The case of Penaflor v.

Outdoor Clothing 1 involved another instance of forced resignation, which the


Court found to amount to constructive dismissal. In this case, petitioner Penaflor was initially hired as
probationary Human Resource Department Manager of respondent Outdoor Clothing Manufacturing
Corporation. According to Penaflor, his relationship with Outdoor Clothing went well during the first few
months of his employment. He even designed and created the company’s Policy Manual, Personnel
Handbook, Job Expectations, and Organizational Set-Up during this period. However, when the
company’s Vice President for Operations, Edgar Lee, left the company after a big fight between Lee and
Chief Corporate Officer, Nathaniel Syfu, Penaflor claimed that he was among those who bore Syfu’s ire
because of his close association with Lee.
