AFFIDAVIT OF WITNESSES

I, NADEJA JOY C. PERALTA of Legal age, married, and with a mailing

address of Vicenza 3 Block 1 Lot 1 Citta Italia Subdivision, Mambog 3, Bacoor ,
Cavite, Philippines, after having been sworn in accordance with law, do hereby
depose and state THAT:

1. I was present and personally saw that accused, Melanie Avergonzado,

committed the crime of Libel on July 1, 2023 at 6:49 in the evening against the
victim Mr. Gilbert Go and Mrs. Maria Consuelo Villamor;

2. I was one of those who took the video recording of the libelous statement
made by the Respondent from my house which is so proximate to the venue of the
said General Assembly.
 3. We file an earlier complaint in the Barangay Mambog 3, Bacoor, Cavite
together with the complainant against the Respondent Melanie A. Avergonzado
because she called me, demanding and threatening me to back out in my candidacy
for Board of Director in our Homeowners Association otherwise she will exposed
to the public and the neighborhood that Mr. Gilbert Go and Mrs. Maria Consuelo
Villamor stole the money from the Association. I replied to her that it was already
settled issues asking her what her motive for such claim is. I had already known
that she has a grievous plan about it so we file a complaint in the Barangay. We
already warned her in the Barangay the if she will commit an act to destroy
anyone’s reputation with her malicious spreading of stories and to destroy one’s
reputation, we will file a case in Court, but she replied “what is your proof”. The
rumor continue to spread yet we just waited for evidence to surface until July 1,
2023 General Assembly exposed it all in the Public with the huge crowd and the
use of large Sound System with microphone. There was malicious, public
humilation and the complainant were fully identified in that event.

I executed this affidavit to attest the truthfulness of the foregoing facts and to
support the filing of Criminal against Melanie Avergonzado for the violation of
Article 353, in relation to Article 355 of the Revised Penal Code of the Philippines
and for Civil charges which may apply to this Case.
