PARIS ACCORD FOR THE IMPLEMENTATION OF THE PARIS AGREEMENT

The Parties to this Agreement,

Recalling the United Nations Framework Convention on Climate Change and in


particular its objective and principles, and emphasizing specially the principles of
historical responsibility and common but differentiated responsibilities, [based on an
understanding that historical responsibility and common but differentiated
responsibilities] are dynamic concepts, (Principles)

Acknowledging that all states and all peoples shall cooperate in the crucial task of
lessening the impact of climate change and its consequent effects, hence all states thus
undertake to take full account of their respective annual emission levels and each
state’s proportionate responsibility shall be based upon such levels.

Reaffirming that economic and social development and poverty eradication are global
priorities and human rights and climate justice should guide international and national
efforts to address climate change,

Reaffirming also the right of each State to economic development which shall be
accorded paramount consideration and which must not sacrifice the environment, and
that sustainable development shall be of utmost concern,

Emphasizing the applicability of the United Nations Declaration on Human Rights and
all other international human rights conventions, agreements and instruments to the
issue of climate change, [including the remedies provided by these conventions,
agreements and instruments for human rights violations,] (climate justice]

Recognizing that reductions in global emissions will be required to achieve the ultimate
objective of the Convention to make sure that temperature increase does not go beyond
[1.5] [2] degrees Celsius, [principles]

ADOPTS this accord to implement the Paris Agreement:

1. The obligations of all Parties under this Protocol shall be based on the principles
set forth in Article 3 of the United Nations Framework Convention on climate change,
with particular emphasis on historical responsibility and common but differentiated
responsibilities, [knowing that such principles have evolved because of the changing
economic circumstances of countries], [guided by equity, taking into account specifically
per capita emissions], [complemented also by the principle of burden-sharing that is fair,
just and equitable] [guided also by the principle of proportionality, with each State
reducing greenhouse gas emission in the amount proportionate to their contribution to
greenhouse gas emission and to their economic capacity] [guided likewise by human
rights and justice]. (principles)
2. [All Parties [shall] [should] pursue low carbon economic and development
pathways, including enhancing and developing renewable energy policies and
measures, as well as efficient energy use. Land use change and forestry programs and
activities that reduce deforestation and forest degradation [shal] [should] also be
implemented. (principles)

3. These pathways shall be implemented through the Nationally Determined


Contributions (NDCs) offered by the Parties and which are hereby annexed to this
Agreement. These NDCs are [voluntary] [legally binding] [implemented on a best effort
basis]. (principles)

4. Developing countries, in accordance with national development priorities and


taken in the context of sustainable development, [legally] commit to undertake
\Nationally Determined Contributions (INDCs), that are measurable, reportable and
verifiable (MRV). The rules for MRV shall in accordance with the specific circumstances
of countries, based on equity and common but differentiated responsibilities. The
implementation of these commitments by developing countries [shall] [should] [legally]
supported and enabled by technology, finance and capacity building provided by
developed [and developing countries with capacity] countries in a measurable,
reportable and verifiable way. (principles)

5. Developing country parties [shall] [should] implement activities and programs that
reduce deforestation and forest degradation, and other such activities and programs
that otherwise enhance natural forest and sustainable land use, [provided that
safeguards that protect forest communities and peoples, promote good governance,
and ensure environmental integrity are followed. In particular, the principles of free and
prior informed consent and other common property based rights shall be respected.]

6. To achieve sustainable development in the midst of climate change, states shall


undertake to take on measures of adaptation to counter its adverse effects. They
[should] [shall] offer adaptation programs as NDCs. [Developed states shall bear
greater responsibility in providing access to means and methods of adaptation to
developing nations more significantly affected by such effects.] (support)

7. Parties to the Convention shall implement adaptation programs, including


support each other in adapting to climate change. All [developed country] parties shall
contribute to an adaptation fund [in accordance with the needs of the most affected
developing country parties such as island states and less developed countries] [in
accordance with the needs of all affected developing country parties] [taking into
account the needs of all affected developing parties]. Developing countries [can choose]
[are obliged based on their capacity] to assist other developing countries in
adaptation.(support)

8. Parties acknowledge the importance of financial assistance, and the need of


[scaled-up] and adequate funding in dealing with the mitigation and adaptation
challenges of climate change, taking into account [as a priority] the urgent and
immediate needs of countries that are [most] vulnerable to the adverse effects of
climate change. (support)

9. States will ensure the acceleration of the development of climate change


research. Climate change technologies will be delivered [without or at minimum cost
and regardless of intellectual property rights] to help all Parties in understanding and
addressing climate change better. (support)

10. The Parties agree to further enhance the Green Climate Fund established in
Durban to provide the financial resources needed to implement this agreement. All
[developed country parties] [parties with capacity] shall contribute to the Green Climate
Fund. [Delivering these financial resources shall be a legally binding obligation.]

11. The Green Climate Fund shall be supported mainly by government contributions
[but shall also include contributions from the private sector andthe carbon market], and
other innovative sources. [Majority of the funds shall be from developed countries.]

12. [The Partiers agree to negotiate a system of compliance beyond reporting and
review, one that will enumerate consequences for failure to achieve commitments and
provide for sanctions for non-compliance.] (climate justice)

13. The Warsaw International Mechanism for loss and damage is hereby adopted. It
can be used to secure [compensation] assistance] for loss and damage arising from
climate change. (climate justice)

14. [The Parties agree to negotiate a system of liability that will allow Parties and
affected communities and peoples to have access to mechanisms of redress that will
ensure climate justice.] [The system [shall] [should] [may] include agreement on the
mandatory jurisdiction of the International Court of Justice for climate change justice
cases.] (climate justice)

15. This agreement [is legally binding on] [will be implemented on a best effort basis
