Counsel has an opportunity to interview custody cases in the “lockup”, but for non-custody cases a duty attorney is asked to represent that client without an opportunity for discussing the case with the new client. Of course, if there is a bail issue, counsel will take the ‘opportunity to talk to the “off the floor client”. but if there is no bail issue, then generally a date is assigned, you give your client your card and ask your client to call you to make an appointment for an office conference. When Ms, Toop came to the bar and I was assigned by the Judge, Eleanor C. Sinnott Ms. Toop showed me a document in which she was listed as a “material witness” (Exhibit “A”, attached), | reviewed the document and told the Court that the document Ms. Toop had presented was not germane to the issue before the Court at that time and that 1 would review the matter with Ms. Toop.
