asa further direct and proximate result of the aforesaid collision, Plaintiff Melita Webb was unable to attend to her usual and daily duties and occupations, and she may be expected to be so’ prevented in the future, all to her great detriment and loss. 12.” As a further direct and proximate result of the aforesaid collision, Plaintiff Melita Webb suffered the loss of life's pleasures, and she may be expected to suffer such a loss in the future, all to her great detriment and loss WHEREFORE, Plaintiff Melita Webb demands judgment against the Defendants, jointly and severally, in an amount not in excess of ($50,000.00) Dollars, together with interest, costs and damages for delay COUNT TWO - PLAINTIFF ETHAN WEBB DEFENDANTS Plaintiffs incorporate by reference the foregoing allegations as if set forth fully at length. 13. Atall times relevant, Plaintiff Ethan Webb was and is the husband of Plaintiff, Melita Webb. 14. Asa direct and proximate result of the aforesaid negligence of Defendant, Plaintiff Ethan Webb suffered the loss of the consortium services of his wife, Plaintiff Melita Webb, and he ‘may so suffer in the future, all to his great detriment and loss. WHEREFORE, Plaintiff Ethan Webb demands judgment against the Defendants, jointly and severally, in an amount not in excess of Fifty Thousand ($50,000.00) Dollars, together with interest, costs and damages for delay.
