Philippines, under oath, hereby deposes and states that;

1. I am duly appointed and the incumbent Branch Manager

of Bendita Appliances Corporation Digos Branch,
organized and existing under the laws of the Philippines.
2. Milo Richards is a previous employee of Bendita as branch
manager in Digos Branch in the year 2010.
3. In a meeting for the purposes by the Board of Directors
of the said Corporation held on March 5, 2018, the
following resolutions were passed and approved, viz

“RESOLVED”, as it hereby resolved, that Ms. Lily Mendoza is

hereby authorized to represent, speak and act for and behalf
of Bendita Appliances Corporation, for the filing of the civil
case of Collection of Sum of Money with Damages against
Milo Richards.
4. The foregoing resolutions have, to date, have not been
amended, revoked, or repealed and its constituted in
accordance with the minute of books of the corporation
which are in my custody.

when you were still the Digos Branch Manager.

Please submit your written explanation within 10 days from

the date this Notice was served to you.

Dear Sir,

As you have failed to give an explanation, despite demands,

of the missing inventories during your time as Branch
Manager of the company in the year 2010, please settle or
remit the total amount of P394, 009.50 which includes the
missing inventories, erroneous release, unauthorized
released, etc., less partial payment as per record, on or
within 50 days from the date of this latter.

Should further legal action be necessary in this matter, you

will be held responsible for any future attorney’s fees and
costs incurred in addition to those set forth above.

Despite the lapse of time given in the first demand letter we

sent, you failed to remit or pay the said amount or to make
arrangement for the settlement of said account.

Please settle or remit the total amount of P394, 009.50

which includes the missing inventories, erroneous release,
unauthorized released, etc., less partial payment as per
record, on or within 30 days from the date of this latter.

This is our final demand. Should further legal action be

necessary in this matter, you will be held responsible for any
future attorney’s fees and costs incurred in addition to those
set forth above.
