MOTION FOR POSTPONEMENT

Plaintiff, through the undersigned counsel, and to this Honorable Court,


most respectfully avers that:

1. The trial for the above-entitled case which was initially scheduled on
May 3, 2010 was declared a non working holiday, the trial of this case was set on
that date and cancelled and reset to June 25, 2010;

2. That on the order of the Honorable Court dated March 26, 2010, the
petitioner and the subject child Angel Trish Sarmiento/Natasja Charmaine
Sabater, through the respondents, were ordered to undergo a DNA Testing to
determine maternal filiation;

3. In compliance with the above order, a DNA Testing was conducted


between petitioner and the subject child on April 19, 2010 at the University of the
Philippines DNA Analysis Laboratory, Diliman, Quezon City at the expenses of
the petitioner;

4. As communicated by the expert witness, Dr. Ma Corazon De Urgia, who


facilitated and supervised the taking of DNA samples from the parties, she is not
available on the re-scheduled trial on June 25, 2010 based on previous
scheduled engagement;
5. That this Motion is filed in good faith and not for the purpose of
delaying the proceedings of the above-entitled case.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed of this


Honorable Court that the trial scheduled June 25, 2010 be reset to August 10,
2010 that is most convenient to the calendar of this Court.
